It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/SGR/2018/8423779 dated 04/10/2018 valid upto 30/09/2023 and the Air Act, 1981 vide no. CTOA/Renewal/SGR/2018/8423749 dated 04/10/2018 valid upto 30/09/2023, for manufacturing of Sorted Raw Rice (with dryer) @ 5.0 TPH by using Paddy @ 7.5 TPH as raw material under orange category. Now, the industry has applied for obtaining renewal of consent under the Water Act, 1974 and the Air Act, 1981 for manufacturing of Sorted Raw Rice (with dryer) @ 5.0 TPH by using Paddy @ 7.5 TPH as raw material under orange category. The industry had deposited consent fee of Rs. 5,600/- vide R.No. 526376210 dated 17/09/2023 under the Water Act, 1974 and Rs. 7,900/- (Rs. 5600/- consent fee + Rs. 1800 NOC fee + Rs. 500/- application fee) vide R.No. 271974428 dated 17/09/2023, under the Air Act, 1981, against the fixed assets of value i.e. Rs. 89.50 Lacs as per CA certificate date 15/09/2023. The deposited fee is adequate upto 30.09.2024 under the both the Acts. The Rice sheller has also requested to grant the CTO upto 30.09.2024. There is increase (Rs. 17.05 lacs) in the value of fixed assets as compare to the last CA certificate provided by the industry in this office. In this regard, the industry has submitted that earlier, the land of rice sheller is on lease but now, the land is on the name of Sh. Hardev Singh (Partner in the rice sheller), who is the only owner of the land. It has been also mentioned in the undertaking that there is no addition in the land.It has also deposited Rs. 1,800/- through online vide R. No. 271974428 dated 17/09/2023 as NOC regularization fee, which is adequate. The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. . Hence case is being processed without visit .Moreover Sheller is also not in operation due to off season. No complaint is pending against the industry. The industry was found complying with consent conditions during last visit and consents were granted thereafter. Keeping above in view, it is recommended that consent to operate granted under the Water Act, 1974 may be renewed up to 30/09/2024(upto adequacy of fee) for manufacturing of Sorted Raw Rice (with dryer) @ 5.0 TPH by using Paddy @ 7.5 TPH as raw as raw material under orange category with usual conditions.
