It is submitted that the industry is a rice sheller unit, which falls under small scale orange category and has been established after obtaining consent to establish (NOC) vide no. CTE/Fresh/FZR/2023/22302821 dated 05.06.2023, valid upto 04.06.2024 for the manufacturing of Raw rice with dryer @ 2.0 TPH and Sorted Rice @ 2.0 TPH, under Orange category, with certain conditions mentioned therein.                        Thereafter, the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981, for the manufacturing of Raw rice with dryer @ 2.0 TPH and Sorted Rice @ 2.0 TPH, under Orange category with requisite documents and adequate consent fees. The detail of case is as under:-                        The industry has submitted self-declaration regarding installation of cyclone separators as APCD for the Pre-cleaning section and sheller section as per dimensional drawing given in the feasibility report submitted to the Punjab Pollution Control Board.                         The industry has deposited Rs. 42,000/- deposited vide UTR/Ref. No. SBIN123347528498 dated 13.12.2023 as water consent fee under the Water Act, 1974 and Rs. 42,000/- deposited vide UTR/Ref. No. SBIN123347613161 dated 13.12.2023 as air consent fee under the Air Act, 1981, against the fixed assets of Rs. 121.28 Lakhs as on 08.11.2023 as per CA certificate dated 11.12.2023 submitted by it. Thus, the consent fee is adequate upto 30/09/2028 under each Acts.                        The industry was visited by this office on 14.12.2023 and it was observed as under:- 1.            The industry is a raw rice sheller unit with dryer, was not in operation during visit. However, was on the verge of commissioning. Raw material was found stored in its premises. 2.            The industry has provided separate cyclone separators as APCDs with shelling section and paddy pre cleaner of dryer section, however all dust emitting points have not been connected with hooding system of these APCDs. 3.            The industry has not provided stacks with the cyclone separators. 4.            The industry has not provided brick wall of adequate length around husk discharge /storage area. 5.            The industry has not stabilized movement area within the premises.                         The industry is not complying with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013.  Accordingly, consent to operate under the Water Act, 1974 and the Air Act, 1981 were refused vide nos. CTOW/Fresh/FZR/2024/24490939 and CTOA/Fresh/FZR/2024/24482080 dated 01/01/2024, due to above mentioned observations during visit.                        Now, the industry has again applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981, for the manufacturing of Raw rice with dryer @ 2.0 TPH and Sorted Rice @ 2.0 TPH, under Orange category with requisite documents and adequate consent fees.                         To process the application, the industry was again visited by this office on 11.01.2024 and it was observed as under:- 1.            The industry is a raw rice sheller unit with dryer, was not in operation during visit. However, was on the verge of commissioning. Raw material was found stored in its premises. 2.            The industry has provided separate cyclone separators as air pollution control devices to control the process emission from shelling section as well as paddy cleaner of dryer as per the design submitted in feasibility report during NOC application. All dust emitting points were now connected to the cyclones. 3.            The industry has now provided cyclones with stacks of adequate height alongwith arrangement to facilitate emission sampling. 4.            The  industry has now provided brick wall of adequate length & height of 10 feet around husk discharge /storage area and now provided mesh wire of 5' height above the said wall in compliance to code of practice prescribed by the Govt. vide order dt. 15.10.2013. 5.            The industry now stabilized movement area within the premises for movement of vehicles. 6.            The industry has provided septic tank for treatment of domestic effluent with provision to discharge onto land for irrigation along the boundary. 7.            The industry has planted saplings along its boundary wall which is adequate.                        The industry is now complying with provisions of the Water Act, 1974 and the Air Act, 1981 as well as code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013. The competency for grant of consents to the rice shellers with dryer lies with the Environmental Engineer of the Regional Office.                          Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry for a period upto 30/09/2028 for operation of rice sheller unit to manufacture Raw Rice with Dryer @ 2.0 TPH and Sorted Rice @ 2.0 TPH, under Orange category, subject to the suitable conditions and a specific conditions that the industry will get its emissions analyzed from Board's lab during within one month.
