The industry has given reply to the clarification and has submitted that we are in process of applying for compounding of all the blocks in GLADA and we will submit the same within six months. Meanwhile we request that consents may be issued to us for 125 plots. We undertake to take separate consents for all blocks, if compounding of all the blocks is not submitted by us within 6 months. Further, the project proponent has earlier granted Consent to Establishment (NOC) vide no. CTE/Fresh/LDH4/2017/6718895 dated 05.12.2017, which is valid upto 04.12.2018 for Residential Colony in an area of 39.932 acres (161599 Square metres) only for area development project and only plots are to be sold to the prospective buyers and no building construction activity is to be carried out and for discharge of Domestic Effluent @ 272.0 KLD {to utilize effluent onto land for plantation and other non-core area (after treatment) and only surplus effluent thereafter will be discharged into sewer after meeting with the standards prescribed for respective mode of disposal} with suitable and special conditions mentioned therein.</span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi; color: #333333; mso-fareast-language: EN-IN; mso-bidi-language: PA;">(1) The project proponent has applied for single consent for all the four blocks namely A, B, C &amp; D. Accordingly, it will obtain single LOI/license/layout plan approval from the GLADA/concerned authority for all the four blocks. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi; color: #333333; mso-fareast-language: EN-IN; mso-bidi-language: PA;">(2) This NOC is valid only as an area development project and only plots are to be sold to the prospective buyers and no building construction activity is to be carried out. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi; color: #333333; mso-fareast-language: EN-IN; mso-bidi-language: PA;">3) The project to incorporate the special condition in the sale deed/ agreement with the prospective buyers to ensure that the total area of any specific building shall not exceed 20000 Sqm without obtaining Environmental Clearance as required under EIA notification 2006 (as amended). </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi; color: #333333; mso-fareast-language: EN-IN; mso-bidi-language: PA;">(4) The project proponent will obtain extension in the validity of LOI/license from the GLADA/concerned authority and will submit to PPCB, within a month. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi; color: #333333; mso-fareast-language: EN-IN; mso-bidi-language: PA;">(5) The project proponent will obtain permission from the Central Ground Water Authority/District Advisory Committee for abstraction of ground water. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi; color: #333333; mso-fareast-language: EN-IN; mso-bidi-language: PA;">(6) The project proponent to utilize effluent onto land for plantation and other non core area (after treatment) and only surplus effluent thereafter will be discharged into sewer after meeting with the standards prescribed for respective mode of disposal.</span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi; color: #333333; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">It is submitted that total built up area is more than 20,000 sqm and project is a plotted project and required to obtain EC.</span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi; color: #333333; mso-fareast-language: EN-IN; mso-bidi-language: PA;">It is pertinent to mention here that MoEF vide its letter no 205 dated 15.04.2019 has clarified that the projects with a land area of less than 50 ha but a built-up area of more than 20,000 Sqm may be appraised as per provisions of Schedule 8(a) of the EIA Notification2006 as amended from time to time. In this regard the Board vide its letter no. 10949 dated 09.05.2023 has sought a clarification from the Joint Director MoEF, Chandigarh and reply of clarification is awaited.</span></p> <p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi; color: #333333; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">In view of above it is recommended that fresh Consent to operate under the Water Act, 1974 and Air Act, 1981 may be granted to the project proponent upto six months with special conditions that:-</span></p> <p class="MsoListParagraphCxSpFirst" style="mso-margin-top-alt: auto;
