<p style="text-align: justify;">The report /recommendations of Regional Office be persued.The industry is a small scale red category unit and was engaged in the process of pickling (Zindi).</p>
<p style="text-align: justify;">· Earlier a complaint was received in this office on 22.03.2022 through Govt. reference regarding industry running in residential area.</p>
<p style="text-align: justify;"> The industry could not produce any agreement made with M/s JBR Tech. Ludhiana. The industry could not produce any record maintained for fresh water consumption & trade effluent lifted by M/s JBR Tech. for treatment in CETP at Ludhiana. The industry was in residential zone and has not obtained consent to operate of the Board as such, directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 vide letter No. 2219-20 dated 21.07.2022 for disconnect the electricity connection of the industry.</p>
<p style="text-align: justify;">2. In compliance to the orders of disconnection of electric supply the electric connection of the industry was disconnected by PSPCL authorities vide TDCO No. 624915 dated 09.01.2023.</p>
<p style="text-align: justify;">· Thereafter, the industry was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 valid upto 30.09.2023 for engaged in the process of pickling section of MS Round for temporarily restoration of electric connection.</p>
<p style="text-align: justify;"> The industry applied for renewal on…………… which was examined and observed that the industry has submitted date of commissioning at said location from 2022 and the area is residential zone as per the Master Plan of Jalandhar, thus the industry is established after notification of the Master Plan of Jalandhar. The industry has also not applied for consent to operate under the Air (Prevention & Control of Pollution) Act 1981.</p>
<p style="text-align: justify;">During hearing, the representative of industry submitted that their industry is in operation at present location from 2005. He submitted that his father is out of station and documentary proof for commissioning of the industry and shall be submitted within a week. The consent operate under Air (Prevention & Control of Pollution) Act 1981 is granted upto 30.06.2024 He requested to allow the industry to resubmit the application under proper documentation alongwith the other requisite and balance fee.</p>
<p style="text-align: justify;">After hearing the officer of the Board, representative of the industry and considering facts on record, the Senior Environmental Engineer decided that:-</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->The consent to operate under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 be refused being not representative.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2. <!--[endif]-->The industry shall re-apply consent to operate under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 with proper documents & requisite fee within 10-days.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->3. <!--[endif]-->The Regional Office-1, Jalandhar verify the documentation regarding commissioning of industry and process the revised consent case on merit.</p>
<p style="text-align: justify;"> Now the industry has applied for renewal of consent to operate as per the report of Regional Office the industry is complying with the provisions of Water (Prevention & Control of Pollution) Act 1974. The industry has now submitted electricity bill as per proof of date of commissioning i.e 02.03.2005 in the name of Sh. Harjinder Singh.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->The industry has submitted an undertaking in which mentioned that:-</p>
<p style="text-align: justify;">"It is humbly submitted that I. Mr. Gurinder Singh S/o Sh. Gurbachan Singh and Mr. Harjinder Singh S/o Sh. Gurbachan Singh started business under the name and style of M/s Saini Industries in 2005. In 2016 we separated our business. Mr. Gurinder Singh took factory situated at Ajit Nagar Tanda Road near KMV College under the name and style of M/s Saini Industries (GSTN 03AGAPS9805P1ZX). Mr. Harjinder Singh took Factory situated at Towri Mohalla, Tanda Road near APJ School under the name and style of M/s Saini Steel Industries"</p>
<p style="text-align: justify;">The industry has already submitted continuation certificate u/s 79 of the Punjab Regional Town Planning and Development Act 1995 amendment 2006 issued by ATP, MC , Jalandhar vide their office letter no. 612 dated 07.06.2022 and as per certificate, the permission has been granted to the industry for operation of unit at site upto 22.08 2025. May if approved,</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1) <!--[endif]-->Directions be issued to PSPCL Authorities for restore the electric connection of the industry temporarily for six months.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2) <!--[endif]-->Renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted to the industry for six months with usual condition as per policy of the Board and with special condition that the industry shall comply with the Zoning Regulations of Master Plan and it shall shift its unit as per the provisions of notified Master Plan.</p>
