CTE/Fresh/SAS/2022/16604565 dated 28.01.2022 valid upto 31.07.2022 for residential plotted and discharge of domestic effluent @ 327.24 KLD into MC sewer after treatment in STP with subject to suitable conditions mentioned therein.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 115%; background: white;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Thereafter, the project proponent was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2022/18739048 dated 05.07.2022 having validity upto 31.03.2023 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2022/17143627 dated 19.06.2022 having validity upto 30.09.2024 for 116 Residential Flats & 32 shops with Domestic Effluent @ 327.24 KLD - Discharged into sewer (MC Zirakpur) after treatment in STP with subject to suitable conditions mentioned therein.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 115%; background: white;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Thereafter, the project proponent was issued notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 along with an opportunity of personal hearing before the Chief Environmental Engineer (P) of the Board on 17.05.2023 and it was decided as under:</span></p>

It was made clear to the project proponent that if it is again found failing to make the compliance with the short comings mentioned in the notice, then directions u/s 33-A of the Water (Prevention and Control of Pollution) Act, 1974 may be confirmed without giving any further opportunity/ notice. </span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 115%; background: white;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Now, the project proponent has applied for obtaining varied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 for 202 Residential Plots alongwith requisite docoments.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 115%; background: white;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">As per record file of the project the previous consent fee under both acts is adequate upto 23.04.2025 against the total cost of fixed assets is Rs. 4.82 crores. Now, the project proponent has deposited Rs. 1,36,800/- vide R. No. 90/5581 dated 18.12.2023 (Rs. 86,400/-<span style="color: red;"> </span>under Water Act, 1974 and Rs. 50,400/- under Air Act, 1981)<span style="color: red;"> </span>against the total cost of the project Rs. 7.30 crores. The total fee deposited by the project proponent is adequate upto 30.09.2028 under both acts.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; mso-pagination: widow-orphan; background: white; text-autospace: ideograph-numeric ideograph-other;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">The pp has submitted approved site plan from MC, zirakpur as per which there are 202 plots in the project. </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; mso-pagination: widow-orphan; background: white; text-autospace: ideograph-numeric ideograph-other;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">The pp has submitted CLU under PAPRA for developing residential scheme vide no. 18877 dated 14.10.2016 issued by Regional Deputy Director, Patiala. </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; mso-pagination: widow-orphan; background: white; text-autospace: ideograph-numeric ideograph-other;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">The pp has submitted letter from MC, Zirakpur vide no. 1729 dated 24.07.2020, as per which the pp shall ensure compliance of the SWM Rules, 2016 by ensuring source segregation, construction of compost pits etc.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; mso-pagination: widow-orphan; background: white; text-autospace: ideograph-numeric ideograph-other;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">The site of the project was visited by this office on 08.01.2024. During the visit, it was observed as under:-</span></p>

The project is complying with the decisions of the hearing given to it.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 18.0pt; mso-pagination: widow-orphan; background: white; text-autospace: ideograph-numeric ideograph-other;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">In view of the above, it is recommended that the consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.09.2028 for 202 residential plots with subject to the suitable conditions and following additional conditions:</span></p>

The biodegradable component shall be treated produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.</span></p>
