<p style="text-align: justify;">· <span style="text-indent: -24px;">The industry has been established without obtaining NOC /consents to operate of the Board under the provisions of Water Act, 1974 & Air Act, 1981.</span></p>
<p style="text-align: justify;"><span style="text-indent: -24px;">·</span><span style="text-indent: -24px;"> </span>The industry was visited by the officer of the Board on 12.01.2023 and it was observed that the industry was in operation for the repair of the old transformer alongwith painting in open. The trade effluent generated from the process was disposed off unscientifically without any treatment.</p>
<p style="text-align: justify;">· The industry was issued show cause notice for violation of the provisions of Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer on 30.01.2023, wherein it was decided that:-</p>
<p style="text-align: justify;">1. The industry shall submit certificate regarding suitability of site at the present location viz-a-viz applicability of zoning regulations of Master Plan of the area from the Department of Town & Country Planning/Local Body (as applicable), within one month.</p>
<p style="text-align: justify;">2. The industry shall not operate its polluting process until it obtains consents to operate of the Board under the provision of Water Act, 1974 & Air Act, 1981.</p>
<p style="text-align: justify;">3. Regional Office, Bathinda shall visit the industry to ensure the compliance of the decision no. 2 above and send report / recommendations in case any violation(s) is observed on the part of the industry alongwith the report regarding suitability of the site as per the zoning regulations.</p>
<p style="text-align: justify;">4. During hearing, it has been made clear to the representative of the industry that in case of non-compliance of decisions of the hearing within stipulated period / any violation(s), further action as deemed fit shall be initiated against the industry.</p>
<p style="text-align: justify;">· A complaint has been received regarding pollution caused by the industry by discharging untreated effluents and by carrying out spray painting in open.</p>
<p style="text-align: justify;">· The industry was visited by the officer of the Board on 22.09.2023 and it was observed as under:-</p>
<p style="text-align: justify;">1. The industry was in operation during visit and is engaged in repair of transformers.</p>
<p style="text-align: justify;">2. The industry has installed a electric fired oven, a spray paint gun, a washing section and transformer oil storage tanks.</p>
<p style="text-align: justify;">3. During visit, the industry was carrying out the process of the wire winding and washing of transformers. Oil & grease trap-cum-grit chamber provided for the treatment of the effluent generated from the process with the provision to re-utilize the same for washing purposes.</p>
<p style="text-align: justify;">4. The industry is also engaged in spray painting of transformers and its parts in open. The process was not in operation during visit however stains of the paint were observed on the walls. The project proponent informed that order for the installation of the paint booth equipped with water scrubber as APCD has been placed and during visit the un- commissioned water scrubber was also found lying in the premises.</p>
<p style="text-align: justify;">5. No documentary proof submitted regarding suitability of the site for industrial operation.</p>
<p style="text-align: justify;">· The industry is in operation without obtaining consents to operate under the Water Act, 1974 & Air Act, 1981. The industry has failed to ensure the compliance of the decisions of the personal hearing dated 30.01.2023 and is violating the provisions of Water Act, 1974 & Air Act, 1981. </p>
<p style="text-align: justify;">· In view of above, the industry was issued show cause notice for violation of the provisions of Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer on 11.10.2023. During hearing, Sh. Sukhwinder Singh, Prop. stated that the industry is established in the year 2009 i.e. well before the notification of the master plan. He further requested that a time period of 15 days be provided to attend all the shortcomings and to apply for obtaining consents to operate under the Water Act, 1974 & Air Act, 1981.</p>
<p style="text-align: justify;">· After hearing the Prop. of the industry as well as officers of the Board, it has been decided that:-</p>
<p style="text-align: justify;">1. The industry shall submit certificate regarding suitability of site at the present location viz-a-viz applicability of zoning regulations of Master Plan of the area from the Department of Town & Country Planning/Local Body (as applicable), within 07 days.</p>
<p style="text-align: justify;">2. The industry shall not operate its polluting process until it obtains consents to operate of the Board under the provision of Water Act, 1974 & Air Act, 1981.</p>
