<p style="text-align: justify;"> It is intimated that the project proponent has earelier applied for consent to establish (NOC) under the Water Act 1974 & Air Act 1981 for the establishment of colony as per application form. The application was examined and observed that as under:-</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->As per proposal submitted by the Project Proponent, total area under Plotting is 38,680 Sq Mtrs. Considering Max. Permissible value of FAR as per Building By Laws of 2.1, the total built up area against plotting will comes out to be 38,680x2.1 = 81,227 Sq mtrs, which is more than 20,000 Sq mts. And thus, it may attract the provisions of EIA Notification 2006.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2. <!--[endif]-->The project proponent has submitted an open ended agreement with Smt. Rajwant Kaur for 15 Kanal 11 Marla. No time frame or lease amount or any other clause has been mentioned therein, which will ensure the longevity of this agreement. This is not a registered lease deed and has no legal sanity and can be dissolved even next day. Moreover, Board prefers longer period arrangements like availability of own land of project proponent or long term registered lease deeds for disposal/ utilization of treated effluents because short term and unregister deeds may lead to disposal problems upon its expiry/ dishonour. </p>
<p style="text-align: justify;"><!-- [if !supportLists]-->3. <!--[endif]-->No lease deed with Smt. Dalbir Kaur W/o Sh. Avtar Singh, Village Sheikhupur Sttar, Distt. Fatiabad, Hariana for land 25 Kanal 11 Marla is found uploaded in the documents attached with application under the head “Waste Water Agreements“</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->4. <!--[endif]-->Moreover, the site of the project is at Khurampur, Teh. Nakodar, Distt Jalandhar whereas, above land of Smt. Dalbir Kaur is stated to be at Village Sheikhupur Sttar, Distt. Fatiabad, Hariana.</p>
<p style="text-align: justify;"> During hearing, the representative of project submitted written reply stating that they require 10-15 days for required documentation and information in response to the show cause and requested to return the application. They requested that they will reapply with complete documentation after 15-days.</p>
<p style="text-align: justify;"> After hearing the officer of the Board, representative of the project proponent and considering facts on record, the Senior Environmental Engineer decided that:-</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->The present application for consent to establish (NOC) applied by the project proponent be returned considering their request.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2. <!--[endif]-->The project proponent shall apply for consent to establish (NOC) under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 with complete documents within 15-days and shall not start any construction activity till they obtain mandatory clearances under environmental laws.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->3. <!--[endif]-->The Regional Office-2, Jalandhar shall process the application on merit as and when received.</p>
<p style="text-align: justify;">Now, the industry has applied for fresh consent to operate under the consent to establish (NOC) under the Water Act 1974 & Air Act 1981. The detail report of Regional Office be perused. </p>
<p style="text-align: justify;"> May if approved, the consent to establish (NOC) under the Water Act 1974 & Air Act 1981 may be granted to project proponent for one year with suitalble conditons and with special conditions mentioned by Regional Office-2, Jalandhar.</p>
