It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/SGR/2022/19842868 dated 12/09/2022 valid upto 30/09/2023 and the Air Act, 1981 vide no. CTOA/Renewal/SGR/2022/19842786 dated 10/09/2022 valid upto 30/09/2023, for manufacturing of Raw rice (without Sortex & without dryer) @ 1.0 TPH by processing of Paddy @ 1.5 TPH as raw material under orange category in the name of Sh. Abhishek Goyal, (Partner). Earlier, there were 04 partners in the rice sheller namely Sh. Shanky Goyal s/o Sh. Atma Ram, Sh. Rajesh Garg s/o Sh. Gopal Krishan, Sh. Tanuj Garg s/o Sh. Gopal Krishan and Sh. Abhishek Goyal s/o Sh. Atma Ram. Thereafter, the rice sheller has submitted dissolution deed dated 01.05.2023, as per which 02 partners got retired from the rice sheller namely Sh. Abhishek Goyal s/o Sh. Atma Ram and Sh. Shanky Goyal s/o Sh. Atma Ram. Now, the rice sheller has submitted new partnership deed dated 01.05.2023, as per which there are now 02 partners namely Sh. Rajesh Garg s/o Sh. Gopal Krishan and Sh. Tanuj Garg s/o Sh. Gopal Krishan running the rice sheller. Now, the industry has applied for obtaining renewal of consent under the Water Act, 1974 and the Air Act, 1981 for manufacturing of Raw rice (without Sortex & without dryer) @ 1.0 TPH by processing of Paddy @ 1.5 TPH as raw material under orange category in the name of Sh. Tanuj Garg (Partner). The industry had deposited consent fee of Rs. 18,000/- vide R.No. 993168000 dated 03/08/2023 under the Water Act, 1974 and Rs. 18,500/- (Rs. 18,000/- consent fee + Rs. 500/- application fee) vide R.No. 443218971 dated 03/08/2023, under the Air Act, 1981, against the fixed assets of value i.e. Rs. 59.42 Lacs as per CA certificate date 30/07/2023. The deposited fee is adequate upto 30.09.2028 under the both the Acts. The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.  As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. Hence case is being processed without visit .Moreover Sheller is also not in operation due to off season.   Further, it is intimated that there is no change in the underappreciated value of the fixed assets. No complaint is pending against the industry. The industry was found complying with consent conditions during last visit and consents were granted thereafter. Keeping above in view, it is recommended that consent to operate granted under the Water Act, 1974 & under the Air Act, 1981 may be renewed up to 30/09/2028 upto adequacy of consent fee for manufacturing of Raw rice (without Sortex & without dryer) @ 1.0 TPH by processing of Paddy @ 1.5 TPH as raw as raw material under orange category subject to certain conditions to be mentioned therein and a special condition that the industry will got analyzed its stack emission sample from Board’s lab or Board’s approved lab in coming season.
