It is submitted that the industry is a hot mix plant and earlier it was granted consent to operate under the Water Act, 1974 & the Air Act, 1981 vide nos.  CTOW/Varied/FZL/2018/8402227 and CTOA/Varied/FZL/2018/8401105 dated 07/09/2018, both expired on 30/09/2022 for operation of hot mix plant for production of Pre-Mix @ 170 MTD by using Stone Aggregates & Bitumen @ 170 MTD as raw material, under Orange category, subject to the suitable conditions mentioned therein and following special conditions: 1.    The industry will comply with the notification no.Admn./SA-2/F.No.178/99/03 dt. 26.04.99. 2.    A suitable dust control system for the dryer and mixer to contain/recycle permissible fines in the mix should be provided. It should be capable of preventing for exhaust of fine dust into atmosphere from both ends of the dryer drum by creating adequate negative pressure. 3.    The plant should have centralized control panel/cabin capable of pre-setting controlling/synchronizing all operation, starting from feeding of cold aggregates to the discharges of hot mix to ensure proper mixing. It should have adequate water scrubbing mechanism to completely remove/control the dust coming out of the drier with proper provisions of re-circulation system for the scrubber water. 4.    Bitumen must be mixed with aggregate as soon as it is heated and dried and second time lifting of the dried aggregate for proper batching should be avoided. 5.    All roads/vehicular movement areas at site of Hot Mix Plant should be pucca/stabilized with stone aggregate and regular sprinkling of water be ensured so that no dust is generated with vehicular movement. 6.    The fine dust arrested by wet scrubber and collected in the re-circulation water tank should be collected and filled in a pit to be covered with fresh earth. This exercise should be repeated as and when dust is removed from the re-circulation tank. 7.    Hot Mix Plant must have proper stack heights for the discharge of its scrubber flue gases and bitumen heating system with proper platform and port holes as per the Punjab Pollution Control Board norms.                   Thereafter, the HMP was visited by office of the Board on 28.12.2019 and it was observed as under:- 1.    Both the hot mix plants i.e. batch type and continuous type were not in operation as per the requirement of the industry, however large quantities of raw material has been stored at the site. 2.    The industry has installed 2 DG sets of capacity 380 KVA and 125 KVA with canopy for the operation of hot mix plants but stacks have not been provided with these DG sets. One DG set of 15 KVA capacity installed for office purposes is without canopy and with inadequate stack height. 3.    Two bitumen heaters with common burner has been installed with batch type hot mix plant but stack of adequate height has not been provided with it. 4.    The industry has installed bag filter house as APCD with batch type hot mix plant but porthole has not been provided with the stack of APCD to facilitate emission sample. 5.    Dust collector followed by wet scrubber has been installed as APCD with continuous  type hot mix plant but the scrubber was found chocked and re-circulation tanks / system in damaged condition. 6.    Three bitumen heaters are provided with continuous type hot mix plant out of which stack has not been provided with one of the bitumen heater. 7.    Vehicle movement area has not been maintained. 8.    