It is submitted that the project proponent has obtained consent to operate vide nos. CTOW/Fresh/FZL/2024/24582244 and CTOA/Fresh/FZL/2024/24582239 dated 23.01.2024, valid upto 31.12.2028 each, under green category for operation of new RMC plant for production of Ready Mix Concrete (in Cubic) @ 320 MTD by using Aggregate Stone, Sand & Cement @ 640 MTD as raw material, subject to certain conditions mentioned therein.
Now, the project proponent has applied for obtaining consent to establish (NOC) for expansion for establishment of hot mix plant in the above premises. Details of the case are as under:-
1. The project proponent has submitted copy of Land Use Classification report issued by DTP, Fazilka vide no. 872 DTP(FZK)/IND-1 dated 03.11.2023 for setting up of Hot Mix, Concrete Batch Mix & Wet-Mix Plants at village Dangar Khera, Hadbast No. 131, Tehsil Abohar, District Fazilka on temporary basis for construction of four laning MHAI Road project from Abohar to Fazilka on HAM Mode in the state of Punjab under Bharatmala Pariyojana, which is reproduced as under:-
"ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਤੇ ਹਵਾਲੇ ਤਹਿਤ ਦਸਤਾਵੇਜ਼ਾਂ ਸਮੇਤ ਪ੍ਰਾਪਤ ਆਪ ਜੀ ਦੀ ਪ੍ਰਤੀਬੇਨਤੀ ਅਨੁਸਾਰ ਵਿਸ਼ੇ ਤਹਿਤ ਸਾਈਟ ਪਿੰਡ ਡੰਗਰ ਖੇੜਾ, ਤਹਿਸੀਲ ਅਬੋਹਰ, ਜ਼ਿਲਾ-ਫਾਜਿਲਕਾ ਦੇ ਖਸਰਾ 105//24/2/2(0-18), 25/2/2(2-16), 106//1(7-12), 10(7-12), 11(7-12), 18(8-0), 19(8-0), 20/2(7-8), 21(7-12), 22(8-0), 23/1(4-0), 23/2/1(3-12), 121//1(7-12), 2/1(2-14), 3/1(1-12),3/2(6-0), 8/2(7-12), 122//5/1(0-15) ਕੁੱਲ 99 ਕਨਾਲ 07 ਮਰਲੇ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। ਵਿਸ਼ੇ ਤਹਿਤ ਸਾਈਟ ਪਿੰਡ ਡੰਗਰ ਖੇੜਾ, ਤਹਿਸੀਲ-ਅਬੋਹਰ, ਜ਼ਿਲਾ-ਫਾਜਿਲਕਾ ਵਿਖੇ ਫਾਜ਼ਿਲਕਾ-ਅਬੋਹਰ (ਐਨ.