File Note: <p style="text-align: justify;">The note of RO may kindly be perused.</p> <p style="text-align: justify;"><span lang="EN-US">The Township was granted &lsquo;Consent to Operate&rsquo; under the Water (Prevention &amp; Control of Pollution) Act, 1974 &amp; the Air (Prevention &amp; Control of Pollution) Act, 1981 vide no: CTOW/Renewal/LDH3/2022/18339523 &amp; CTOA/Renewal/LDH3/2022/18339509 both dated 26.05.2022, valid upto 31.03.2023 each, for operation of Township in an area of 108 acres alongwith discharge of Domestic effluent @ 1417 KLD (Effluent @ 152 KLD will be used in cooling, @ 675 KLD will be used for irrigation &amp; @ 590 KLD will be used for flushing after treatment in the STP), subject to suitable conditions alongwith following special conditions:</span></p> <p style="text-align: justify;"><span lang="EN-US">1.&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The project proponent shall comply with the conditions stipulated by Ministry of Environment &amp; Forest while granting the Environmental clearance, in totality including that for the treatment and disposal of treated effluent</span></p> <p style="text-align: justify;"><span lang="EN-US">2.&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The project proponent has very less occupancy in the colony and constructed few dwelling housing and commercial units vis-a-vis total proposal submitted at the time of NOC/ Environmental Clearance. The project proponent will augment the capacity of its Sewage Treatment Plant (STPs) with the increase of occupancy and shall also increase the area under plantation for utilization of treated effluent accordingly.</span></p> <p style="text-align: justify;"><span lang="EN-US">3.&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The project proponent will ensure that there will be no problem due to odour emissions from the STP/Domestic sewage.</span></p> <p style="text-align: justify;"><span lang="EN-US">4.&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The project proponent shall make necessary arrangements for the environmentally sound collection, segregation and disposal of municipal solid waste as per the Municipal Solid Waste Management Rules, 2016.</span></p> <p style="text-align: justify;">The project proponent has submitted requisite documents as verified by the RO. However, the adequacy of the fee has been mentioned as 21.12.2023 which needs to be clarified from RO.</p> <p style="text-align: justify;"><span lang="EN-US">The site was visited by AEE of RO3&nbsp; on 27.12.2023 and it has been reported as under:</span></p> <p style="text-align: justify;"><span lang="EN-US">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">Township has total area of 108 acres and the project proponent has constructed boundary wall of entire site.</span></p> <p style="text-align: justify;"><span lang="EN-US">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">Township is mainly a plotted colony and all plots are lying vacant. No house has been constructed in entire colony except for few in-complete house structures. The project proponent has constructed 30 no. 3 BHK flats &amp; 3 no. 2 BHK flats. Presently only 02 flats are occupied. The project proponent has also constructed 54 no. SCOs, but there is no occupancy. The project proponent has constructed site office.</span></p> <p style="text-align: justify;"><span lang="EN-US">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">There is one eye care hospital namely M/s Sankara Eye Hospital within the premises of Township. Hospital has provided its captive ETP &ndash; cum &ndash; STP and is discharging its treated water within its own premises.</span></p> <p style="text-align: justify;"><strong><span lang="EN-US">Thus from the note of RO the project is in nascent stage and has not been developed to a major extent.</span></strong></p> <p style="text-align: justify;"><span lang="EN-US">RO has further reported that the PP is not complying with the conditons of EC alreasy obtained by it from the MoEF&amp;CC i.e. c</span>ondition no. III, XIX (Specific conditions), VI (Operational phase), XI (Operational phase).</p> <p style="text-align: justify;">These conditions mainly relate to obtaining permission from the CGWA, providing first aid room, provisiding municipal waste handling arrangements and providing solar lights.</p> <p style="text-align: justify;">It is submitted here that the project proponent obtained EC from the MoEF&amp;CC on 09/09/2020. No comment on validity of EC has been mentioned in the EC letter, but as per the provisions of EIA notification dated 14.09.2006, the EC was to be granted for 5 years. Later on the said period was extended to 7 years. Thus the EC obtained by the PP has been expired.</p> <p style="text-align: justify;">In light of above, may if approved, scn for refusal of consent to operate be issued to the project proponent after affording an opportunity of personal hearing.</p> <p style="text-align: justify;"><strong>Competency- worthy Chairman</strong></p>