The industry has not submitted any schedule for operation of hot mix plant and neither submitted the analysis report of the air emission sample.                   The industry was found violating the conditions of consents granted under the Water Act, 1974 and the Air Act, 1981 intentionally and deliberately.                   Show cause notice for revocation/ cancellation of consents to operate granted under the provisions of the Water Act, 1974 and Air Act, 1981 was issued to the industry with an opportunity of personal hearing before the Senior Environmental Engineer on 27.01.2020.                   Sh. Rajinder Kumar, Prop. attended the hearing and submitted as under: 1.    Stack of 3 meter height has been provided with the DG sets and another DG set of 15 KVA is used for site purposes and it has been lifted as it is not used for the plant. 2.    The bitumen heater provided with the batch type hot mix plant are operated through coal heater and as such does not required stack over it. 3.    The industry has installed port hole, staircase and platform with the APCD installed with batch type hot mix plant. 4.    The hot mix plant is not in operation since 25.09.2019 due to which the condition of the re-circulation tanks was not good and requested for a time period of 10 days to attend the said observations. 5.    The bitumen heaters provided with the continuous type hot mix plans is provided with a stack height of around 14 ft from the roof the bitumen heater and it will be further increased as per the requirement. 6.    The vehicle movement area has been maintained. 7.    The hot mix plant will be in operation after 15th April, 2020 and the Board may conduct the air emission sampling any time thereafter.                   After hearing the officers of the Board and representative of the indsutry, it as decided by SEE of the Board that:- Ø  The hot mix plant to be visited by Zonal Office to cross check version of Regional Office and industry to proceed further in the matter.                    The proceedings of personal hearing were conveyed to the industry for compliance of decisions vide Zonal Office letter no. 540 dated 05.02.2020.                   After that, the industry was visited by AEE of this office alongwith JSO from Head Office on 23.04.2021 and air emission sample were collected from the port hole on stack of Hot Mix Plant after APCD and sent to Head Office Lab, Patiala for analysis. As per analysis report, the concentration of parameter i.e. Particulate Matter was found to be 136 mg/Nm3, which was found to be within permissible limit prescribed by the Board for such units. The unit has deposited Rs. 7200/-vide R. No. 43/5410 dated 27.04.2021 as emission analysis charges.                   Thereafter, the industry has applied for renewal of consent to operate under the Water Act, 1974 and the Air Act, 1981 on 01.04.2023 under Orange category with same capacity. However, the application of the industry was returned citing incompletions at site.                   After that, the hot mix plant was visited by this office on 07.09.2023 and it was observed as under: 1.            The hot mix plant was in operation. 2.            Wet scrubber has been installed as APCD with rotary drum and same was in operation however, large quantity of sludge was deposited in the recirculation tanks and re-circulated water of wet scrubber was dark black in colour. 3.            Brown colour emissions were observed from the stack of APCD. 4.            The hot mix plant has installed 03 no. bitumen heaters and only 01 no. heater has been provided with stack of adequate height. 