File Note: <p style="text-align: justify;"><strong>Subject: <span style="white-space: pre;"> </span>Application for obtaining 'Consent to Establish' (NOC) under the provisions of the Water Act, 1974 and Air Act, 1981 - M/s Chandigarh Premium Outlets Developed By Guru Nanak Realtors, Village Pohlo Majra, Chandigarh-Ludhiana Road, Tehsil Khamanon, District Fatehgarh Sahib.</strong></p> <p style="text-align: justify;">It is submitted that the establishment namely M/s Guru Nanak Realtors has proposed to develop Commercial project namely Chandigarh Premium Outlets at Village Pohlo Majra, Chandigarh-Ludhiana Road, Tehsil Khamanon, District Fatehgarh Sahib. The project proponent has applied for obtaining Consent to Establish (NOC) under the provisions of the Water (Prevention &amp; control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 for Commercial plots @ 98 numbers, alongwith requisite documents and NOC fee.</p> <p style="text-align: justify;">The PP has submitted the sale deed of land executed between Sh. Jaswant Singh, Sh. Rajvir Singh, Sh. Ravi Verma, Sh. Digvijay Singh, Sh. Davinder Singh, Sh. Parminder Singh and M/s Guru Nanak Realtors of total land area of 47 Bighe 9 Biswa. The PP has submitted the Change of Land Use (CLU) for developing commercial colony of the total land area of 43 Bighe 11 Biswa (9.0729 Acre) vide letter no. 1474/DTP/FGS/CL-1 dated 19/12/2022.&nbsp;</p> <p style="text-align: justify;">The PP has submitted the Admission-cum-Retirement partnership deed dated 28/04/2022, according to which Sh. Jasmeet Singh Bhatia, Sh. Sandeep Kumar Bhatia and Sh. Sumit Jain are the partners of M/s Guru Nanak Realtors. Further, the PP has submitted the authorization letter vide which Sh. Sandeep Kumar Bhatia is the authorized signatory on behalf of M/s Guru Nanak Realtors.&nbsp;</p> <p style="text-align: justify;">The PP has also submitted the License to develop a commercial colony vide License No. LDC-48/2023 dated 14/11/2023 granted under the Punjab Apartment &amp; Property Regulation Act, 1995 to M/s Guru Nanak Realtors at Village Pohlo Majra, Tehsil Khamanon, District Fatehgarh Sahib in area of 9.0729 Acres.</p> <p style="text-align: justify;">The project proponent has submitted the brief project report as per which, the proposed cost of the project is Rs. 679.14 lakhs. Accordingly, the project proponent has deposited NOC fee amounting to Rs. 10,800/- vide UTR. No. YESB40129624351 dated 12/01/2024. The fee deposited by the project proponent is adequate for 01 year as per Board's circular dated 29/10/2018.</p> <p style="text-align: justify;">The PP has submitted the site plan approved vide letter no. 1108-STP(SAS)/SS-11 dated 05/09/2023 by Member Layout Plan Scrutiny Committee-cum-Senior Town Planner, SAS Nagar.</p> <p style="text-align: justify;">The project proponent has submitted the feasibility report, wherein, it has proposed to install STP of capacity 40 KLD based on MBBR technology. The total water demand for the project is 42 KLD which will be met through submersible and the treated effluent after treatment in STP @ 21.56 KLD will be used for flushing and remaining 12.04 KLD will be disposed off onto land for plantation in an area of 3 kanal. As per the feasibility report, Solid waste will be generated from the residential complex, which will be segregate into biodegradable &amp; non-biodegradable waste. Biodegradable waste will be used as composter by vermi-composting pits &amp; non-recyclable waste will be dumped to authorized MC dumping site or it will handover to Waste management facility.</p> <p style="text-align: justify;">The site of the project was visited by AEE of this office on 24/01/2024 and during visit, it was observed that:</p> <p style="text-align: justify;">1.<span style="white-space: pre;"> </span>The project proponent has proposed to construct commercial plots @ 98 numbers at Village Pohlo Majra, Chandigarh-Ludhiana Road, Tehsil Khamanon, District Fatehgarh Sahib</p> <p style="text-align: justify;">2.<span style="white-space: pre;"> </span>As per the boundary limits of the site shown by the representative during the visit, there is no operational approved existing MAH industry within a radius of 250 m from the boundary of the proposed site of the project.&nbsp;</p> <p style="text-align: justify;">3.<span style="white-space: pre;"> </span>There is no operational approved existing air polluting industry falls within a radius of 100 m from the boundary of the project.</p> <p style="text-align: justify;">4.<span style="white-space: pre;"> </span>The project proponent has started the construction work of the boundary wall.</p> <p style="text-align: justify;">5.<span style="white-space: pre;"> </span>The project proponent has proposed to install 01 no. DG set of capacity 125 KVA with canopy and stack of adequate height.</p> <p style="text-align: justify;">In view of the above, it is recommended that Consent to Establish (NOC) from pollution angle under the provisions of the Water (Prevention &amp; control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 may be granted for one year for commercial plots @ 98 numbers subject to the suitable conditions and following additional conditions that:</p> <p style="text-align: justify;">1.<span style="white-space: pre;"> </span>The Project Proponent shall ensure that the total built up area of construction being carried out by it or any different builders may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain the environmental clearance, failure which, the promoter company/builder shall be liable for action for the violation of EIA notification dated 14/09/2006.</p> <p style="text-align: justify;">2.<span style="white-space: pre;"> </span>The promoter company shall ensure that the total built up area of all individual projects/plots combined together is not more than 1,50,000 sqm, otherwise the project as such is covered under category 8(b) of the schedule appended to the EIA notification and project proponent of the area development project is required to obtain the environmental clearance, failure which, the promoter company shall be liable for action for the violation of EIA notification dated 14/09/2006.</p> <p style="text-align: justify;">3.<span style="white-space: pre;"> </span>The project proponent shall obtain permission from PWRDA for extraction of ground water before obtaining consent to operate.</p> <p style="text-align: justify;">4.<span style="white-space: pre;"> </span>The project proponent shall comply with the conditions of CLU granted to it.</p> <p style="text-align: justify;">5.<span style="white-space: pre;"> </span>The project proponent shall not carry out any activity, which covered under category 8-B of the EIA notification dated 14.09.2006.</p> <p style="text-align: justify;">6.<span style="white-space: pre;"> </span>The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.</p> <p style="text-align: justify;">7.<span style="white-space: pre;"> </span>The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disburse in the air in any form.</p> <p style="text-align: justify;">8.<span style="white-space: pre;"> </span>The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.</p> <p style="text-align: justify;">9.<span style="white-space: pre;"> </span>The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.</p> <p style="text-align: justify;">10.<span style="white-space: pre;"> </span>The NOC/ CTE has been granted on the basis of information filed by the project proponent and if, in future any information is found wrong, the Board has right to revoke the NOC/ CTE.</p> <p style="text-align: justify;">Scale &ndash; Small (Green)</p> <p style="text-align: justify;"><strong>Date of Receipt &ndash; 18/01/2024</strong></p> <p style="text-align: justify;"><strong>Date of Scrutiny &ndash; 23/01/2024</strong></p> <p style="text-align: justify;"><strong>Date of visit- 24/01/2024</strong></p> <p style="text-align: justify;"><strong>Date of Deemed Approval &ndash; 09/02/2024 (15 working days)</strong></p> <p style="text-align: justify;"><strong>Competency &ndash; SEE</strong></p> <p style="text-align: justify;">&nbsp;</p>
