<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: normal; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Arial; color: black; mso-themecolor: text1;">It is submitted that earlier </span><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">The industry has been granted CTOs under the Water Act, 1974 and the Air Act, 1981 for manufacturing of biodegradable carry bags @ 1.5 TPD by using corn granules under green category on 24.04.2022 (valid up to 31.03.2023), subject to conditions mentioned therein.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: normal; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">Thereafter, a complaint was received against the industry alleging that the industry is manufacturing plastic carry bags instead of biodegradable carry bags. Accordingly, the industry was visited by AEE on 23.09.2022 and it was observed that:</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: normal; background: white; margin: 0in 0in .0001pt 1.0in;"><em><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">i.</span></em><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;"> <em>The unit was in operation and was manufacturing carry bags with printing </em>"This is 100% Bio-degradable bags"<em>. The unit has also printed consent no. issued by the Board on the carry bags.</em></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: normal; background: white; margin: 0in 0in .0001pt 1.0in;"><em><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">ii.</span></em><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;"> <em>No responsible person was present at site and there was no record available regarding purchase of raw material.</em></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: normal; background: white; margin: 0in 0in .0001pt 1.0in;"><em><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">iii.</span></em><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;"> <em>The unit has stored LLDPE (linear low density polythene) but no corn granules were observed (raw material) in its premises. Therefore, the unit seemed to be manufacturing non bio-degradable carry bags.</em></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: normal; background: white; margin: 0in 0in .0001pt 1.0in;"><em><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">iv.</span></em><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;"> <em>The industry has not submitted certificate from CPCB regarding selling/marketing of biodegradable carry bags and has also not obtained</em> <em>registration under the PWM Rules, 2016 as amended from time to time.</em></span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: normal; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">Accordingly, the industry was issued show cause notice for revocation of consent to operate under the Water Act, 1974 & the Air Act, 1981 with an opportunity of personal hearing before Member Secretary of the Board on 03.11.2022.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: normal; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">After hearing the representatives of the industry and officer of the Board, it has been decided by the Member Secretary of the Board that:-</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -24.0pt; line-height: 12.6pt; background: white; margin: 0in 0in .0001pt 42.0pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">1. The industry shall not manufacture, stock and sell any kind of plastic carry bag, either biodegradable or compostable until it obtains clarification from the Department of Local Govt. and Department of Rural Development & Panchayats, Govt. of Punjab regarding manufacturing, stocking and sale of carry bags made from compostable / biodegradable plastic material.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -24.0pt; line-height: 12.6pt; background: white; margin: 0in 0in .0001pt 42.0pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">2. It was made clear to the representatives of the industry that in case the industry fails to comply with the decisions above, further action for closure of the industry shall be initiated.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -24.0pt; line-height: 12.6pt; background: white; margin: 0in 0in .0001pt 42.0pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">3. Regional Office, Faridkot shall keep a watch over of the activities of the industry and submit report / recommendations in the matter, in case the industry fails to comply with the decisions of hearing. </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: normal; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">Thereafter, the industry has applied for renewal in validity of consents to operate under the Water Act, 1974 & the Air Act, 1981 through OCMMS on 28.03.2023 for manufacturing of bio all cut type of carry bags @ 1.5 TPD. Details of the case are as under:-</span></p>

No. N007221785363516 dated 07/01/2022 as water consent fee under the Water Act, 1974 and Rs. 14,500/- vide UTR/Ref. No. N007221785376204 dated 07/01/2022 as air consent fee under the Air Act, 1981, against the fixed assets of Rs. 65.53 lacs. The consent fees deposited by the institute are adequate upto 31/12/2026 under the Water Act, 1974 and the Air Act, 1981.</span></p>

