CTOA/Renewal/FDK/2016/4838331 dated 16.12.2016 for</span></span><span lang="PA" style="font-size: 12.0pt; line-height: 115%; font-family: 'Raavi','sans-serif'; mso-ascii-font-family: 'Bookman Old Style'; mso-hansi-font-family: 'Bookman Old Style'; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; color: black; mso-themecolor: text1; background: white;"> </span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; color: black; mso-themecolor: text1; background: white;">operation of brick kiln to produce brick & tiles @ 30,000 numbers/day, with validity up to 30.09.2026, su</span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">bject<span style="color: black; mso-themecolor: text1;"> to conditions mentioned therein.</span> A public notice was issued by the Board in all the leading newspapers on 02.11.2018 regarding orders of Hon’ble NGT, New Delhi dated 24.10.2018 with the directions to all brick kilns in the State of Punjab to not to operate on bull trench kiln technology w.e.f. 01.02.2019 and it was also clearly mentioned in the public notice that the consent to operate already granted to the brick kiln will automatically deemed to be suspended w.e.f. 01.02.2019.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">The brick kiln was visited by the officer of the Board on 05.02.2019 and it was observed that the brick kiln was in operation without adopting induced draft zig-zag technology. As such, the consent to operate granted to the industry under Air Act, 1981 was revoked vide Board’s letter no. 547-47 dt. 07.02.2019. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 was issued to the BKO with the direction to the brick kiln to stop its operation immediately failing which legal action will be initiated against the brick kiln alongwith the direction to the District Food & Civil Supplies Officer, Department of Food, Civil Supplies & Consumer Affairs, Faridkot to cancel the license of the brick kiln vide Board's letter nos. 1184 and 1187 dt. 20.02.2019, respectively.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">The order dated 28.05.2019 of the Government of Punjab. Department of Science, Technology and Environment was conveyed to the brick kilns vide Board's letter no. 4090 dt. 27.08.2019 for compliance and the District Food & Civil Supplies Officer, Department of Food, Civil Supplies & Consumer Affairs, Faridkot was also made aware of the Government notification dated 28.05.2019 vide Board’s letter no. 4760 dated 17.10.2019 alongwith request to comply with the directions of the Board dated 08.03.2019 to cancel the license of the brick kiln.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">The District Food & Civil Supplies Officer, Department of Food, Civil Supplies & Consumer Affairs, Faridkot again failed to submit any compliance to the Board regarding cancellation of license of the subject cited brick kiln.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">The brick kiln was again visited by officer of the Board on 13.03.2020 and it was observed that the brick kiln was in operation without adopting Induced draft zig-zag technology and was found violating the provisions of Air (Prevention & Control of Pollution) Act, 1981 and the order dated 28.05.2019 passed by the Government of Punjab, Department of Science, Technology & Environment by invoking powers u/s 5 of the Environment (Protection) Act, 1986, intentionally & deliberately.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">The matter was considered by the Competent Authority of the Board and it was decided that legal action may be taken against the brick kiln under section 37 (I) of the Air Act, 1981 as well as against the District Food & Civil Supplies Officer, Department of Food, Civil Supplies & Consumer Affairs, Faridkot under section 41 of the said Act for non complying with the directions issued to them u/s 31-A of the Air Act, 1981 after affording an opportunity of personal hearing.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">Sh. Varinder Kumar, DFSC submitted that the matter was investigated on 19.03.2020 and the brick kiln was found in operation without adopting induced draft zig-zag technology. Accordingly, the license issued to the brick kiln was suspended and the brick kiln owners were directed to submit their reply in the matter, however no reply was received and accordingly personal hearing was given to the brick kiln on 29.05.2020, wherein it was informed by the representative of the brick kiln that due to shortage of skilled man power, delay has occurred in adopting the new zig-zag technology and it was further informed that in order to obtain more time for conversion to the new technology, the case has been filed in the Hon’ble Punjab & Haryana High Court. The brick kiln was again given personal hearing on 11.06.2020, wherein it was informed by the representative of the brick kiln that the Hon’ble Punjab & Haryana High Court has directed that no coercive action is required to be taken until the decision in the matter. Since, the matter is pending in the Punjab & Haryana High Court, accordingly, legal advice has been sought from the Director, Department of Food & Civil Supplies and further action will be taken thereafter. He further informed that now the BKO is not in operation due to suspension of license.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">Sh. Neeraj Kumar, representative of the brick kiln submitted his reply in writing and the relevant extract of which is as under :</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify;"><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">1.