<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; background: white;">It is intimated that the stone crusher was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/HSP/2022/20489240 & Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/HSP/2022/20489238 dated 21.12.2022, which were valid upto 30.09.2023 with conditions mentioned therein.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; background: white;">Now, the stone crusher has applied for renewal of consent to operate under Water Act and Air Act. The industry has submitted earlier granted consents, CA Certificate, mining registration of mining department, slips of mining. The industry has already deposited Rs. 54000/- vide UTR No. N229232599134140 dated 17.08.2023 under Air Act, <span style="mso-spacerun: yes;"> </span>Rs. 54000 vide UTR No. N229232599134140 dated 17.08.2023 under Water Act, Rs. 54500/- vide receipt No. 000138520948 dated 17.08.2023. The fee submitted by the industry is adequate upto 30.09.2028. Earlier, the stone crusher has submitted bank guarantee of Rs. 1.00 lacs and same was expired on 08.02.2017.<span style="mso-spacerun: yes;"> </span>The was asked vide this office letter no.1597 dated 31.05.2021, 2936 dated 28.09.2021, 3573 dated 29.12.2021 and 815 daetd 28.06.2023 to submit the extended bank guarantee, but the industry has failed to submit the bank guarantee in this office till date. </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1;">It is further submitted that Board issued order vide no. CEE (HQ)F.No. 957/2016/59 dated 2/2/2016 regarding to grant of auto renewal consent to establish/consent to operate to the Orange & Green category industries. The industry is complying with the conditions of consents granted earlier under Water Act, 1974 and Air Act, 1981. The industry falls in Orange category in small scale sector and competency to decide the case lies with Environmental Engineer, Regional Office, Hoshiarpur. </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: normal; background: white;"><span style="font-family: 'Tahoma','sans-serif'; color: black; mso-themecolor: text1;">In view of above, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be refused due to reasons mentioned above.<span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span></span></p>
