CTE/Fresh/SAS/2022/17817121 dated 31.03.2023, valid till 23.01.2023 for development of Residential Project of 29 plots in S+3 pattern in an area of 5941.25 sq.mt under orange category vide categorization no. 2097-Infrastructuredevelopment projects not covered under EIA notification.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-language: PA;">Thereafter, the project proponent had applied fresh consent to operate under Water Act, 1974 and Air Act, 1981, due to violation observed during visit, show cause notice issued to the industry with an opportunity of submit reply within 7 days.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-language: PA;">Therefore, the consent to operate under Water Act, 1984 and Air Act, 1981 was refused vide no. CTOW/Fresh/SAS/2023/20952312 dated 01.03.2023 and vide no. CTOA/Fresh/SAS/2023/20952485 dated 01.03.2023.</span></p>

During hearing it was decided as under:</span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-language: PA;">Now, the project proponent has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for construction of Residential Project of 29 plots in S+3 pattern in an area of 5941.25 sq.mt. under green category vide Board revised categorization no. “3079: Building and construction projects, having built-up area upto 20,000 m2 and waste water generation <50 KLD”.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The project proponent has submitted CA certificate with the value of fixed assets of Rs. 3.91 crore. The project proponent has deposited Rs. 22100/- vide R no. 282835782 dated 22.01.2023 & Rs. 16,800/- vide UTR no. AXSK232910023570 dated 18.10.2023 under Water Act, 1974 and Rs. 22,100/- vide R no. 985749440 dated 22.01.2023 & Rs. 16,800/- vide UTR No. AXSK232910025912 dated 18.10.2023 under Air Act, 1981. </span><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; mso-fareast-language: EN-IN; mso-bidi-language: PA;">After deduction of late fee, the consent under Water Act, 1974 and Air Act, 1981 are adequate till 31.12.2025.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The Project proponent has submitted approved site plan issued by Executive Engineer, MC Zirakpur. </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The project proponent has submitted water balance detail, as per which the total water requirement of the project will be 58 KLD. The project generates domestic effluent @ 46 which is being treated in STP of capacity 50 KLD installed within the project site. After treatment through STP, 1.6 KLD will be used for green area and 45 KLD will be disposal into MC sewer.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The project proponent had submitted copy of letter issued by MC, Zirakpur vide no. 431 dated 29.11.2021 as approval for solid waste disposal and letter no. 432 dated 29.11.2021 for provisional approval of sewerage connection for M/s Oak Dale Enclave, Ramgarh Bhudda, VIP Road, Zirakpur subject to certain terms and conditions.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The project proponent had submitted undertaking that Mr. Raj Dhiman S/o Bhanga Ram Dhiman is sole proprietor of this project namely “Oakdale”.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The site of the project proponent was visited by AEE of this office on 16.11.2023. During the visit, it was observed as under:</span></p>

The treated effluent is currently being utilized in the green area developed within the premises of the industry.</span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-fareast-font-family: Cambria; mso-bidi-font-family: Cambria; color: black;">Further, it is submitted that in the review meeting taken by CEE(P) of this office on 13.7.2023, it was decided that the consents for discharge into MC sewer may be given to such projects, which are having permission from MC regarding connectivity of MC sewer before 15.06.2022 and as the PP has obtained permission from MC Zirakpur for discharge of treated sewage vide no. 432 dated 29.11.2021, which is well before the directions issued to MC Zirakpur by the Board on 15.6.2022. As such the application, as such is fit for grant for discharge into MC sewer.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-fareast-font-family: Cambria; mso-bidi-font-family: Cambria; color: black;">The decision of the Competent Authority taken during hearing dated 28.09.2023 has also been taken into account. However, to maintain equivalence while deciding applications which have been granted permission from MC Zirakpur before 15.06.2022, the application has been considered for grant of consent for discharge onto land for plantation.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-fareast-font-family: Cambria; mso-bidi-font-family: Cambria; color: black;">It is also clarified that the recommendations for grant into MC sewer have been given keeping in mind the ‘Principle of Natural Justice’ & to maintain equivalence while deciding the application and is not intended to undermine the decision of the Competent Authority.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-fareast-font-family: Cambria; mso-bidi-font-family: Cambria; color: black;">In view of above, it is recommended that consent to operate under the Water (Prevention & Control </span><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-ascii-theme-font: major-latin; mso-fareast-font-family: 'Times New Roman'; mso-hansi-theme-font: major-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1; mso-fareast-language: EN-IN; mso-bidi-language: PA;">of</span><span style="font-size: 12.0pt; font-family: 'Cambria','serif'; mso-fareast-font-family: Cambria; mso-bidi-font-family: Cambria; color: black;"> Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2025 with special conditions as under:</span></p>

The biodegradable component shall be treated produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.</span></p>
