It is submitted that the industry is an Induction Furnace and Concast unit and was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/LDHKH/2019/11584527 dated 18/11/2019 and under the Air Act, 1981 vide no. CTOA/Renewal/LDHKH/2019/11584502 dated 18/11/2019 both valid upto 30/09/2023 for the manufacturing of Steel Ingots and Castings or Concast Billets @ 84 MTD and Round, Squares, Bars, Flats, Angle and Other rolled products @ 84 MTD. Thereafter, the industry has obtained Consent to establish (NOC) under Water Act, 1974 & Air Act, 1981 vide no. CTE/Exp/LDHKH/2023/20889009 dated 20/04/2023 valid upto 05/03/2024for manufacturing of MS Billets/Concast Billets/Flats/HR Coil/TMT Bars/Pipes/ ERW Pipes (189400 TPA) @ 541 MTD with suitable conditions and special conditions mentioned therein. Now, the industry has applied for obtaining varied 'consent to operate' under the Water Act, 1974 & under the Air Act, 1981for manufacturing of MS Billets/Concast Billets/Flats/HR Coil/TMT Bars/Pipes/ ERW Pipes (189400 TPA) @ 541 MTD by installing 30 TPH Induction furnace with requisite documents under orange category. The industry has deposited consent fee of Rs. 366000/- vide UTR. no. BARBR52023090800969878 dated 08/09/2023 under the Water Act, 1974 and Rs. 366000/- vide UTR. no. BARBR52023090800970114 dated 08/09/2023 under the Air Act, 1981 against total fixed assets of Rs. 7170.41 lakhs as on 30/08/2023 as per CA certificate dated 31/08/2023, which is adequate upto30/09/2027 under the both acts. The industry has submitted a copy of building plans approved by Charanjit Singh Ubhi, Executive Officer, Municipal Council, Khanna, Distt Ludhiana vide no. File/B.A. No. PB/LDH/Khanna/178730 dated 03/07/2023. Accordingly, the industry was visited by the AEE of this office on 06/10/2023 and partner of the industry was present during the visit. During the visit, it was observed as under: 1.            Theindustrywasin operation during visit. 2.            The industry has already installed 1 no. induction furnace of capacity 7 TPH provided side hood type suction hood for fugitive emissions as per design and specifications provided by the PSCST, Chandigarh. 3.            The industry has now installed 1 no. induction furnace of capacity 30 TPH provided side hood type suction hood for fugitive emissions as per design and specifications provided by the PSCST, Chandigarh. 4.            The industry has submitted Provisional certificate issued by PSCST vide no.405 dated 27/09/2023. 5.            The APCD was in operation and the industry is maintaining record of the same. 6.            The industry has installed 2 nos. D.G sets of 320 KVA &150 KVA, which is equipped with canopies and stack of adequate heights. 7.            The whole water to be used for cooling purposes is being re-circulated. There is generationb of domestic effluent for which it has providedseptic tank andthe treated domestic effluent is discharged onto land for plantation. 8.            The industry has provided paved/interlocking tiles at entry/exit and has also stabilized the movement area. 9.            TheindustryiscomplyingwithSOPslaiddownbytheBoard. 10.         The stack emission sampling of the industry was carried out by Board's Lab on 05/04/2023 induction furnace of capacity 7 TPH and as per the analysis results, the concentration of SPM was analyzed as 34 mg/Nm3 against the prescribed standards 150 mg/Nm3. 11.         The industry has not submitted any agreement/report regarding annual maintenance for APCD.                                         The industry is located in Industrial Zone as per notified Master Plan of Khanna.               The industry has submitted amended Environmental Clearance Vide No. SEIAA/MS/2022/ 969 dated 21/09/2022regarding installation of 1 induction furnace of capacity 30 TPH in place of the earlier proposed 2 induction furnace of capacity 15 TPH each without change in other machinery.                   The industry has submitted compliance report of EC granted to it in annotated form and the same were verified by undersigned during visit.(Copy enclosed)                   It is submitted that the Govt. of India, Ministry of Jal Shakti, Deptt. of Water Resources RD&GR Central Ground Water Authority, New Delhi has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter no. CGWA-21/6/2020-CGWA-101 dated 06/04/2022 “that it shall be mandatory for the Project Proponent abstracting ground water to obtain NOC from CGWA or the concerned State/ UT Ground Water Authority as the case made be in the compliance condition in consent to operate and consent to establish issued by the State Pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions.                     PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.                     In the subject cited case, the industry has mentioned ground water extraction @ 108 KLD. Considering 30 working days in a month during season, so ground water extraction will be 3240 KL/month, which is more than 300 KL/month. As such the unit is required permission from PWRDA. The industry has already obtained permission fresh water consumption @ 3135 KLDfrom PWRDA vide no. PWRDA/05/2022/L2/373 dated 13/05/2022 with the comment in the validity section that it has only valid upto 3 months from the date of issuance of Final guidelines issued by PWRDA and the industry has not obtained permission after the guidelines issued on 27/01/2023.                    In view of the above, it is recommended that the varied consent to operate under the Water Act, 1974 may be refused and the Air Act, 1981 may be granted i.e upto 30/06/2024 for manufacturing of MS Billets /Concast Billets / Flats / HR Coil / TMT Bars/Pipes/ERW Pipes (189400 TPA)@ 541 MTD with suitable conditions and special conditions that: 1.        The industry shall submit stack emission analysis report from Board’s lab for induction furnace of capacity 30 TPH with one month. 2.        The industry shall comply with the guidelines for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA). 3.        The industry shall comply with the guidelines/SOPs provided by PSCST, Chandigarh in the effective operation of APCD. 4.        The industry shall not dispose off its Hazardous waste to any unauthorized vendor. 5.        The industry shall execute annual maintenance contract (AMC) for APCD from the repute agency and submit the report within one month. 6.        The industry shall not use any scrap containing Hazardous waste like shockerscontainingwasteoil. 7.        The project proponent shall not throw, burn o rburry any solid wastes in open,out side premises or in drain/water bodies. 8.        The project proponent shall promote use of  alternatives  of  single  use  plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER)activities.(See attached banner). 9.        The project proponent shall ensure that there are no usages of single use plastic-thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons ,straw etc. and single used eco rating material made of plastic-thermocal or any other non-bio degradable material lin the premises. 10.     The project proponent shall properly  handle  and  manage  the  solid  wastages  as per the  provisions of the  Municipal Solid Waste  Rules 2016 and ensure  that the solid waste is segregated & disposed of in an environmentally sound manner.                                                                                 Time Line Large-Orange Date of receipt of case 27-09-2023 Date of scrutiny of case 29-09-2023 Target Date for deemed approval Competency 13-11-2023(30 working days) (Competency C.E.E.)