</span></em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;"> <em>The brick kiln has deposited the requisite fee for the feasibility report to be prepared by M/s CBRI-Roorke. That the brick kiln could not be converted to the Induced draft zig-zag technology due to the shortage of the skilled man power.</em></span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify;"><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">2.</span></em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;"> <em>That in order to obtain some more time for conversion to Induced draft zig-zag technology, a court case has been filed with petition no. CWP 4754 of 2020 which has been clubbed alongwith the already ongoing court case related to the brick kiln bearing no. 22165/2019.</em></span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify;"><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">3.</span></em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;"> <em>That the order dated 28.05.2019 of the Govt. of Punjab, Department of Science, Technology & Environment is under stay by the Court and further the court has issued orders in CWP 22165 of 2019 dated 03.10.2019 that in case of any coercive action taken by the State of Punjab, it shall be open to the petitioners to approach the court.</em></span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify;"><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">4.</span></em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;"> <em>That the brick kiln will comply with any orders passed by the Hon’ble Punjab & Haryana High Court in the matter.</em></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">After going through the matter, it was observed that no stay has been imposed by the Hon’ble Punjab & Haryana High Court regarding induced draft technology with zig-zag setting. After hearing the officers of the Board and representative present in the hearing, it was decided by the Competent Authority of the Board that:-</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify;"><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">1.</span></em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;"> </span><em><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white; mso-ansi-language: EN-IN;">The brick kiln will not operate its unit without converting to induced draught zig-zag technology and without obtaining consent to operate of the Board.</span></em></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify;"><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">2.</span></em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;"> </span><em><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white; mso-ansi-language: EN-IN;">In case the brick kiln is found violating the decision mentioned at S.No. 1 above, legal action will be initiated against the brick kiln, without any further notice / opportunity</span></em><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white; mso-ansi-language: EN-IN;">.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">Thereafter, the brick kiln was visited by this office on 14.01.2022 and it was observed that the brick kiln has converted into induced draft technology and has neither submitted the completion certificate from the concerned technical provider for adoption of induced draught zig-zag technology and nor applied for obtaining consents to operate. As such, the brick kiln was issued show cause notice for violation of the provisions of the Water Act, 1974 & the Air Act, 1981 vide this office letter no. 198 dated 27.01.2022 to submit its reply in writing or in person within 10 days.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">Further, the Hon'ble Punjab and Haryana High Court has given an order in CWP no. 4754/2020 dated 19.07.2023, relevant part of which is as under:</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify;"><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">"Learned counsel for the parties submit that the present writ petition has been rendered infructuous with the passage of time as well as in view of the fact that the Supreme Court is in seisin of the dispute in Civil Appeal Diary No(s). 18213/2021 titled as </span></em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">NCR Brick Kiln Association Vs Central Pollution Control Board and others<em>.</em></span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify;"><em><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">In view of the aforesaid statement made by learned counsel for the parties, the present writ petition stands dismissed as infructuous."</span></em></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">Now, the brick kiln has applied for obtaining consents to operate under the Air Act, 1981 & the Water Act, 1974 for operation of the brick kiln to manufacture of bricks & tiles @ 30000 numbers/day. Details of the case are as under:-</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">i)<span style="mso-tab-count: 1;"> </span>The kiln has submitted the completion certificate issued by CBRI, Roorkee dated 25.01.2021 regarding that brick kiln has constructed Induced Draught Brick Kiln with Zig-zag technology, rectangular in shape as per CSIR-CBRI design. Design details given by our licensee M/s Pollution Consultants & Engineers, Faridabad via drawing no. 20/1448 and completed construction as per norms.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">ii) <span style="mso-tab-count: 1;"> </span>The kiln has submitted CA certificate dated 11.09.2023, showing gross fixed assets of Rs. 63.72/- (including lease value of Rs. 45 lacs for 10 years) as on 31.07.2023.