File Note: <p style="text-align: justify;">It is submitted that the subject cited industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Varied/FGS/2022/19935601 dated 03/10/2022 and under the Air Act, 1981 vide no. CTOA/Varied/FGS/2022/19919528 dated 03/10/2022, both were valid upto 19/07/2023 for the manufacturing of MS Round, Flats, Square etc. @ 200 MTD subject to the suitable terms &amp; conditions mentioned therein.</p> <p style="text-align: justify;">Now, the industry has applied for obtaining varied consent to operate under the Water Act, 1974 and Air Act, 1981 for the manufacturing of M.S. Round, Flats, Square etc. @ 275 MTD by using Ingots, Billets &amp; Slab etc. @ 296 MTD as raw material due to heavy sizes and upgradation in the machinery while converting from Gasi Fired to Gas Fired (Piped Natural Gas-PNG) alongwith requisite documents and consent fee.</p> <p style="text-align: justify;">The industry has submitted the CA certificate dated 29/12/2023, wherein, it has mentioned that the total value of fixed assets of the industry as on 31/03/2023 is Rs. 1269.29 lakhs with value of plant &amp; machinery is Rs. 828.22 lakhs. Accordingly, the industry has deposited of Rs. 14,400/- vide R. no. 982111708 dated 03/01/2024 &amp; Rs. 43,200/- vide R. No. 146781296 dated 11/01/2024 under the Water Act, 1974 &amp; Rs. 16,600/- vide R. no. 991807753 dated 03/01/2024 &amp; Rs. 43,200/- vide R. No. 413498211 dated 11/01/2024 under the Air Act, 1981. As such, after deducting Rs. 2200/- as NOC regularization fee for increase in cost of fixed assets and deducting 25% penalty under each Act, the fee deposited by the industry under both the Acts is adequate upto 31/03/2027 as per Board's Office Order dated 29/10/2018.</p> <p style="text-align: justify;">Further, the industry was visited by AEE of this office on&nbsp;<strong>22/01/2024</strong>&nbsp;and during visit, it was observed that: -</p> <p style="text-align: justify;">1.<span style="white-space: pre;"> </span>The industry was in operation during visit.</p> <p style="text-align: justify;">2.<span style="white-space: pre;"> </span>The industry has installed 1 no. reverberatory furnace and PNG used as fuel in furnace.</p> <p style="text-align: justify;">3.<span style="white-space: pre;"> </span>The industry has dismantled its Gasi fired and now the industry has using (Piped Natural Gas-PNG) as fuel.</p> <p style="text-align: justify;">4.<span style="white-space: pre;"> </span>The industry has maintained its already stabilized vehicular movement area within industry/entry/exit points to suppress the dust emissions.</p> <p style="text-align: justify;">5.<span style="white-space: pre;"> </span>There is no generation of trade effluent and domestic effluent is being discharged into MC sewer.</p> <p style="text-align: justify;">6.<span style="white-space: pre;"> </span>The industry is located in Industrial Zone as per master plan of Mandi Gobindgarh.</p> <p style="text-align: justify;">It is pertinent to mention here that the industry has applied online for grant of Terms of Reference (ToR) followed by Environment Clearance in compliance to the previous consent condition.</p> <p style="text-align: justify;">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</p> <p style="text-align: justify;">"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."</p> <p style="text-align: justify;">PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.</p> <p style="text-align: justify;">In the subject cited case, the industry has mentioned ground water extraction @ 17 KLD. Considering 25 working days per month, ground water extraction will be 425 KL/month, which is more than 300 KL/month. The industry has applied for obtained permission from PWRDA.&nbsp;</p> <p style="text-align: justify;">From above, it is clear that the industry is complying with the provisions of the Water Act, 1974 and Air Act, 1981.</p> <p style="text-align: justify;">In view of facts mentioned above, if approved, it is recommended that the varied consent to operate under the Water Act, 1974 and &amp; the Air Act, 1981 for the manufacturing of MS Ingots and Castings @ 84 MTD alongwith MS Ingot Billet Re rolled Products @ 84 MTD may be granted upto&nbsp;<strong>31/12/2026</strong>&nbsp;with suitable conditions &amp; special conditions as under:</p> <p style="text-align: justify;">1.<span style="white-space: pre;"> </span>The industry shall obtain permission from the Punjab Water Regulation and Development Authority (PWRDA) for the abstraction of ground water.&nbsp;</p> <p style="text-align: justify;">2.<span style="white-space: pre;"> </span>The industry will not generate and discharge any trade effluent without obtaining prior written permission of the Board.&nbsp;</p> <p style="text-align: justify;">3.<span style="white-space: pre;"> </span>The industry shall install sensor/Hooting system to sensitize the labor/worker as and when there will be any leakage of gas.&nbsp;</p> <p style="text-align: justify;">4.<span style="white-space: pre;"> </span>The industry shall depute skilled manpower to operate rolling mills based on PNG.&nbsp;</p> <p style="text-align: justify;">5.<span style="white-space: pre;"> </span>The industry shall not use any fuel except PNG in its furnaces.&nbsp;</p> <p style="text-align: justify;">6.<span style="white-space: pre;"> </span>The industry maintains it's already stabilized its vehicular movement area within industry/entry/exit points, to suppress the dust emissions.&nbsp;</p> <p style="text-align: justify;">7.<span style="white-space: pre;"> </span>The industry shall not carry out any activity, which covered under the ambit of EIA Notification, 2006.&nbsp;</p> <p style="text-align: justify;">8.<span style="white-space: pre;"> </span>The industry shall not change/modernize its manufacturing process and shall not increase its production capacity.&nbsp;</p> <p style="text-align: justify;">9.<span style="white-space: pre;"> </span>The industry shall provide thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the industry.</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;"><strong>Scale &ndash; Medium</strong></p> <p style="text-align: justify;"><strong>Date of Receipt &ndash; 11/01/2024</strong></p> <p style="text-align: justify;"><strong>Date of Scrutiny &ndash; 20/01/2024</strong></p> <p style="text-align: justify;"><strong>Date of visit- 22/01/2024</strong></p> <p style="text-align: justify;"><strong>Date of Deemed Approval &ndash; 02/02/2024</strong></p> <p style="text-align: justify;"><strong>Competency &ndash; SEE</strong></p> <p style="text-align: justify;">&nbsp;</p>
