Saurabh Gupta Brother of Director</span></p> <p style="margin: 0in; margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 11.0pt; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin; color: black; mso-themecolor: text1; mso-bidi-font-weight: bold;">&nbsp;</span></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; color: black; mso-themecolor: text1; mso-bidi-font-weight: bold;">The officers of the Board brought out that the </span><span lang="EN-US" style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-fareast-language: KO;">project proponent was earlier issued a show cause notice for violation of provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981, along with an opportunity of personal hearing before the Senior Environmental Engineer on&nbsp;27/1/2022, wherein, it was decided as under:</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp; </span>The project proponent shall apply for obtaining &lsquo;consent to establish&rsquo; (NOC) from pollution under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 within requisite documents and attending the observations made by the Board within 15 days.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp; </span>The Environmental Engineer, RO, SAS Nagar shall visit the site of the project and shall process the application of the project proponent on merits to be submitted by project proponent. Further, action will be taken after receipt of report of RO.</span></p> <p class="MsoListParagraphCxSpFirst" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-fareast-language: KO;">Thereafter, the project site was visited on 23/3/2022 and it was observed that the project proponent is not complying with the decisions of hearing. Accordingly, the project proponent was issued notice to issue direction u/s 33-A of the Water Act, 1974 along with an opportunity of personal hearing before the Chief Environmental Engineer on 26/4/2022. However, the said hearing could not be held due to administrative reasons. </span></p> <p class="MsoListParagraphCxSpMiddle" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-fareast-language: KO;">The matter was again considered by the Competent Authority and it was decided to give another opportunity of personal hearing to the project proponent before the Chief Environmental Engineer on 8/2/2023. But, neither any representative of the project proponent attended the hearing nor submitted any reply/ communication in the matter. </span></p> <p class="MsoListParagraphCxSpLast" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-fareast-language: KO;">The Competent Authority of the Board again considered the matter and decided to give final opportunity of persona hearing to the project proponent before taking further action in the matter. Accordingly, the project proponent was issued notice to issue direction u/ 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 alongwith an opportunity of personal hearing before the Chief Environmental Engineer on 12/4/2023, which was postponed to 19/7/2023 due to administrative reasons. But, neither any representative</span><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;"> of the project proponent attended the hearing nor submitted any reply/ communication in the matter. The Chief Environmental Engineer (P) Board took a serious note of this and it was decided as under:</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp; </span>That the project proponent shall take all necessary steps to stop its construction at site and stop forthwith discharging any effluents/wastewater into sewer/into storm water drain/inland surface water/onto land for stagnation/irrigation or through any mode.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp; </span>That the project proponent shall not allow any new occupancy and shall not allow any new possession in the premises of the project, with immediate effect.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp; </span>That the project proponent will immediately stop its activities and will not restart the same unless all necessary water and air pollution control measures are taken ant it obtains valid &lsquo;consent to operate&rsquo; of the Board under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp; </span>That the Revenue Authority shall not register any sale deed related to any plot/ flat/ house/ shop/ any other component of this project with immediate effect.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp; </span>The Punjab State Power Corporation Ltd. authorities shall be directed not to release any further electric connection to the residential houses in the project.</span></p> <p class="MsoListParagraph" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-fareast-language: KO;">The Board vide letters no. 3077 dated 5/5/2023, no. 3078 dated 5/5/2023, 3079 dated 5/5/2023 and 3080 dated 5/5/2023 and issued a copy of the said directions to following for compliance and taking necessary action in the matter:</span></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; layout-grid-mode: char;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The Sub-Registrar-cum-Tehsildar, Derabassi, Distt. The said appeal was heard on 5/9/2023.<strong>&nbsp;</strong>Operative Para of the said order is as under:</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: normal; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><strong><span lang="EN-US" style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-fareast-language: KO;">&ldquo;<em>Before taking any further action in the case, the Environmental Engineer, Punjab Pollution Control Board, Regional office, SAS Nagar is directed to carry out the measurement of the project site in the presence of the representative of the appellant at the earliest and submit report on the next date of hearing.&rdquo;</em></span></strong></p> <p class="MsoListParagraphCxSpFirst" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-fareast-language: KO;">The appeal is listed for hearing on 29/11/2023.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-fareast-language: KO;">The project proponent was again applied for obtaining consent to establish (NOC) from pollution angle as required under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981, for establishment of a new Residential Plots having 226 Number of plots and commercial plots @ 17&nbsp;Numbers, along with requisite documents. However, the project proponent has not submitted proof regarding date of start of construction activity at site, thus, adequacy of fee cannot be adjudged.</span></p> <p class="MsoListParagraphCxSpLast" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-ansi-language: EN-US; mso-fareast-language: KO;">The layout plan and&nbsp;regularization certificate&nbsp;has been issued by the Govt. to&nbsp;M/s Silver City Housing and Infrastructure Ltd.