Sarup Developers 3rd Floor, 100/28, Shiva Tower, Sarajpur, Sector-9, Rohini, Delhi has obtained change of land use from the Municipal Corporation, Patiala vide letter no. 609/BLD dated 23.10.2015 for development of single unit colony H.B. 33, in khasra no. 1219(9-14) and 1224 (6-7 &frac12;) in an area of 16 bighe 1 &frac12; bishwa (3.34 acres)&nbsp;subject to conditions mentioned therein.</span></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 150%; background: white;"><strong><span style="font-size: 12.5pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; background: white;">LOI:</span></strong></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.5pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; background: white;">The project proponent has submitted final letter of approval to develop colony Letter Of Intent (LOI) from the O/o Commissioner-cum-Competent Authority vide approval no. 469/BLD dated 13.10.2016. AXSK233410004910 dated 05.12.2023 as water consent fee and Rs. 144500/- (Rs. 72000/- as water consent fee and Rs. 72000/- as 400% penalty fee) UTR No. AXSK233410004953 dated 07.12.2023 fee against the gross value of fixed assets of Rs. 662.24 lakh on 30.11.2023 as per CA certificate dated 02.01.2024. This consent fee is adequate upto 31.07.2024 under both the Acts separately. The project proponent has also deposited Rs. 45000/- vide UTR no. Considering 2.1 FAR, total built up area is 28056 sqm, which is less than 50 hectare and 1.5 lakh sqm. Therefore, the project is not covered under EIA notification dated 14.09.2006.&nbsp;&nbsp;</span></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 18.0pt; background: white;"><strong><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">Feasibility Report</span></strong></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.5pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; background: white;">As per the application and feasibility report, the total water requirement during the operation of the project shall be 34.5 KLD and total wastewater generation shall be 28.4 KLD&nbsp;and untreated sewage water will be directly disposed into public sewer leading to Terminal Sewerage Treatment plant of Patiala as per clause no.25 of final Letter of approval to develop the colony (No.469/BLD dated 13.10.2016). </span></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.5pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; background: white;">As the Board&rsquo;s office order</span><span lang="PA" style="font-size: 12.5pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; background: white; mso-bidi-language: PA;"> </span><span style="font-size: 12.5pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; background: white; mso-bidi-language: PA;">no. 315 dated 05.07.2018, if the residential colony/commercial complex/construction project is proposed to be established within the municipal limits of a City/Town of the State and it proposes to discharge its entire sewage into the municipal sewer, then the promoter of the residential colony shall install adequate and appropriate individual sewage treatment plant. The project proponent shall make arrangements to re-use the treated effluent for flushing purposes and/or for watering of green areas in the project premises. Only the surplus treated waste water shall be discharged into the MC sewer.</span><span style="font-size: 12.5pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; background: white;"><span style="mso-spacerun: yes;">&nbsp; </span></span></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 18.0pt; background: white;"><strong><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">Solid Waste</span></strong></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.5pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; background: white;">As per the feasibility report&nbsp;average quantity of this waste will be @400-450 g/capita / day from residential facility. Thus, about 130 kg/day of MSW will be produced by the township. The project proponent has proposed to provide vermi-composting, where vermi-culturing (culturing of earthworms) is used, cost-effectively, to convert waste into valuable compost for agricultural applications. </span></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.5pt; line-height: 150%; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; background: white;">The MSW generated by the residential colony having disposed of through MRF facility M/s Hari Bhari Management Society (Registered with MC, Patiala) vide letter no. MCP/CE(HQ)/2018/277 dated 09.10.2018.</span></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 18.0pt; background: white;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">The project site was visited by the undersigned on <span style="mso-spacerun: yes;">&nbsp;</span>15.01.2024 and contacted Sh. Tarsem Singh, <span style="mso-spacerun: yes;">&nbsp;</span>representative at site. During visit, it was observed as under:</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -22.5pt; line-height: 18.0pt; background: white; margin: 0in 0in 3.0pt 22.5pt;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">1.&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp; </span>The project falls on the left hand side of&nbsp;the Patiala-Rajpura Road<span style="background: white;">.</span></span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -22.5pt; line-height: 18.0pt; background: white; margin: 0in 0in 3.0pt 22.5pt;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">2.&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp; </span>There are 38 no. residential plots out of which 30 are constructed (stilt + 2) and 8 no. EWS plots have also been constructed. About 50 families are residing in the colony as informed by the representative. <span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;</span></span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -22.5pt; line-height: 18.0pt; background: white; margin: 0in 0in 3.0pt 22.5pt;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">3.<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp; </span>No dispensary has been provided and the site is lying vacant. </span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -22.5pt; line-height: 18.0pt; background: white; margin: 0in 0in 3.0pt 22.5pt;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">4.