<p class="MsoListParagraph" style="text-align: justify; text-indent: 1.0in; tab-stops: 157.5pt 178.5pt;"><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;">It is intimated that the industry is a small scale red category industry and has been granted Consent to operate under the Water Act, 1974 vide no. </span><span lang="EN-IN">CTOW/Renewal/LDH4/2023/21394284</span><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;"> and under the Air Act, 1981 vide no. </span><span lang="EN-IN">CTOA/Renewal/LDH4/2023/21394340 </span><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;">dated 09.08.2023 both are valid upto 30.08.2023 with special condition that :-</span></p>
<p class="MsoListParagraph" style="margin-left: 108.75pt; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo3; tab-stops: 157.5pt 178.5pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif; mso-fareast-font-family: 'Segoe UI';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;">The industry shall not operate between 10:00 pm to 06:00 am keeping in view of the grievance of the complainant.</span></p>

<p class="MsoListParagraph" style="margin-left: 108.75pt; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo3; tab-stops: 157.5pt 178.5pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif; mso-fareast-font-family: 'Segoe UI';"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;">If industry found violating the provision of Water Act, 1974 and Air Act, 1981 then the temporary restoration of electric connection will be withdrawn without giving any opportunity.</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: 1.0in; tab-stops: 157.5pt 178.5pt;"><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;"><span style="mso-spacerun: yes;"> </span>Direction u/s 33-A of the Water Act, 1974 and Air Act, 1981 for temporarily restoration i.e. up to 30.08.2023 of electric connection of the industry has also been issued vide Board’s 4410-13 dated 10.08.2023.</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: 1.0in; tab-stops: 157.5pt 178.5pt;"><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;"><span style="mso-spacerun: yes;"> </span>It is further intimated that the industry was given personal hearing before the Chief Environmental Engineer, Ludhiana on 04.10.2023, wherein it was decided as under: -</span></p>
<p class="MsoListParagraph" style="margin-left: 113.25pt; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo2; tab-stops: 157.5pt 178.5pt;"><!-- [if !supportLists]--><strong><em><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif; mso-fareast-font-family: 'Segoe UI';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em></strong><!--[endif]--><strong><em><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;">The industry shall submit revised DTP certificate regarding classification of area/ suitability of site, within 15 days.</span></em></strong></p>
<p class="MsoListParagraph" style="margin-left: 113.25pt; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo2; tab-stops: 157.5pt 178.5pt;"><!-- [if !supportLists]--><strong><em><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif; mso-fareast-font-family: 'Segoe UI';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em></strong><!--[endif]--><strong><em><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;">The industry shall submit Action Plan regarding shifting of its unit in the designated industrial area, within 15 days.</span></em></strong></p>
<p class="MsoListParagraph" style="margin-left: 113.25pt; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo2; tab-stops: 157.5pt 178.5pt;"><!-- [if !supportLists]--><strong><em><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif; mso-fareast-font-family: 'Segoe UI';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></em></strong><!--[endif]--><strong><em><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;">Environmental Engineer, Regional Office-4, Ludhiana shall visit the industry, verify its contentions, comments on genuine of the complaint and submit report along with conclusive recommendations within 7 days accordingly.</span></em></strong></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: 1.0in; tab-stops: 157.5pt 178.5pt;"><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;">Now, the industry has applied for renewal of the same along with requisite documents. The industry has deposited Rs. 15840/- vide UTR No. N275232665226629 dated 02.10.2023 under the Water Act, 1974 and Rs. 15840/- vide UTR No. N275232665226632 dated 02.10.2023, out of which, Rs. 14400/- considered as air consent fee ad Rs. 1440 as NOC regularization fee. The consent fee is adequate up to 31.01.2023 under Air Act, 1981 and up to 31.03.023 under Water Act, 1974 against the CA certificate of Rs. 385.70 lacs.</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: 1.0in; tab-stops: 157.5pt 178.5pt;"><span lang="EN-IN" style="font-size: 11.5pt; font-family: 'Segoe UI',sans-serif;">The industry was visited on 10.10.2023 by the undersigned and it was observed as under: -</span></p>
<p class="MsoNormal" style="margin-left: .75in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo1;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;">The industry was in operation and engaged in manufacturing of tractor parts.</span></p>
<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo1; margin: 0in 0in 0in .75in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;">The industry has provided 01 electroplating section, 01 acid pickling section, 05 oil fired forging furnaces, power presses, CNC machines and other allied machinery. </span></p>
<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo1; margin: 0in 0in 0in .75in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;"><span style="mso-spacerun: yes;"> </span>The industry has provided adequate stack height with the forging furnaces. </span></p>
<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo1; margin: 0in 0in 0in .75in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;">The industry has installed 02 separate water meter for electroplating section and pickling section and readings of the same are 392.02 KL and 22.05 KL respectively.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo1; margin: 0in 0in 0in .75in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;">The industry has consumed fresh water from 01.06.2023 to 10.10.2023 @ (392.02-343.2) = 48.32 KL for electroplating process. Opening balance stored as on 01.06.2023 was 295 ltrs as per record maintained by the industry. The industry has got lifted @ 37 KL of effluent in the said period. The industry has provided a storage tank of capacity about 5 KL and approx. 3500 ltr of effluent was stored in it. </span></p>
<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo1; margin: 0in 0in 0in .75in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;">The industry has consumed fresh water from 01.06.2023 to 10.10.2023 (22.05-15.72) = 6.33 KL for pickling section and got lifted @ 4.95 KL of spent acid in the said period. <span style="mso-spacerun: yes;"> </span>Opening balance stored as on 01.06.2023 was noted as 50 Ltr as per record. The industry has provided a storage tank of capacity 500 ltr, which was full up to brim. The industry has consumed 119 ltrs of acid in the said period as per record. </span></p>
<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo1; margin: 0in 0in 0in .75in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">7.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;">The industry has submitted detail of increase plant and machinery, as per which the industry has installed forging die block, CNC machine part chip conveyer, chain pulley blocks, draw die and machine pump for coolant. </span></p>
<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo1; margin: 0in 0in 0in .75in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">8.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;">The industry has made an agreement with M/s Charanjeet and Company @ 1500 Ltr/month for lifting of spent acid and with M/s JBR Technologies @ 10,000 Ltr/month for lifting of electroplating effluent. </span></p>