&nbsp;However, the relevant documents (such as partnership deed, undertaking etc.) attached with the online application is of another firm, i.e.&nbsp;M/s Arpan Devcon Pvt. Ltd, which is not in order.&nbsp;In this regard, the project proponent has submitted a copy&nbsp;letter of General Power of Attorney issued by Office of the Joint Sub-Registrar Zirakpur dated 05.04.2023 executed between M/s Silver City Housing and Infrastructure Ltd, and M/s Arpan Devcon Pvt. Ltd. As per the orders of the Appellate Authority, the site of the project was again visited on 16/10/2023 along</span><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">with Sh. Gautam, representative of M/s Arpan Devcon Pvt. Ltd and it was observed as under:</span></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; layout-grid-mode: char;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">1)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>There are total of 226 plots in the project and 17 commercial plots in the project.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">2)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>Construction on around 50 plots on which construction has been done out of which some are S+3 and some are G+2. Further, 2 plots of commercial pocket has been constructed on G+1/2 configuration. The unit is an orange category is has obtained CTE from PPCB for setting up of an industrial unit for formulation of Pharmaceuticals.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt 1.0in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">f)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><u>M/s Jai Casting, Plot no. F-23&nbsp;</u>- The boundary wall of the said industry is located at a distance around 86 mtr from boundary wall of the residential plot of the project. The unit is an orange category unit is engaged in casting of auto parts.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">8)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;"> </span>Further, there are several empty plots, where either no construction has been carried out by the respective owner or sheds are existing and no production is being carried as yet. However, as the plots are located in industrial focal point developed by PSIEC, thus any kind of activity can be carried out by the said plot holders, in future.</span></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; layout-grid-mode: char;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">9)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>MC sewer is not laid till project.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in 0in .0001pt .5in;"><span style="mso-ascii-font-family: Calibri; mso-fareast-font-family: Batang; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-fareast-language: KO;">10)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The project proponent has constructed one underground storage tank of 1,75,000 ltr. for storage of freshwater. The project proponent has one tubewell and the representative has been advised to start maintaining regard of the same.</span></p> <p class="MsoListParagraphCxSpFirst" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">From the above, it is clear that there are many shortcomings in the application of the project proponent. The project proponent has not submitted adequate proposal w.r.t pollution control &amp; disposal measures. The project proponent has also not deposited adequate Consent to Establish fees. The site of the project is also not suitable as per notification dated 25/7/2008 and 30/10/009. The project proponent is not complying with the provisions of the Water (Prevention and Control of Pollution) Act, 1974<span style="mso-spacerun: yes;">&nbsp; </span>and the Air (Prevention and Control of Pollution) Act, 1981. It was proposed to refuse the consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention and Control of Pollution) Act, 1974<span style="mso-spacerun: yes;">&nbsp; </span>and the Air (Prevention and Control of Pollution) Act, 1981 after affording an opportunity of show cause-cum-personal hearing. </span></p> <p class="MsoListParagraphCxSpMiddle" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">Thereafter, the project proponent was served show cause notice for</span><span style="mso-ascii-font-family: Calibri; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-bidi-font-weight: bold;"> refusal of consent to establish (NOC) from pollution angle</span><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"> applied under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 </span><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-fareast-language: EN-IN;">vide Board's letter no. 9159-60 dated 30/11/2023 alongwith an opportunity of personal hearing before the Chairman of the Board on 5/12/2023.</span><span style="mso-fareast-font-family: Calibri; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"> </span><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-fareast-language: EN-IN;">But, neither any representative of the project proponent attended the hearing nor submitted any reply/ communication in the matter. </span></p> <p class="MsoListParagraphCxSpMiddle" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="mso-bidi-font-family: Tahoma;">The matter</span> was considered by the Competent Authority and decided to afford another opportunity before taking further action in the matter. <span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">Therefore, the project proponent was given another opportunity of personal hearing before </span><span style="mso-ascii-font-family: Calibri; mso-hansi-font-family: Calibri; mso-bidi-font-family: Calibri; mso-bidi-font-weight: bold;">refusal of consent to establish (NOC) from pollution angle</span><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"> applied under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 </span><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-fareast-language: EN-IN;">vide Board's letter no. 9439 dated 12/12/2023 alongwith an opportunity of personal hearing before the Chairman of the Board on 18/12/2023.</span><span style="mso-fareast-font-family: Calibri; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"> </span></p> <p class="MsoListParagraphCxSpMiddle" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="mso-fareast-font-family: Calibri; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">The representative of the project proponent attended the hearing and submitted written reply, which was taken on record. He informed that the site of project falls in residential zone as per the Master Plan of the area. The green buffer zone has already been provided by the project proponent towards air polluting industry as per the guidelines of the Board. The project is having sufficient plantation area to the tune of 1.75 acres to utilize treated wastewater @ 120 KLD partially onto land for plantation.
