<a name="_Hlk143875987"></a>It is submitted that the industry was granted consent to establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/FGS/2023/22736521 dated 06/09/2023, which is valid upto 05/09/2024 for manufacturing of Metal Doors & Partitions @ 100000 Number/Year and Metal Windows @ 25000 Number/Year subject to the suitable terms and conditions mentioned therein. Now, the industry has applied for obtaining fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Metal Doors & Partitions @ 100000 Number/Year and Metal Windows @ 25000 Number/Year alongwith requisite documents and consent fee. The industry has submitted the CA certificate dated 17/10/2023, wherein, the total value of fixed assets of the industry is Rs. 930.15 lakhs with value of plant & machinery is Rs. 911.16 lakhs. Accordingly, the industry has deposited consent fee of Rs. 54,000/- vide UTR No. BKIDY23296664085 dated 23/10/2023 under the Water Act, 1974 and Rs. 54,000/- vide UTR No. BKIDY23296664155 dated 23/10/2023 under the Air Act, 1981. As such, the fee deposited by the industry under the both Acts is adequate upto 30/09/2026 as per Board's office order dated 29/10/2018.                     The industry has submitted copy of lease deed dated 05/06/2023 executed between Sh. Bhagwant Singh and M/s GMP Technical Solutions Pvt. Ltd. for lease out the industrial building, which is valid for 02 years. The industry has also submitted the approved Amendment/Expansion Factory Building Plans under section-6 of the Factories ACT, 1948 and Punjab Factories Rules 1952 from Director of Factories, Punjab vide no. DOF230861680 dated 01/08/2023.                          To verify the contents of the application, the industry was visited by the AEE on 03/11/2023 and Sh. Hardeep Singh, HR Head was contacted. During visit, it was observed as under:- 1.        The industry was in operation. 2.        The industry has installed 1 CNC machine, moulding machine, 3 LPG fired oven and 1 fully covered powder coating section. 3.        The industry has installed cyclone as APCD with closed powder coating section to contain the concentration of the particulate matter. 4.        The industry has installed 01 DG set of capacity 360 KVA, which is equipped with canopy and stack of adequate height. 5.        The industry has not installed any boiler/furnace. 6.        No water is used in the process. As such, no trade effluent is being generated from the process. 7.        The industry has provided septic tank for the treatment of domestic effluent. The industry has provided saplings along the boundary wall.   The Board vide letter no. 1955-57 dated 18/01/2023 has informed that department of Water Resources (RD and GR), Central Ground Water Authority, Ministry of Jal Shakti Govt. of India, New Delhi under Section 5 of the Environment (Protection) Act, 1986 has issued directions vide order dated 6/4/2022 that “It shall be mandatory for the project proponent abstracting ground water to obtain No objection Certificate from Central Ground Water Authority or the concerned State/UT Ground Water Authority as the case may be in the compliance conditions in consent to operate and consent to establish issued by the State pollution control Board”. PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month. In the subject cited case, the industry has mentioned ground water extraction @ 5 KLD. Considering 25 working days in a month during season, so ground water extraction will be 337*135 = 45 KLD, which is less than 300 KL/month. As such the unit requires permission from PWRDA. From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.                     In view of above, it is recommended that fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry upto 30/09/2026 (upto adequacy of consent fee) for manufacturing of Metal Doors & Partitions @ 100000 Number/Year and Metal Windows @ 25000 Number/Year subject to the suitable conditions and additional conditions as under: 1.    The industry shall not generate and discharge any kind of trade effluent. It shall discharge only domestic effluent onto land for plantation after passing through septic tank. 2.    The industry shall inform the Board in writing as and when any change is occurred in the Partnership Deed/ Proprietorship/ Memorandum of Article of Association, especially with regard to the name and address of the Partner/ Proprietor/ Director/ Subscriber etc. and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed/ Proprietorship/ Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken. 3.    The industry shall not install shot blasting/sand blasting without the prior approval of the Board. 4.    The industry shall not carry out any surface treatment i.e. Phosphating/Pickling/Electroplating, etc. without prior permission of the Board. 5.    The industry shall not install any boiler/furnace without the prior permission of the Board. 6.    The industry shall not carry out any activity which cover under the ambient of EIA notification 14.09.2006.   Scale – Medium (Orange) Date of Receipt of Application – 26/10/2023 Date of Scrutiny – 30/10/2023 Date of Visit – 03/11/2023 Date of Deemed Approval – 11/12/2023 (30 working days) Competency – CEE