<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; margin: 0in 0in 0in .5in;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;"> </span></p>
<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; margin: 0in 0in 0in .5in;"><strong><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;">It is pertinent to mention here that the</span> </strong><strong><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;">Department of Housing and Urban Development vide its notification no. 08/05/2023-441/2208 dated 06.10.2023 has allowed the existing industries lying in residential zone (within & outside MC) of Master Plan, Ludhiana for further 03 years i.e. from 11.09.2023 to 10.09.2026 and as per Regional Office-2, Punjab Pollution Control Board, Ludhiana’s letter no. 610-12 dated 31.08.2023, the Competent Authority of the Board has decided to grant further consents as per policy of the Board to the industries falls in industrial mix zone. Further,as per DTP letter no. 168/DTP(L)/M2A dated 27.01.2023, the site of the said industry falls in Mix Land Use Zone along the Road Front and there is no mention to grant CTO to such industries which falls in Mix Land Use Zone along the Road Front in above said orders. Further, the industries in Mix Land Use Zone along the Road Front can only be allowed beyond 4 kilometers from the municipal limits of Amritsar, Jalandhar and Ludhiana Corporations, 3 Kilometers from the limits of other corporations and Class-A town limits and 2 kilometers from other towns as per letter no 5780-5816 CTP(PB)/SP-135 dated 24.09.2021 of Directorate of Town and Country Planning. The said industry is about 01 KM from the MCL limit. </span></strong></p>
<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; margin: 0in 0in 0in .5in;"><strong><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;"> </span></strong></p>

<p class="MsoNormal" style="mso-add-space: auto; text-align: justify; margin: 0in 0in 0in .5in;"><span style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US;">Keeping in view of the above, it is recommended that SCN for refusal of CTO under the Water Act, 1974 and Air Act, 1981 may be issued to the industry, please.</span></p> |