&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp; </span>The project proponent has not installed any D.G. set. </span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -22.5pt; line-height: 18.0pt; background: white; margin: 0in 0in 3.0pt 22.5pt;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">5.<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp; </span>One no. submersible pump without flow meter with an over head tank of 50 KL is provided.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -22.5pt; line-height: 18.0pt; background: white; margin: 0in 0in 3.0pt 22.5pt;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">6.<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp; </span>The project proponent has not provided any Sewage Treatment Facility and is discharging its domestic effluent into sewer, which is connected with terminal STP.<span style="mso-spacerun: yes;">&nbsp; </span></span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -22.5pt; line-height: 18.0pt; background: white; margin: 0in 0in 3.0pt 22.5pt;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">7.&nbsp;&nbsp;&nbsp;&nbsp;During visit, there is no air polluting industries within 100 mtr of the project site and also there is no MAH project proponent within 250 mtr of the said site. As such, the site is also complying with notification no. No. 3/6/07/STE(4)/2274 Dated 25.07.2008.</span></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; text-indent: 58.5pt; line-height: 18.0pt; background: white;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">There is clarification vide Board letter no. 4426-49 dated 05.02.2009 in which it was mentioned that the prescribed distance are to be maintain or not from the various category of above mentioned industries (i.e. rice shellers/saila plant/stone crushers/brick kilns/cement plants/cement grinding units/hot mix plants) for establishments of residential colonies/commercial establishments, was discussed in a meeting held under the chairmanship of Chief Secretary, Punjab on 13.01.2009 and it was decided as under:</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -27.0pt; line-height: 18.0pt; background: white; margin: 0in 0in 3.0pt 27.0pt;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">a)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The distance of 500m and 300m as prescribed in the above mentioned notification for establishment of rice shellers/saila plants/stone crusher and brick kilns/cement plants/cement grinding units/hot mix plants, respectively, would be maintained by the new residential colonies to be established outside the local planning area(LPA) i.e. these notifications would be deemed to be operative vice-versa also.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -27.0pt; line-height: 18.0pt; background: white; margin: 0in 0in 3.0pt 27.0pt;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">b)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The residential/commercial establishments shall be allowed within the Local Planning area as per the land use prescribed in the master plan/draft master plan of the area irrespective of their distance from the rice shellers/saila plants/stone crushers/ brick kilns/ cement plants/ cement grinding units/ hot mix plants. However, minimum buffer of 15m green belt of broadleaf trees should be provided by the colonizer towards the air polluting industries, boundary of which are located within 100m from the boundary of such projects.</span></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 15.6pt; background: white;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">In this case, the project proponent has obtained CLU and no air polluting industry is located within 100 mtr of the said site.&nbsp;The site is suitable for establishment of the project. </span></p> <p class="MsoNormal" style="margin-bottom: 3.0pt; text-align: justify; line-height: 18.0pt; background: white;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">In view of above, if approved, SEE, ZO-1, Patiala may be recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 be granted to the project proponent upto 31.07.2024 with the suitable conditions and following special conditions that:</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 15.6pt; background: white; margin: 0in 0in 3.0pt .5in;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">1&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent shall provide sewage treatment facility </span><span style="font-size: 12.5pt; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; background: white; mso-bidi-language: PA;">make arrangements to re-use the treated effluent for flushing purposes and/or for watering of green areas in the project premises and discharge surplus treated waste water into the MC sewer, within two months as per Board&rsquo;s office order no. 315 dated 05.07.2018.</span><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;"><span style="mso-spacerun: yes;">&nbsp; </span></span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 15.6pt; background: white; margin: 0in 0in 3.0pt .5in;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent shall ensure compliance of Noise Pollution Rules, 2000 in true letter and spirit and no noise pollution is caused in the vicinity due to the project.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 15.6pt; background: white; margin: 0in 0in 3.0pt .5in;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The project proponent shall comply with the provisions of Solid Waste Management Rules, 2016 in true letter and spirit.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 15.6pt; background: white; margin: 0in 0in 3.0pt .5in;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent shall comply with the provisions of E-Waste Management Rules, 2022 in true letter and spirit.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 15.6pt; background: white; margin: 0in 0in 3.0pt .5in;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The project proponent shall comply with the provisions of Plastic Waste Management Rules, 2016 in true letter and spirit.&nbsp;&nbsp;&nbsp;</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 15.6pt; background: white; margin: 0in 0in 3.0pt .5in;"><span lang="EN-IN" style="font-size: 12.5pt; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN;">6.<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The project proponent shall provide flow meter on the submersible pump within 7 days, maintain daily record of fresh water consumption and submit compliance. </span></p> <p class="MsoNormal" style="text-align: justify;
