CTOW/Varied/SGR/2021/17056147 dated 06/10/2021, valid upto 30/09/2026 and under the Air Act, 1981 vide no. CTOA/Varied/SGR/2021/17038306 dated 06/10/2021 valid upto 30/09/2026, for manufacturing of Sorted Raw Rice (with Dryer) @ 2.0 TPH by processing of paddy @ 3.0 TPH as raw material, with certain conditions mentioned therein in the name of Smt. Amarjit Kaur, (Proprietor). </span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 1.0in; line-height: 106%;"><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Tahoma',sans-serif; background: white;">The industry has submitted the death certificate of Smt. Amarjit Kaur. The industry has also submitted wasiyat nama from Smt. Amarjit Kaur. In which it is states that Sh. Jaspal Singh is the nominee of Smt. Amarjit Kaur of her all property.</span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 1.0in; line-height: 106%;"><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Tahoma',sans-serif; background: white;">Now, the industry has applied for varied consent to operate under the Water Act, 1974 and under the Air Act, 1981 due to change in the proprietor only, for manufacturing of Sorted Raw Rice (with Dryer) @ 2.0 TPH by processing of paddy @ 3.0 TPH as raw material, with certain conditions mentioned therein in the name of Sh. Jaspal Singh, (Proprietor).</span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 1.0in; line-height: 106%;"><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Tahoma',sans-serif; background: white;">The industry had already deposited consents fee amounting to Rs. 42,000/- vide UTR No. BKIDN21272817300 dated 29/09/2021 under the Water Act, 1974 & Rs. 42,000/- vide UTR No. BKIDN21272816635 dated 29/09/2021 under Air Act, 1981, against the value of gross fixed assets of Rs. 117.39 lacs (as per CA certificate submitted by the industry dated 18/09/2023), which is <strong>adequate upto</strong> <strong>30/09/2026</strong>.</span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 1.0in; line-height: 106%;"><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Tahoma',sans-serif; background: white;">The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 1.0in; line-height: 106%;"><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Tahoma',sans-serif; background: white;">As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. </span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 1.0in; line-height: 106%;"><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Tahoma',sans-serif; background: white;">The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 1.0in; line-height: 106%;"><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Tahoma',sans-serif; background: white;">It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. </span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 1.0in; line-height: 106%;"><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Tahoma',sans-serif; background: white;">No complaint is pending against the industry. The industry was found complying with consent conditions during last visit and consents were granted thereafter.</span></p>
<p class="MsoNormal" style="margin-bottom: 8.0pt; text-align: justify; text-indent: 1.0in; line-height: 106%;"><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Tahoma',sans-serif; background: white;">Keeping in view of above, it is recommended that varied consent to operate (CTO) under Water Act, 1974 and the Air Act, 1981 may both be granted up to <strong>30/09/2026 (upto adequacy of fee)</strong>, for the production of Sorted Raw Rice (with Dryer) @ 2.0 TPH by processing of paddy @ 3.0 TPH as raw material, subject to the suitable conditions as per policy of the Board </span><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Verdana',sans-serif;">and a special condition that the industry will got analyzed its stack emission sample from Board’s lab or Board’s approved lab in coming season</span><span style="font-size: 12.0pt; line-height: 106%; font-family: 'Tahoma',sans-serif; background: white;">.</span></p>
