1.           As per the record file, the industry was previously issued show cause notice before refusal of consents to operate under the provisions of Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before the Chairman of the Board on 08.06.2023, wherein amongst other decisions it was decided that : a)        The industry shall obtain a certificate from the manufacturer supplying raw material or from some approved agency like CIPET to the effect that the raw material to be used and product i.e. carry bags to be produced does not contains any plastic material and the report regarding the same shall be submitted to the Regional Office, Faridkot, within 15 days. In case the industry fails to submit the clarification in the matter, the applications applied by it for obtaining 'consents to operate' under the Water Act, 1974 & Air Act, 1981 will be refused without any further notice/opportunity of hearing. b)   Environmental Engineer, Regional Office, Faridkot on the receipt of the report in compliance to decision no. 1 above, shall process the applications applied by the industry under the Water Act, 1974 & Air Act, 1981 on merits. 2.                     Thereafter, the industry submitted a copy of undertaking from M/s Vision Industries, District Gandhinagar, Gujrat, wherein it was mentioned that they are supplying biodegradable polymers to M/s Greenista, which does not contain any petro chemical waste plastic and is fully biodegradable and compostable within 180 days. The material is tested by CIPIET India and NAB Lab across India.  The firm M/s Vision Industries has submitted the test report of CIPIET, CTE issued by Gujrat State Pollution Control Board and the certificate of CPCB to manufacture/sell compostable plastic. 3.     From the perusal of the documents submitted in the matter, it was observed that:- a)     The CPCB has issued certificate dated 19.07.2022 to manufacture/sell compostable plastic to M/s Vision industries, Distt. Gandhinagar, Gujrat (supplier to M/s Greenista), wherein it has been mentioned that the certificate is issued to the industry as "Manufacturer", subject to the condition that the end product "compostable plastic and commodities" shall be manufactured using the raw material "compostable stratch granules, PLA, PBAT, biodegradable resin" and following the production process. b)   The analysis report of the compostable film of M/s Vision industries, Distt. Gandhinagar, Gujrat (supplier to M/s Greenista) carried out by CIPET Chennai dated 19.01.2021 submitted, wherein it has been mentioned that the compostable film sample consists of blend of poly lactic acid (PLA) and poly butylene adipate co-terephthalate (PBAT), which is bio-degradable @ 90.06% at the end of 109 days. 4.         The applications applied by the industry under the Water Act, 1974 and Air Act, 1981 were refused dated 09.08.2023 as the documents submitted by the industry i.e. the report of CIPET and the certificate issued by CPCB to the supplier namely M/s Vision industries, Distt. Gandhinagar, Gujrat of the industry, does not specify anywhere that the raw material to be used and product i.e. carry bags to be produced does not contains any plastic material and moreover it has been mentioned in the certificate issued by CPCB and in the analysis report of CIPET that the raw material consists of PLA and PBAT. 5.      Thereafter, applications again applied under the Water Act, 1974 and Air Act, 1981 alongwith a copy of an undertaking from Vision Industries, wherein it has been mentioned that we are supplying biodegradable polymers to M/s Greenista. We supply PBAT, PLA and Bio-Fillers and these products do not contain any plastic material. These materials are fully biodegradable and compostable in environment within 180 days. The material is tested by CIPIET India and NABL Lab across India, however has still attached the CPCB letter dated 19.07.2022 with the application, the detail of which is already mentioned in para 3(a) above. 6.    The application was returned as the industry failed to submit the compliance w.r.t. decisions of the personal hearing dated 08.06.2023. 7.     Now again the application applied by the industry alongwith an undertaking wherein it has been mentioned that they are manufacturing bio all cut types carry bags using completely bio-degrdable material. Documents also submitted from the vender regarding the bio-degradable material. Requested for grant of CTOs under the Water Act, 1974 & Air Act, 1981 alongwith the request to take the sample of the raw material/product. 8.     As the industry failed to submit any document from the CPCB or from any approved agency like CIPET mentioning that the raw material to be used and the product to be produced does not contain any plastic material and moreover, in the earlier submitted certificate issued by CPCB to the supplier namely M/s Vision industries, Gandhinagar, Gujrat and in the analysis report of CIPET it has been mentioned that the raw material consists of blend PLA & PBAT, which is bio-degradable @ 90.06% at the end of 109 days, however no where it has been mentioned that the raw material/product  does not consists any plastic material.               In view of above, if approved, the Regional Office be advised to return the application as the industry has failed to comply with the decisions of the personal hearing dated 08.06.2023 i.e. failed to submit any document from CPCB or from some approved agency like CIPET to the effect that the raw material be used and the product i.e. carry bags to be produced does not contain any plastic material.
