CTOW/Renewal/SGR/2019/11019712 dated 10/09/2019 valid upto 30/09/2023 and the Air Act, 1981 vide no. CTOA/Renewal/SGR/2020/13404210 dated 05/09/2020 valid upto 30/09/2023, for manufacturing of Raw Rice (without Sortex machinery and without Dryer) @ 1.0 TPH by using Paddy @ 1.5 TPH as raw material under orange category in the name of Sh. Rajesh Kumar, (Partner).</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">Earlier, there were 10 no. partners in the rice sheller namely, (1) Smt. Ashu Goyal w/o Sh. Munish Kumar, (2) Sh. Rajesh Kumar s/o Sh. Manohar Lal, (3) Sh. Ashwani Kumar s/o Sh. Manohar Lal, (4) Smt. Kamlesh Rani w/o Sh. Joginder Pal, (5) Smt. Sangita Rani w/o Sh. Mohinder Pal, (6) Sh. Joginder Pal s/o Sh. Chiranji Lal, (7) Sh. Mohinder Paul s/o Sh. Chiranji Lal, (8) Sh. Mukesh Kumar s/o Sh. Sohan Lal, (9) Sh. Rohit Kumar s/o Sh. Mohindar Pal and (10) Smt. Veerwanti Rani w/o Sh. Ashu Goyal w/o Sh. Munish Kumar, Sh. Rajesh Kumar s/o Sh. Manohar Lal, Sh. Ashwani Kumar s/o Sh. Manohar Lal, Smt. Kamlesh Rani w/o Sh. Joginder Pal and Smt. Sangita Rani w/o Sh. Mohinder Pal and as per partnership deed executed on 11.09.2017, 05 no. partners were running the rice sheller namely, Sh. Joginder Pal s/o Sh. Chiranji Lal, Sh. Mohinder Paul s/o Sh. Chiranji Lal, Sh. Mukesh Kumar s/o Sh. Sohan Lal, Sh. Rohit Kumar s/o Sh. Mohindar Pal and Smt. Veerwanti Rani w/o Sh. Sohan Lal.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">Thereafter, a new partnership deed executed on 10.08.2020, as per which the 5<sup>th</sup> partner of the rice sheller namely Smt. Veerwanti Rani w/o Sh. Sohan Lal gives has been died and Smt. Nishi Goyal w/o Sh. Mukesh Kumar has joined the partnership.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">Now, the industry has applied for obtaining renewal of consent under the Water Act, 1974 and the Air Act, 1981 for manufacturing of Raw Rice (without Sortex machinery and without Dryer) @ 1.0 TPH by using Paddy @ 1.5 TPH as raw material under orange category in the name of Sh. Mukesh Kumar (Partner). </span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">The industry had deposited consent fee of Rs. 5500/- vide R.No. 548832547 dated 17/08/2023 under the Water Act, 1974 and Rs. 6000/- (Rs. 5500/- consent fee + Rs. 500/- application fee) vide R.No. 514657329 dated 17/08/2023, under the Air Act, 1981, against the fixed assets of value i.e. Rs. 5.69 Lacs as per CA certificate date 01/08/2023. The deposited fee is adequate upto 30.09.2029<span style="color: red;"> </span>under the both the Acts.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';"><span style="mso-spacerun: yes;">&nbsp;</span>As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green &amp; white categories" which also includes the consent period for which the consents are to be granted to red, orange &amp; green category industries for five years, ten years &amp; 15 years respectively. </span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange &amp; Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. </span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">Further, it is intimated that there is no change in the underappreciated value of the fixed assets.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">No complaint is pending against the industry. The industry was found complying with consent conditions during last visit and consents were granted thereafter.</span></p> <p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: 8.0pt; text-align: justify; text-indent: 63.8pt; background: white;"><span lang="EN-US" style="font-size: 12.0pt; font-family: 'Verdana','sans-serif';">Keeping above in view, it is recommended that consent to operate granted under the Water Act, 1974 &amp; under the Air Act, 1981 may be renewed up to 30/09/2029 (upto adequacy of fee) for manufacturing of Raw Rice (without Sortex machinery and without Dryer) @ 1.0 TPH by using Paddy @ 1.5 TPH as raw as raw material under orange category subject to certain conditions to be mentioned therein and a special condition that the industry will got analyzed its stack emission sample from Board&rsquo;s lab or Board&rsquo;s approved lab in coming season.</span></p>
