<p style="text-align: justify;">The note of RO may kindly be perused.</p>
<p style="text-align: justify;"><span lang="EN-US">The industry was granted ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no: CTOW/Renew/LDH3/2023/21693564 & CTOA/Renew/LDH3/2023/20796135 respectively, both dated 13.04.2023 valid upto 31.03.2024 each, subject to suitable conditions and with special conditions that</span></p>
<p style="text-align: justify;"><span lang="EN-US">1. </span><span lang="EN-US">The industry shall obtain registration under the Extended Producer Responsibility (EPR) from the Central Pollution Control Board within one month and submit the copy of the same to Board.</span></p>
<p style="text-align: justify;"><span lang="EN-US">2. </span><span lang="EN-US">The industry shall comply with the zoning regulation of Master Plan of Ludhiana and shall shift its unit accordingly.</span></p>
<p style="text-align: justify;"><span lang="EN-US">Now, the industry has applied for Varied ‘Consents to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS. The industry has submitted requisite documents and adequate fee upto 31.12.2027 as verified by RO. </span></p>
<p style="text-align: justify;"><span lang="EN-US">RO has submitted that as per record file of the industry, the District Town Planner, Ludhiana vide memo no: 2625 DTP(L) /M2A dated 23.08.2013 has intimated that the industry falls under Mixed Land Use along road front zone as per Approved Master Plan, Jagraon (2010-2031). The industry has applied for varied ‘Consent to Operate’ with expansion of its production with adding </span>Recycled Dana @ 2800Kgs/day, however, the site falls under <span lang="EN-US">Mixed Land Use along road front zone as per Approved Master Plan, Jagraon (2010-2031), </span>the industry cannot expand its production / pollution load in this area. Further, the industry has failed to obtain <span lang="EN-US">registration under the Extended Producer Responsibility (EPR) from the Central Pollution Control Board.</span></p>
<p style="text-align: justify;"><span lang="EN-US">In light of above RO has recommended to refuse the application.</span></p>
<p style="text-align: justify;"><span lang="EN-US">In this regard, the Department of Town and Country Planning has issued a notification dated 24.09.2021, attached herewith which has provisions for such type of units in section B(i).</span></p>
<p style="text-align: justify;"><span lang="EN-US">If approved RO be requested to comment on the relevant part of the said notification before taking any action for refusal, please.</span></p>
