<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">It is submitted that while scrutinize the case it has been observed that:-</span></p>
<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">1. Earlier, the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. PBIP/PPCB/2018/CTO(W) - 46, dated 17/04/2018 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. PBIP/PPCB/2018/CTO(A) – 46, dated 18/04/2018 both valid upto 30/09/2022 for the manufacturing of Rail Coach Components @ 3.50 TPD.</span></p>
<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">2. The fixed assets of the industry has been increased from Rs.259.00 to 785.87 Lacs and production of the industry has been increased from 3.50 TPD to 9.0 TPD without obtaining NOC of the Board, Please clarify. In light of Sr.No. (2) above, industry was required to apply for varied consents of the Board instead of Renewal of consent, as the production of the industry has been increased from 3.50 TPD to 9.0 TPD with complete detail of increased machinery with Bill No/Date/Amount/Type of machinery besides other required documents.</span></p>
<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">3. The industry has not submitted the compliance report of previous consent conditions granted to the industry, please submit the same in annotated form.</span></p>
<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">4. The industry has not submitted the details of plantation area to dispose off the treated domestic effluent, please submit the same duly marked on site plan.</span></p>
<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">5. The consent fee deposited by the industry is not adequate for next 5 years, as the industry is required to deposit the balance consent fee on the basis of fixed assets increased year by year since 2018-19 onward and previous consent obtained by the industry has been expired on 30.09.2022, hence industry is required to deposit the late fee also alongwith consent form fee.</span></p>
<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">6. Please submit the completion certificates of APCDs provided with the Induction furnaces.</span></p>
<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">7. The industry has not submitted the analysis report of stack emissions from the Boards Lab.</span></p>
<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">8. Please submit the compliance of authorization obtained under the Hazardous Waste (Management & Other Transboundary) Rules, 2016.</span></p>
<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">The industry was requested to attend the above said observations and submit your reply within 2 days through clarification dated 12.12.2023, but no reply has been submitted by the industry so far.</span></p>
<p><span style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff;">As, the industry has increased the production from 3.5 TPD to 9.0 TPD, hence the industry is required to apply for varied consent of the Board alongwith reply of clarification dated 12.12.2023 with supporting documents. But I have no option to return the application.</span></p>
<p>Please allow me to return the application with the the request to the industry to apply for varied consent <span style="background-color: #ffffff; color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify;">longwith reply of clarification dated 12.12.2023 with supporting documents and requisite consent fee.</span></p> |
