<p style="text-align: justify;">It is submitted that earlier the industry was granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2022/20635821 dated 26/12/2022 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2022/20635811 dated 26/12/2022, both having validity upto 25/12/2023 or Cleaning of Contaminated drums/barrels @ 100 Numbers/day by using Contaminated drums/barrels @ 100 Numbers/day and Sodium Hydroxide @ 5 Numbers/day as raw material, subject to certain terms and conditions mentioned.</p>
<p style="text-align: justify;">Now, the industry has applied for obtaining renewal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</p>
<p style="text-align: justify;"> </p>
<p style="text-align: justify;">As per record file, earlier the industry had deposited consent fee, which is adequate upto 30.06.2027. Now, the industry has deposited Penalty and application form fee of Rs. 640/- vide no. 74712759 dated 09.01.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Penalty of Rs. 140/- vide no. 262337336 dated 09.01.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.06.2027, against the fixed assets of Rs. 8.43 lakhs as on 31.03.2023.</p>
<p style="text-align: justify;"><span lang="EN-IN">Status of Passbook under Rule, 09 of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016</span><span lang="EN-IN">:</span></p>
<p style="text-align: justify;">The industry has been issued actual user certificate cum passbook by the Board vide letter no. PPCB/ZP-1/2022/AUC/F-22 dated 28.09.2022 and the passbook is valid upto 27.09.2027.</p>
<p style="text-align: justify;"> </p>
<p style="text-align: justify;"><strong>Visit:</strong></p>
<p style="text-align: justify;"> Accordingly, the industry was visited by AEE of this office on 18.01.2024 and during visit, it was observed as under:</p>
<p style="text-align: justify;">1. The site of the industry is located in Village Bhagwanpura, Tehsil Derabassi, District SAS Nagar.</p>
<p style="text-align: justify;">2. The industry has constructed 02 no. sheds for the storage of treated / untreated drums and the drums was found to be stored under these sheds.</p>
<p style="text-align: justify;">3. The industry has installed 02 trays with fixed nozzles for the washing of contaminated drums.</p>
<p style="text-align: justify;">4. The industry has installed electric evaporator for the treatment of wastewater generated.</p>
<p style="text-align: justify;">5. The industry has provided flow meters at the source of fresh water and line carrying water for washing purpose.</p>
<p style="text-align: justify;">6. Further, industry was found complying with the SOP issue by the CPCB for such type of units.</p>
<p style="text-align: justify;">7. The industry was advised to improve the housekeeping of the unit.</p>
<p style="text-align: justify;">8. The industry has not installed any DG set in its premises.</p>
<p style="text-align: justify;">From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</p>
<p style="text-align: justify;"><strong>Recommendations:</strong></p>
<p style="text-align: justify;"> In view of above, if may approved, the industry may be granted renewal of ‘Consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 upto 30.06.2027, subject to suitable conditions and following additional conditions:</p>
<p style="text-align: justify;"> </p>
<p style="text-align: justify;"><span lang="EN-IN">1. </span><span lang="EN-IN">The industry shall strictly comply with the provision of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.</span></p>
<p style="text-align: justify;"><span lang="EN-IN">2. </span><span lang="EN-IN">The industry shall maintain the record of receiving of used containers from the different states and submit the same in the Regional office on monthly basis.</span></p>
<p style="text-align: justify;"><span lang="EN-IN">3. </span><span lang="EN-IN">The industry shall comply with the standard operating procedure (SOP) framed by the CPCB for washing of used containers of Category 33.1 at all times.</span></p>
<p style="text-align: justify;"><span lang="EN-IN">4. </span><span lang="EN-IN">The industry shall obtain permission from PWRDA for abstraction of groundwater (if applicable).</span></p>
<p style="text-align: justify;"><span lang="EN-IN">5. </span>The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.</p>
<p style="text-align: justify;"><span lang="EN-IN">6. </span>The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received</p>
<p style="text-align: justify;"><span lang="EN-IN">7. </span>The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.</p>
<p style="text-align: justify;"><span lang="EN-IN">8. </span>In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.</p>