5.            The hot mix plant has not provided energy meter with the APCD and has not maintained record regarding the same. 6.            The hot mix plant has not stabilized the movement area.                   Since, the hot mix plant is not complying with the provisions of the Water Act, 1974 and the Air Act, 1981 and has been operating without valid consents to operate under the said Acts. Therefore, SCN for violation under the provisions of the Water Act, 1974 & the Air Act, 1981 was issued to the hot mix plant vide this office letter no. 6031 dated 18.09.2023 to submit compliance regarding above observations.                   Now the industry has applied for renewal of consent to operate under the Water Act, 1974 and the Air Act, 1981 under Orange category on 28.10.2023 for operation of hot mix plant for production of Pre-Mix @ 170 MTD by using Stone Aggregates & Bitumen @ 170 MTD as raw material, under Orange category, with requisite documents and adequate consent fees.                   Detail of the case is as under:-                   The HMP has submitted partnership deed executed on 01.04.2018 which states that Sh. Rajinder Kumar S/o Sh. Tej Pal R/o Muktsar and Sh. Goldy Sain S/o Sh. Rajinder Kumar, R/o Muktsar, have decided to carrying out the business of hot mix plant under the name & style of M/s Rajinder Kumar & Co. (Hot Mix Plant), Jalalabad (west) H. O. Muktsar w.e.f. 01.04.2018.                   The HMP has submitted sale deed executed on 28.04.2014 which states that Sh. Rajinder Kumar S/o Sh. Tej Pal R/o Muktsar and Sh. Goldy Sain S/o Sh. Rajinder Kumar, R/o Muktsar, (partners of the firm), have purchased the land measuring area 16 Kanal 00 Marle bearing khasra nos. 174//2(8-0), 9(8-0).                   The HMP has submitted reply on dated 25.09.2023 of show cause notice issued to it  vide this office letter no. 6031 dated 18.09.2023 regarding compliance of observations during visit on 07.09.2023, which is reproduced as under:- “1. <span lang="PA" style="font-family: 'Raavi','sans-serif'; mso-ascii-font-family: 'Arial MT'; mso-fareast-font-family: 'Times New Roman'; mso-hansi-font-family: 'Arial MT'; mso-bidi-theme-font: minor-bidi; background: white; mso-bidi-language: PA;">ਇਹ ਕਿ ਸਰਕਾਰ ਵੱਲੋਂ ਕੰਮ ਅਲਾਟ ਨਾ ਹੋਣ ਕਾਰਨ ਸਾਡਾ ਹਾਟ ਮਿਕਸ ਪਲਾਂਟ ਕਾਫੀ ਦਿਨਾਂ  ਤੋਂ ਬੰਦ ਹੈ। ਅਸੀਂ ਸਿਰਫ 2 ਦਿਨ ਲਈ ਮਸ਼ੀਨਰੀ ਚੈਕ ਕਰਨ ਲਈ ਟਰਾਇਲ ਬੇਸ ਤੇ ਪਲਾਂਟ ਚਲਾਇਆ ਸੀ। <span lang="PA" style="font-family: 'Raavi','sans-serif'; mso-ascii-font-family: 'Arial MT'; mso-fareast-font-family: 'Times New Roman'; mso-hansi-font-family: 'Arial MT'; mso-bidi-theme-font: minor-bidi; background: white; mso-bidi-language: PA;">2. ਇਹ ਕਿ ਹਾਟ ਮਿਕਸ ਪਲਾਂਟ ਦੇ ਹਵਾ ਪ੍ਰਦੂਸ਼ਣ ਕੰਟਰੋਲ ਵਾਲਾ ਯੰਤਰ ਸਾਫ ਕਰਵਾ ਦਿੱਤਾ ਹੈ ਅਤੇ ਜੋਂ ਸੱਲਜ਼ ਜਗ੍ਹਾ ਤੇ ਪਾਈ ਗਈ ਸੀ, ਉਹ ਵਾ ਸਾਫ ਕਰਵਾ ਰਹੇ ਹਾਂ, ਕੰਮ ਪ੍ਰਗਤੀ ਅਧੀਨ ਹੈ। <span lang="PA" style="font-family: 'Raavi','sans-serif'; mso-ascii-font-family: 'Arial MT'; mso-fareast-font-family: 'Times New Roman'; mso-hansi-font-family: 'Arial MT'; mso-bidi-theme-font: minor-bidi; background: white; mso-bidi-language: PA;">3. ਇਹ ਕਿ ਹਵਾ ਪ੍ਰਦੂਸ਼ਣ ਕੰਟਰੋਲ ਵਾਲਾ ਯੰਤਰ ਹੁਣ ਸਾਫ ਕਰਵਾ ਦਿੱਤਾ ਹੈ। <span lang="PA" style="font-family: 'Raavi','sans-serif'; mso-ascii-font-family: 'Arial MT'; mso-fareast-font-family: 'Times New Roman'; mso-hansi-font-family: 'Arial MT'; mso-bidi-theme-font: minor-bidi; background: white; mso-bidi-language: PA;">4. ਇਹ ਕਿ ਅਸੀਂ ਤਿੰਨੇ ਬਿਟੁਮੇਨ ਹੀਟਰ ਉਪਰ ਸਟੇਕ ਲਗਵਾ ਰਹੇ ਹਾਂ, ਜਿਸਦਾ ਕੰਮ ਪ੍ਰਗਤੀ ਅਧੀਨ ਹੈ। <span lang="PA" style="font-family: 