It is submitted that the industry has applied for obtaining Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, under Green Category through OCMMS with required documents for production of SHAWLS & STOLES @ 1000 Nos/Day using YARN @ 0.25 MTD as raw material.
Detail of the case are as under:-
1. The industry has CA certificate dated 28.12.2023 which it is gross value of fixed assets of Rs. 9.30 Crore as on 15.11.2023. Accordingly, it has deposited Rs. 54,000/- vide UTR/Ref. No. N356232797330804 dated 22/12/2023 as consent fee under Water Act, 1974, Rs. 129600/- vide UTR No. N356232797328419 dated 22/12/2023 as penalty under Water Act, 1974, Rs. 10000/- vide UTR No. N356232797323590 dated 22/12/2023 as NOC regularization fee, Rs. 129600/- vide UTR No. N356232797335156 dated 22/12/2023 as penalty under Air Act, 1981, Rs. 54000/- vide UTR No. N356232797341478 dated 22/12/2023 as consent fee under Air Act, 1981, Rs. 10000/- vide UTR No. N356232797341478 dated 22/12/2023 as NOC regularization fee, Rs. 500/- vide UTR No. N356232797354920 dated 22/12/2023 as application form fee, which it is adequate upto 31.12.2034 under both Acts considering VDS scheme of the Board.
2. The industry has submitted manufacturing process which its reproduced as under:-
Yarn – Warping – Weaving – Final Product.
3. The industry has submitted Change of Land use (CLU) of site measuring of 1.28 acre at village H.B No. 280, Tehsil & Distt Amritsar vide no. 1602 dated 26.10.2015 issued from Senior Town Planner, Amritsar, Department of Town and Country Planning, Punjab
4. The industry has submitted building plan approved by competent person of Director of Factory Act, 1948.
5. The industry has submitted a copy of electricity bill as proof of date of commissioning.
The industry was visited by officer of this office on 30.01.2024 and it was observed as under: -
1. The industry was in operation and was engaged in process of weaving and embroidery of woolen shawls.
2. The industry has installed weaving machines and embroidery machines in its premises.
3. As observed during visit the industry has also installed 03 no. commercial washing machines for washing of its final product for purpose of producing samples to the customers. The representative informed that some time they wash some sample products occasionally to produce before the customers and not wash the products regularly.
4. However, as observed during visit the industry was discharging small quantity of colored water being generated from the washing into internal sewer which leads to the collection tank provided by the industry. The representative informed that they discharge collected untreated water onto unknown areas through tankers.
5. The industry has also installed an ETP plant and same was not in operational condition.
6. The industry has installed 02 no. D.G. Sets of capacity which were provided with canopies but inadequate stack height.
The industry was violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of the above, it is therefore recommended that the consent to operate under the provisions of Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be refused due to the violations observed during visit. |
