Subject:               Proceedings of the personal hearing given to M/s Rainbow Denim Limited, Vill. Chaundheri, PO Dappar, Lalru, Tehsil Dera Bassi, Distt. SAS Nagar for refusal of renewal of consent to operate granted under the Water Act, 1974 and the Air Act, 1981 before the Chairman of the Board on 25/1/2024 The following were present: From Board's side: Er. Sunny Garg, Director The officers of the Board brought out that the  industry is a large-scale Red Category unit and was earlier granted consent to operate under Water (Prevention & control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2017/5007510 dated 14/3/2017 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2017/5016036 dated 14/3/2017, valid upto 31/3/2022 for manufacturing of Denim Fabric @ 40,000 Meter/day, Cotton Yarn @ 34 Metric Tonnes/Day by using Indigo Blue @ 250 Kgs/day, Sodium Hydro Sulphite @ 200 Kgs/day, Caustic Soda @ 650 Kgs/day, Ladiquest (Water Softner) @ 15 Kgs/day, Leonil EHC (Wetting Agent) @ 15 Kgs/day, Green Acid (For neutralization of fabric) @ 300 Kgs/day, Exsilk Dye (Cationic Softner for yarn softening) @ 90 Kgs/day, Cotton @ 38 Metric Tonnes/Dayas raw material with subject to suitable conditions mentioned therein. As per record of Regional Office, SAS Nagar and document submitted by the industry, the unit is not in operation since 11/5/2019 and has filed for insolvency in the NCLT. The industry has now applied for obtaining renewal of consent to operate under Water (Prevention & control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents.<a name="_heading=h.gjdgxs"></a> However, as per the Sale certificate dated 21/9/2023 submitted by the industry, the industry has been purchased @ Rs. 48.47 Cr. As such, the CA certificate submitted by the industry is not in order. The industry was visited by officer of the Board on 22/12/2023 and it was observed as under: 1)           The industry was in operation during the visit and is currently only carrying out spinning of cotton. The polluting process of the industry was under renovation. 2)           The dyeing machinery installed by the industry was under renovation. 3)           The industry has installed an ETP having capacity 750 KLD based on physico chemical followed by biological based ETP for the treatment of the wastewater, however, the same was under renovation during the visit. Further, legacy sludge generated from the cleaning of ETP was found disposed off in the plantation area near the ETP. 4)           The industry was issued direction u/s 33-A of the Water (Prevention and Control of Pollution) Act, 1974  vide Board's letter no. 1089 dated 22/2/2019 to install OCEMS and connect the same to the CPCB server by 31/7/2019. However, the industry has not installed OCEMS till date. 5)           The industry has developed plantation in an area of about 18-20 acres for utilization of the treated trade effluent as per Karnal Technology. But, the area is full of wild growth and needs cleaning. 6)           The STP provided for treatment of domestic effluent is currently under renovation and the domestic effluent being generated from the project is collected in the collection tank of the STP. 7)           The industry was not discharging any effluent (treated or untreated) into Jharmal Choe. 8)           The industry has installed another rice husk fired boiler of capacity 12 TPH. The industry has also installed one thermopack of capacity 15 lac kcal/hr. During visit, only boiler of capacity 12 TPH was in operation. The industry has provided multi cyclone as APCD to contain the concentration of the particulate matter within the standards prescribed by the Board. The boiler and thermopack is attached to a common stack. However, the stack was found broken from many places. It is evident that the industry is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 as well as has failed to comply with the conditions imposed in the consent to operate earlier granted to it under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, willfully causing pollution in the vicinity, thus violating the provisions of the said Acts, intentionally and deliberately. It was proposed to refuse the renewal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause-cum-personal hearing.  Therefore, the industry was served show cause notice for renewal of consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide Board’s letter no. 10377-78 dated 19/1/2024 before the Chairman of the Board on 25/1/2024. Sh. Sunny Garg, Director of the industry attended the hearing and submitted written reply, which was taken on record. He informed during hearing that at present only dry process i.e. spinning will be carried out in its premises. He assured that without upgradation of ETP, plantation area and without obtaining prior written permission from the Board, the dyeing process shall not be carried out in its premises. He requested for grant of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for the operations of the industry for dry process i.e. spinning only.   After hearing the officers of the Board and the representative of the industry, the Chairman of the Board decided as under: 1)            The consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 shall be granted to the industry for dry process only i.e. spinning, upto 31/12/2024 subject to suitable conditions.   2)            The industry shall not carry out any wet process within its premises i.e. dyeing without upgradation of existing ETP based on ZLD technology, without installation of OCEMS, plantation area  and without obtaining prior permission from the Board under any circumstances. 3)            Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall visit the industry as per protocol and thereafter, send the report alongwith recommendations. If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.
