It is submitted that the establishment is a rice sheller unit and the proprietor of the industry i.e. Sh. Vikas Garg, (Partner) was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/SGR/2021/16430117  dated 02/08/2021 and under the Air Act, 1981 vide no. CTOA/Renewal/SGR/2021/16429888 02/08/2021, which are valid upto 30/09/2026, for manufacturing of <a name="_Hlk156562630"></a>Raw Rice (without Sortex Machinery and without Dryer) @ 1.0 TPH by processing Paddy @ 1.5 TPH as raw material under the name of M/s New Garg Gram Udyog Samiti (Regd),  with certain conditions mentioned therein.                  Now, the partner of the industry i.e. Sh. Vikas Garg has proposed to change the name of industry from M/s New Garg Gram Udyog Samiti (Regd), to M/s Sri Sai Nath Rice Mill and accordingly has applied for obtaining varied consents to operate under Water Act, 1974 and the Air Act, 1981 for production of Raw Rice (without Sortex Machinery and without Dryer) @ 1.0 TPH by processing Paddy @ 1.5 TPH as raw material, under the name of M/s Naina Rice Mills. In this regard, the industry has submitted Form A & C (registration of firm cert.) alongwith partnership deed as proof of change of name of Industry.                  The consent fee already deposited by the industry along with previous granted applications was adequate upto 30.09.2026.                  The industry has now deposited Rs. 3,600/- vide UTR no. 309357329 dated 25.09.2023 under the Water Act, 1974 and the Air Act, 1981, against the gross fixed assets of value 13.15 lacs as on 01.09.2023, as per CA certificate dated 01.09.2023 which is adequate for one year.                  The industry has also deposited Rs. 1,100/- vide UTR no. 687594942 dated 25.09.2023 as NOC regularization fee. Although, there is no change in value of gross fixed assets as per the record file of this office.                  After considering the fact of Board’s policy in the case of change of name of industry and deducting the fee for one year under the Water Act, 1974 and the Air Act, 1981, the adequacy of the fee becomes upto 30.09.2025.                     To verify the compliance of consent conditions earlier granted to the industry & the code of practice, the industry was visited by undersigned on 15/01/2024 and it was observed as under : - 1.   The industry was not in operation during visit. 2.   The industry has provided Cyclone Separator as APCD along with stack of adequate height to control the process emission from shelling section. 3.   The industry has covered all the processing sheds. 4.   The industry has provided brick paved road from main gate of the industry to the rice room/husk area for the movements of vehicles. 5.   The industry has provided brick wall of 10 feet height in front of the discharge point of rice husk area and the length of aforesaid brick wall is 35' on each side of the rice husk discharge point. The industry has  provided jalli of 5 feet height above the brick wall in front of the discharge point of rice husk area. 6.   The industry has no source of trade effluent generation and the industry has provided septic tank for treatment of domestic effluent to be generated from toilets / washrooms. It has also made plantation along boundary wall to utilize treated domestic effluent after septic tank.                  The industry has also submitted compliance report of consent conditions earlier granted to it under the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contentds of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Air (Prevention & Control of Pollution) Act, 1981. The industry has also submitted undertaking regarding updation of APCD from time to time, in future as and when required by PPCB or Punjab Govt.                           No complaint is pending against the industry.                  Keeping above in view, it is recommended that varied consent to operate granted under the Water Act, 1974 and the Air Act, 1981 both may be granted up to 30/09/2025 for manufacturing of Raw Rice (without Sortex Machinery and without Dryer) @ 1.0 TPH by processing Paddy @ 1.5 TPH as raw material under orange category, under the name of M/s Sri Sai Nath Rice Mill (Previously known as M/s New Garg Gram Udyog Samiti (Regd), subject to certain conditions to be mentioned therein.