'Raavi','sans-serif'; mso-ascii-font-family: 'Arial MT'; mso-fareast-font-family: 'Times New Roman'; mso-hansi-font-family: 'Arial MT'; mso-bidi-theme-font: minor-bidi; background: white; mso-bidi-language: PA;">5. ਇਹ ਕਿ ਐਨਰਜੀ ਮੀਟਰ ਵੀ ਲਗਵਾ ਦਿੱਤਾ ਜਾਵੇਗਾ। <span lang="PA" style="font-family: 'Raavi','sans-serif'; mso-ascii-font-family: 'Arial MT'; mso-fareast-font-family: 'Times New Roman'; mso-hansi-font-family: 'Arial MT'; mso-bidi-theme-font: minor-bidi; background: white; mso-bidi-language: PA;">6. ਇਹ ਕਿ ਮੂਵਮੈਂਟ ਏਰੀਆ ਵੀ ਸਟੇਬਲਾਈਜਡ ਕਰਵਾ ਰਹੇ ਹਾਂ ਅਤੇ ਕੰਮ ਪ੍ਰਗਤੀ ਅਧੀਨ ਹੈ। <span lang="PA" style="font-family: 'Raavi','sans-serif'; mso-ascii-font-family: 'Arial MT'; mso-fareast-font-family: 'Times New Roman'; mso-hansi-font-family: 'Arial MT'; mso-bidi-theme-font: minor-bidi; background: white; mso-bidi-language: PA;">                    ਬੇਨਤੀ ਹੈ ਕਿ ਅਸੀਂ ਆਪ ਵੱਲੋਂ ਦੱਸੇ ਗਏ ਸਾਰੇ ਕੰਮ 07 ਦਿਨਾਂ ਦੇ ਵਿੱਚ ਵਿੱਚ ਪੂਰੇ ਕਰਵਾ ਦਿੱਤੇ ਜਾਣਗੇ ਅਤੇ ਕੰਨਸੈਂਟ ਟੂ ਅਪਰੇਟ ਅਪਲਾਈ ਕਰਨ ਮੌਕੇ ਕੰਪਲਾਇੰਸ ਰਿਪੋਰਟ ਵੀ ਜਮ੍ਹਾ ਕਰਵਾ ਦਿੱਤੀ ਜਾਵੇਗੀ।”.                   The HMP has submitted CA certificate dated 22.02.2023 regarding value of gross fixed assets of the industry of Rs. 333.30 lakhs as on 20.02.2023. The industry has deposited Rs. 56,500/- each vide Receipt no.  SDL125861900 and SDL125861774 dated 16.03.2023 under the Water Act, 1974 and the Air Act, 1981, respectively, which is adequate upto 30.09.2026 under both Acts, after deducting penalty fee of 200% of one year fee. The industry ha also deposited Rs. 3600/- vide Receipt no. SDL127846331 dated 11.04.2023 as NOC fee, which is adequate against increase in fixed assets of Rs.  63.63 lacs under Orange category.                   To check compliance, the hot mix Plant was again visited by AEE of this office (undersigned) on 07.11.2023 and it was observed as under: 1.       The industry was not in operation. It has removed the Batch type HMP from its premises and only conventional type HMP was lying at site. 2.       The industry has installed dust collector followed by wet scrubber with water re-circulation system as air pollution control device to contain the emissions from rotary drum of existing machinery of hot mix plant, which has been made in line/operation-able condition. Recirculation tanks has been maintained and made in line. 3.       The industry has provided separate energy meter with the APCD of hot mix plant. 4.       The industry has provided stacks of adequate height above ground level with the APCD along-with adequate sampling facilities to facilitate the emission sampling. 5.       The industry has now provided stacks of adequate height with all bitumen heaters. 6.       The industry has now stabilized the vehicular movement area within its premises with stone aggregates and has made arrangement for sprinkling of water to supress the dust emissions generated during vehicular movement through pipeline. 7.       The industry has installed 02 D.G sets of capacity 125 KVA & 380 KVA with canopy and stacks of adequate height above roof level in its premises. 8.       The industry has planted plantation adequate as per code of practice.                   The industry is now complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981.                     Keeping in view of above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the hot mix plant for production of Pre-Mix @ 170 MTD by using Stone Aggregates & Bitumen @ 170 MTD as raw material, under Orange category, for a period upto 30.09.2026, with suitable conditions as per policy of the Board, please.
