File Note: <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-language: PA;">It is submitted that earlier, the project proponent has applied for obtaining the consent to establish (NOC) from pollution angle under the Water Act, 1974 &amp; the Air Act, 1981 for development of residential colony in an area of 13.34 acres for developing 282 no. of residential plots in the revenue estate of Fazilka. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-language: PA;">Fr</span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">om the perusal of the documents submitted alongwith the application, it has been observed that:- </span></p> <p class="MsoListParagraph" style="margin-left: .25in; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The project proponent has failed to submit the copy of change of land use (CLU) issued by the DTP/Local Body alongwith the application. </span></p> <p class="MsoListParagraph" style="margin-left: .25in; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The project proponent has proposed STP of capacity 460 KLD, however no proposal submitted for utilization/disposal of treated wastewater. The visiting officer has reported that there is no sewage connection/MC sewer line at the proposed site of the colony for disposal of treated wastewater. </span></p> <p class="MsoListParagraph" style="margin-left: .25in; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The project proponent has not submitted proposal regarding management of the solid waste to be generated from the project premises in compliance to the Solid Waste Management Rules, 2016. </span></p> <p class="MsoListParagraph" style="margin-left: .25in; text-align: justify; text-indent: -.25in; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The project proponent has not submitted details regarding total built-up area to ascertain the applicability of EIA notification dated 14.09.2006. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>Accordingly, the industry was issued show cause notice before refusal of 'Consent to Establish' (NOC) under the provisions of Water Act, 1974 &amp; Air Act, 1981 with an opportunity of personal hearing before the Senior Environmental Engineer on 04.01.2024. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>During hearing, the Partner of the project submitted that the CLU &amp; layout plan has been obtained from the Competent Authority and the same shall be submitted within 02 days. He further submitted that the colony is having land area under parks for disposal of the treated domestic effluent and also the MC has given permission for disposal of the effluent into MC sewer. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>After hearing the Partner of the project as well as the officer of the Board, it has been decided that:- </span></p> <p class="MsoListParagraph" style="margin-left: .25in; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The project proponent shall submit a copy of the approved layout plan from the Competent Authority alongwith copy of Change of land use (CLU) to the Regional Office, Faridkot of the Board, within 03 days. </span></p> <p class="MsoListParagraph" style="margin-left: .25in; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The project proponent shall obtain the permission from the Municipal Council (MC) regarding disposal of treated effluent into MC sewer and shall also obtain the detail from the MC regarding the capacity of the terminal STP, quantum of treated effluent of the colony permitted for disposal into MC sewer and distance of the sewerline from the colony or shall provide adequate alternate arrangements for disposal of treated domestic effluent. The said permission obtained from MC shall be submitted to the Regional Office, Faridkot of the Board, within 03 days. </span></p> <p class="MsoListParagraph" style="margin-left: .25in; text-align: justify; text-indent: -.25in; mso-list: l2 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">Environmental Engineer, Regional Office, Faridkot shall process the application applied by the project proponent for obtaining 'consent to establish' (NOC) of the Board under the Water Act, 1974 &amp; Air Act, 1981, on merits immediately after 03 days. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>But, the project proponent has failed to submit any compliance w.r.t. the decisions of the personal hearing dated 04.01.2024. Therefore &lsquo;consent to establish&rsquo; (NOC) application applied by the industry under the provisions of the Water <span style="mso-spacerun: yes;">&nbsp;</span><span style="mso-spacerun: yes;">&nbsp;</span>Act, 1974 &amp; Air <span style="mso-spacerun: yes;">&nbsp;</span>Act, 1981 was refused vide no. CTE/Fresh/FZL/2024/24348336 dated 09.01.2024.</span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>Now, </span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-language: PA;">the project proponent has again applied for obtaining the consent to establish (NOC) from pollution angle under the Water Act, 1974 &amp; the Air Act, 1981 for construction of the commercial project for development of residential colony in an area of 13.34 acres for developing 282 no. of residential plots under orange category. In response of hearing decision, the project proponent has following documents:- </span></p> <p class="MsoNormalCxSpMiddle" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol; mso-bidi-language: PA;"><span style="mso-list: Ignore;">&middot;<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-language: PA;">The project proponent has submitted copy of </span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">Change of land use (CLU) to M/s Prestige Developers through Rakesh Kumar, Fazilka issued by the Local Govt. Punjab vide his office letter Memo No. PB/CLU/FKA/FAZIL/2223 dated 30-08-2022, as per which the site falls in Residential as per Master Plan Fazilka (2007-2021).</span></p> <p class="MsoNormalCxSpMiddle" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol; mso-bidi-language: PA;"><span style="mso-list: Ignore;">&middot;<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-language: PA;">The project proponent has submitted letter issued by EO, MC, Fazilka vide his office letter no. 1558 dated 03.11.2023, which states that approval is given for connection of water supply and sewerage with the subject cited colony and MC further vide his office letter no. 23 dated 09.01.2024 informed that STP of capacity 13 MLD based on SBR technology is working condition. But, there has been no clear cut mention regarding disposal of treated effluent into MC sewer. Further it has not mentioned regarding the capacity of the terminal STP, quantum of treated effluent of the colony permitted for disposal into MC sewer and distance of the sewerline from the colony or alternate arrangements for disposal of treated domestic effluent. </span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">Accordingly, a clarification was raised to submit <span style="mso-spacerun: yes;">&nbsp;</span>proper compliance of decision no. 2 of the hearing decision dated 04.01.2024, but the project proponent has failed to submit any reply so far.</span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-language: PA;">As such the industry has failed to comply with the hearing decisions taken by the SEE of the Board on</span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"> 04.01.2024.</span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-language: PA;">Keeping in view of above, it is recommended that the consent to establish (NOC) may be refused and further action under the provisions of the Water Act, 1974 and the Air Act, 1981 may be taken against the project proponent, please.</span></p> <p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">&nbsp;</span></p>