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">iii)<span style="mso-tab-count: 1;"> </span>The kiln has deposited consents fee of Rs. 54,000/- vide UTR/Ref. no. 426353311 dated 11.09.2023 under the Water Act, 1974, which is adequate upto 30.09.2033 and consent fee of Rs. 37,500/- (including Rs. 3600/- of NOC regularization fee) vide UTR/Ref. no. 33690783 dated 11.09.2023 under the Air Act, 1981, which is adequate upto 30.09.2033 after adjusting fee, as per office order dated 29.10.2018.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">iv)<span style="mso-tab-count: 1;"> </span>The kiln has submitted an undertaking (duly attested by CA) through proprietor Balwant Rai S/o Sh. Madan Gopal R/o Jaitu has declare as under:- </span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 115%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">That the entries made in the coal register are true and correct and may be taken as documentary evidence.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 115%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">That brick kiln was operated with FCBTK technology upto 25.06.2020 and thereafter the kiln has not been operated till adoption of induced draught<span style="mso-spacerun: yes;"> </span>Zig Zag technology after obtaining completion certificate from CSIR-Central Building Research Institute, Roorkee.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 115%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">That the brick kiln has adopted induced draught zig zag technology and obtained completion certificate from CSIR – Central Building Research Institute, Roorkee on 25.01.2021.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 115%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">That the brick has been operated by using only coal as a fuel for its operation and no other fuel was used for its operation.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 115%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">That the brick kiln shall use 20% paddy straw pallets as a fuel.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: .75in; mso-add-space: auto; text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;"> </span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">v)<span style="mso-tab-count: 1;"> </span>The kiln has deposited EC of Rs. 3,75,000/- (Rs. 3,25,000/- R. No. 36/5546 dated 11.09.2023 & Rs. 50,000/- R. No. 39/5546 dated 22.09.2023), which is adequate for operation of brick kiln with FCBTK technology from April, 2019 to June, 2020.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">The brick kiln has been visited by this office on 15.09.2023 and it was observed as under:-</span></p>
<p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">1. <span style="mso-tab-count: 1;"> </span>The brick kiln was not in operation.</span></p>
<p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">2. <span style="mso-tab-count: 1;"> </span>The brick kiln has upgraded its kiln into induced draft zig-zag technology. AVFD fan has been provided with the chimney and the length the central island of brick kiln was found less than 245 feet.</span></p>
<p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">3. <span style="mso-tab-count: 1;"> </span>The brick kiln has provided adequate sampling facilities with kiln stack to facilitate emission sampling.</span></p>
<p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">4. <span style="mso-tab-count: 1;"> </span>The kiln has stabilized the periphery road/movement area with brick bats/keri.</span></p>
<p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">5. <span style="mso-tab-count: 1;"> </span>The brick kiln has planted trees along its boundary.</span></p>
<p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">6. <span style="mso-tab-count: 1;"> </span>The brick kiln has provided septic tank for the treatment of domestic effluent and same is being discharge onto land for plantation.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">Thus, the brick kiln is complying with the provision of the Water Act, 1974 and Air Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">Keeping in view of above, it is recommended that:</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">A. Consents to operate under the Water Act, 1974 and Air Act, 1981 may be granted to the brick kiln for production of bricks & tiles @ 30,000 nos./day using induced draft zig-zag technology for a period of 30.09.2033, respectively, with suitable conditions and specific as under:-</span></p>
<p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">1. The consent is subject to the orders passed by the Hon’ble Punjab & Haryana High Court/Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order.</span></p>
<p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">2. The consent is subject to the performance evaluation of new technology adopted by the brick kilns.</span></p>
<p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">3. The BKO shall replace 20% of fuel with paddy straw based pellets, all the times.</span></p>
<p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; background: white;">4. The BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacture of bricks and submit the same, within two months.</span></p>

The industry shall comply with code of practice prescribed for operation of brick kilns and shall be liable to achieve the prescribed standard notified by CPCB/PPCB from time to time.</span></p>
