<p style="text-align: justify;">Sub: Proceedings of the personal hearing before Senior Environmental Engineer, Zonal Office-2, Ludhiana on 22.01.2024 Show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 - M/s Swastik Electroplating B-42, PH-6, Focal Point, Ludhiana,. </p>

<p style="text-align: justify;"> Environmental Engineer, Zonal Office-2, Ludhiana brought out that the industry is a small-scale red category unit and the industry has applied for fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 through OCMMS.</p>
<p style="text-align: justify;"> The industry was visited by officer of the Board on 06.01.2024 and it was observed that:</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->The industry was in operation during visit and is engaged in zinc electroplating process.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2. <!--[endif]-->The industry has made an agreement with M/s JBR Technology Pvt. Ltd., Phase-8, Focal Point, Ludhiana for lifting of trade effluent @ 4000 ltr/month dated 18.12.2023. The industry has also submitted balance capacity available with the CETP operator in the agreement.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->3. <!--[endif]-->The water meter provided by the industry was found damaged during the visit.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->4. <!--[endif]-->The industry has failed to show the record regarding the total fresh water consumption viz-a-viz effluent lifted.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->5. <!--[endif]-->The collection tank of the industry of 2000 ltr was lying full during visit and industry has not provided adequate storage tank for storage of trade effluent to be lifted by CETP operator.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->6. <!--[endif]-->The industry has not provided red sand stone beneath the polluting process area and housekeeping of the industry was observed to be poor.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->7. <!--[endif]-->The industry has submitted MSME certificate as a proof of date of commissioning i.e. 24.09.2022.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->8. <!--[endif]-->The industry has submitted an approved building plan from Competent Person approved by Director of Factories.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->9. <!--[endif]-->The industry is located in designated industrial zone i.e. focal point, Phase6 as per Master Plan Ludhiana.</p>
<p style="text-align: justify;"> The industry is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974.</p>
<p style="text-align: justify;"> Sh. Balwinder Garg, Authorized of the industry attended the hearing and submit a written reply which was taken on record. He stated that they have installed a new water meter for process area. Effluent has also lifted by the CETP on next day of visit by the Board's Officer. They have also provide the red stone beneath the polluting area.</p>
<p style="text-align: justify;"> After hearing, officer of Board and Senior Environmental Engineer of the Board decided that:</p>
<p style="text-align: justify;">1. <span lang="EN-US">Environmental Engineer, Regional Office-4, Ludhiana shall visit the industry to verify the contentions of the industry and process the consent application on merits.</span></p>

<p style="text-align: justify;"> Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.</p>