<p class="MsoListParagraph" style="margin-left: 42.0pt; text-align: justify; line-height: 12.6pt; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; color: black; mso-themecolor: text1;">Thereafter, the industry was visited by AEE on 03.04.2023 and it was observed as under:-</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -24.0pt; line-height: 12.6pt; background: white; margin: 0in 0in .0001pt 42.0pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">1. The industry was not in operation during the visit.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -24.0pt; line-height: 12.6pt; background: white; margin: 0in 0in .0001pt 42.0pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">2. The industry has installed an extruder machine, an offset printing machine, cutting machine and sealing machine in its premises. The manufacturing process is as under:- Bio Degradable granule (made from corn starch)-> Extruder machine -> cutting-> punching-> offset printing-> Compostable carry bag.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -24.0pt; line-height: 12.6pt; background: white; margin: 0in 0in .0001pt 42.0pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">3. The industry has produced an electric bill of last two months, which shows that the industry is not being operated from last two months.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -24.0pt; line-height: 12.6pt; background: white; margin: 0in 0in .0001pt 42.0pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">4. There is no source of emission generation during the process.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -24.0pt; line-height: 12.6pt; background: white; margin: 0in 0in .0001pt 42.0pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">5. The industry was not found stored LLDPE (linear low density polythene)</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -24.0pt; line-height: 12.6pt; background: white; margin: 0in 0in .0001pt 42.0pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">6. There is no source of trade effluent generation and only domestic effluent is being discharged into sewer.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -24.0pt; line-height: 12.6pt; background: white; margin: 0in 0in .0001pt 42.0pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">7. The representative of the industry has request to grant valid consents so that EPR registration on CPCB portal could be applied. </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 12.6pt; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; color: black; mso-themecolor: text1; background: white;">Further, the industry has submitted an undertaking dated 13.04.2023 through email stating that <em><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi;">my product compostable bags is completely based on corn starch granules and we are not using any kind of plastic and not in future too because our product is totally based on starch material. </span></em></span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 12.6pt; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">Earlier, show cause notice before refusal of consents to operate under the provisions of Water Act, 1974 & Air Act, 1981 have been issued to the industry with an opportunity of personal hearing on 08.06.2023 before Worthy Chairman of the Board.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: 12.6pt; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">During hearing, the representatives of the industry failed to submit any written reply w.r.t. notice issued to the industry. However during hearing they stated that:-</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: 15.05pt; background: white; margin: 0in 0in .0001pt 22.5pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">1. The industry submitted a copy of the email received from CIPET Testing Ahemdabad wherein it has been stated that the raw material for the production of bio-degradable bags complies with the ISO 17088:2012.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: 15.05pt; background: white; margin: 0in 0in .0001pt 22.5pt;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">2. The industry informed that in the state many units are manufacturing compostable plastic carry bags as well as plastic carry bags and are also having valid 'consents to operate' of the Board under the Water Act, 1974 & Air Act, 1981.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 15.05pt; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;"> </span></p>

S.O.438/P.A.9/1994/S-30/2016 dated 29.03.2016 issued by the Department of Rural Development & Panchayats, whether the plastic carry bags are biodegradable or compostable in nature.</span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.0in; line-height: normal; background: white;"><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">Now, the industry has again applied consents under the Water Act, 1974 & the Air Act, 1981 and has submitted CA certificate dated 10.12.2023, showing value of gross fixed assets of Rs. 101.53 lacs as on 31.10.2023, accordingly the industry has deposited additional consent fee of Rs. 73600/- (including penalty of Rs. 3200/-) vide UTR / Ref. No. N353232791543964 dated 19.12.2023 under Water Act, 1974 and Rs. 67700/- (including penalty of Rs. 3200/-) vide UTR / Ref. No. N353232791546038 dated 19.12.2023 under Air Act, 1981, which is adequate upto 31.12.2033. The industry has submitted an undertaking, relevant part of which is reproduced as under:</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: .5in; text-align: justify; line-height: normal; background: white;"><em><span style="font-size: 10.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: black; mso-themecolor: text1;">"We request that we are manufacturing of Bio All Cut Types Carry Bags using completing biodegradable material. We have also submitted documents from are vendor regarding biodegradable raw material. Please grant us consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and the Board can get out unit and take sample of out raw material and products. We hereby submit that if any non-biodegradable plastic material is found, the Board shall take any strict action against us and we will comply with all the directions and order of the Board."</span></em></p>