<p style="text-align: justify;">3. The industry shall apply for obtaining consents to operate under Water Act, 1974; Air Act, 1981 and authorization under HOWM Rules, within 15 days.</p>
<p style="text-align: justify;">4. Regional Office, Bathinda shall visit the industry immediately after 15 days to verify the compliance(s) made by it and process the applications to be applied by the industry under the Water Act, 1974; Air Act, 1981 and authorization under the HOWM Rules, 2016, on merits.</p>
<p style="text-align: justify;">5. During hearing, it has been made clear to the Prop. of the industry that in case of non-compliance of decisions of the hearing within stipulated period / any violation(s), further action as deemed fit shall be initiated against the industry.</p>
<p style="text-align: justify;">· Now, the industry has applied for CTOs under the provisions of Water Act, 1974 & Air Act, 1981 for repairing of the transformers @ 20 nos/day at Badal Road, Bathinda in an area of 3600 sq. yard.</p>
<p style="text-align: justify;">· The industry has submitted the report from DTP, Bathinda vide his office letter no. 1974 dated 21.12.2023, wherein it has been mentioned that the industry falls in the residential zone as per Master Plan, Bathinda and is not permitted for operation at the said site. However, as per the documents submitted by the industry, the unit has been established before the notification of Master Plan, Bathinda so as per clause no. 1.7 of unified zoning regulations 2018, the industry can be permitted for its operation for 15 years from the date of implementation of Master Plan, Bathinda after obtaining due permission from the Competent Authority.</p>
<p style="text-align: justify;">· The project proponent has submitted telephone bill of the year 2007 alongwith PSPCL receipt dated 18.01.2007 & 31.01.2007 and has also submitted the copy of registration certificate of firm dated 24.01.2007.</p>
<p style="text-align: justify;">· The Regional Office has reported that the Master Plan of Bathinda was notified vide no. 4030CTP(Pb)/SB-59 dated 25.05.2010.</p>
<p style="text-align: justify;">· As per the policy dated 30.04.2013, PPCB will continue to grant its consent to operate/ authorization to all industries not having any hazardous process, existing and operating in non-designated industrial areas prior to the date of notification of Master Plan provided the industry complies with the prescribed norms for the discharge of effluent/ emissions.</p>
<p style="text-align: justify;">· The visiting officer has reported that the industry was visited on 06.01.2024 and it was observed that:-</p>
<p style="text-align: justify;">1. The industry was not in operation during visit.</p>
<p style="text-align: justify;">2. The process carried out by the industry is procurement of old transformer, dismantling, removal of old transformer oil, cleaning, washing and repair old transformer cases, brush painting of old transformer cases and its parts, winding of transformer wire and fitting in case, filling of repaired transformer with transformer oil, heat treatment in oven, quality check and dispatch. The industry has installed an electric fired oven, a washing section and transformer oil storage tanks.</p>
<p style="text-align: justify;">3. The project proponent has installed 2 set of oil & grease trap-cum-grit chamber for treatment of the effluent generated form the process leading to sedimentation tank finally leading to the clear water tank having pump and pipe arrangement for re-use of the treated effluent.</p>
<p style="text-align: justify;">4. The industry is also engaged in spray painting of transformers and its parts and has installed water scrubber as APCD with adequate stack height.</p>
<p style="text-align: justify;">5. Further, the visiting officer has reported that the industry is located within MC limit and in the residential zone, but since the industry has been established prior to the notification of the Master Plan, Bathinda as such the site of the industry can be regularized for operation for 15 years from the date of the notification of the Master Plan.</p>
<p style="text-align: justify;">· In view of above, if approved, CTO under the Air Act, 1981 may be granted to the industry upto 31.03.2025, with the following special conditions that:-</p>
<p style="text-align: justify;">1. The industry shall obtain necessary permission from the Department of Town & Planning for its operation on said location, within one month.</p>
<p style="text-align: justify;">2. The industry shall be bound to shift from its existing premises to the designated area in compliance to the bye-laws of Master Plan, Bathinda.</p>
<p style="text-align: justify;">3. The industry will ensure to reuse its entire effluent (generated from the washing of transformer bodies) and will not discharge the same without prior written permission of the Board.</p>
