File Note: <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-family: Tahoma, 'sans-serif';">Discussed.</span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-family: Tahoma, 'sans-serif';">As per record file, report of Deputy Commissioner, Rupnagar issued vide no. 9948-50 dated 21.04.2014, the unit was visited by the team constituted at District level and found the unit is located within 50 m from the guide bandh provided on right side of the river Sutlej and therefore, it is required to be shifted from present location by 31.08.2015.&nbsp;&nbsp;&nbsp;</span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-family: Tahoma, 'sans-serif';">Further, as per record file, a CWP no. 21899 of 2012 titled as Surmukh Singh vs State of Punjab was heard by Hon&rsquo;ble Punjab and Haryana High Court in the matter regarding stone crushers. In the said case, an application CM-14442 &amp; 14568-CWP-2015 in CWP-21899-2012 was also heard and the Hon'ble Punjab &amp; Haryana High Court vide orders dated 22.01.2016 has directed to constitute a Site Appraisal Committee under Rule 5 of the Punjab Minor Mineral Rules, 2013 to inspect the new location of the applicant-Stone Crushers and submit its reply with reference to the compliance of the notification dated 30.07.2013 and/or any other relevant parameters. The committee has inspected the crushing units alongwith M/s lal Kila Screening Plant, Saidpur and found to be having distance more than 50 m from outer edge of river/choe.</span></p> <p class="MsoNormal" style="margin-bottom: 8pt; text-align: justify; line-height: 17.12px;"><span lang="EN-US" style="font-family: Tahoma, 'sans-serif';">Previously the unit was located in the khasra no. of 10//10, 9/1, 2/1, 3/1 which was not complying with the siting criteria as per STP, SAS Nagar memo no. 277 dated 12.03.2021. Therefore, the industry shifted its machinery to khasra no. 10//10 and 11/1 only. According to the fresh report of Tehsildar and DTP Rupnagar, it is now complying with the siting criteria.