ਐਚ-07) ਸੜਕ ਤੇ ਡੰਗਰ ਖੇੜਾ ਵੱਲ ਜਾਣ ਵਾਲੀ ਸੜਕ ਤੋਂ ਲਗਭਗ 263 ਮੀਟਰ ਅੱਬੇ ਅਬੋਹਰ ਵੱਲ ਜਾਂਦੇ ਖੱਬੇ ਹੱਥ ਪੈਂਦੀ ਹੈ। ਕੇਸ ਨਾਲ ਨੱਥੀ ਦਸਤਾਵੇਜਾਂ ਅਨੁਸਾਰ ਆਪ ਵੱਲੋਂ ਸਮਾਂ 31/12/2028 ਲਈ ਉਕਤ ਰਕਬੇ ਵਿੱਚ ਆਰਜੀ ਤੌਰ ਤੇ Hot Mix, Concrete Batch Mix & Wet-Mix Plants ਸਥਾਪਤ ਕਰਨ ਦੀ ਤਜਵੀਜ਼ ਹੈ। ਮੌਕੇ ਅਨੁਸਾਰ ਆਪ ਦੀ ਸਾਈਟ ਖਾਲੀ ਹੈ। ਕਿਉਂਜੋ ਇਹ ਇਕਾਈ ਆਰਜੀ ਹੈ ਇਸ ਲਈ ਸੀ.ਐਲ.ਯੂ/ਬਿਲਡਿੰਗ ਪਲੈਨ ਦੀ ਪ੍ਰਵਾਨਗੀ ਦੀ ਜ਼ਰੂਰਤ ਨਹੀਂ ਹੈ। ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਅਬੋਹਰ ਮਾਸਟਰ ਪਲੈਨ 2009-2031 ਦੀ ਹਦੂਦ ਅੰਦਰ ਪੈਂਦੀ ਹੈ। ਮਾਸਟਰ ਪਲੈਨ ਅਬੋਹਰ (2009-2031) ਅਨੁਸਾਰ ਇਸ ਸਾਈਟ ਖੇਤੀਬਾੜੀ ਲੈਂਡਯੂਜ਼ ਜ਼ੌਨ ਵਿੱਚ ਪੈਂਦੀ ਹੈ। Unified Zoning Regularization 2018 ਦੇ Annexure-A ਦੇ ਲੜੀ ਨੰ. C-28 ਅਨੁਸਾਰ ਖੇਤੀਬਾੜੀ ਅਧੀਨ ਰਕਬੇ ਵਿੱਚ ਹੋਟ ਮਿਕਸ ਪਲਾਂਟ ਸਥਾਪਤ ਕਰਨਾ ਆਗਿਆਯੋਗ ਹੈ, ਬਸ਼ਰਤੇ ਕਿ ਆਪ ਦੀ ਸਾਈਟ ਵਿਭਾਗੀ ਹਦਾਇਤਾਂ ਦੀ ਪਾਲਣਾ ਕਰਦੀ ਹੋਵੇ। ਆਪ ਵੱਲੋਂ ਪੇਸ਼ ਕੀਤੇ ਦਸਤਾਵੇਜ਼ਾਂ ਅਨੁਸਾਰ ਅਤੇ Lease Dead ਵਿਚ ਦਰਜ ਮਿਤੀ 31/12/2028 ਤਕ ਐਨ.ਓ.ਸੀ. ਇਸ ਸ਼ਰਤ ਤੇ ਜਾਰੀ ਕੀਤਾ ਜਾਂਦਾ ਹੈ।
1. ਵਿਸ਼ੇ ਤਹਿਤ ਸਾਈਟ ਲਈ ਐਨ.ਓ.ਸੀ. Lease Dead ਵਿਚ ਦਰਜ ਮਿਤੀ 31/12/2028 ਤੱਕ ਕੇਵਲ ਟੈਪਰੇਰੀ ਐਕਟੀਵਿਟੀ ਚਲਾਉਣ ਲਈ ਹੈ, ਉਸ ਉਪਰੰਤ ਇਹ ਐਨ.ਓ.ਸੀ. ਬਿਨਾ ਕਿਸੇ ਨੋਟਿਸ ਰੱਦ ਸਮਝੀ ਜਾਵੇਗੀ।
2. ਜੇਕਰ ਆਪ ਮਿਥੇ ਸਮੇਂ ਤੋਂ ਬਾਅਦ ਹਾਟ ਮਿਕਸ ਪਲਾਂਟ ਨੂੰ ਪੱਕੇ ਤੌਰ ਤੇ ਚਲਦਾ ਰੱਖਣਾ ਚਾਹੁੰਦੇ ਹੋ ਤਾਂ ਸਰਕਾਰ ਦੀਆਂ ਹਦਾਇਤਾਂ ਅਨੁਸਾਰ ਇਸਦਾ ਸੀ.ਐਲ.ਯੂ./ਬਿਲਡਿੰਗ ਪਲੈਨ ਸਮਰੱਥ ਅਧਿਕਾਰੀ ਤੋਂ ਪ੍ਰਵਾਨ ਕਰਵਾਉਣ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ।
3. ਜੇਕਰ ਈ.ਡੀ.ਸੀ., ਲਾਇਸੰਸ ਫੀਸ, ਸੀ.ਐਲ.ਯੂ., ਐਸ.ਆਈ.ਐਫ. ਦੀ ਫੀਸ ਅਤੇ ਕੋਈ ਹੋਰ ਚਾਰਜਿਜ ਜੋ ਮਕਾਨ ਉਸਾਰੀ ਅਤੇ ਸ਼ਹਿਰੀ ਵਿਕਾਸ ਵਿਭਾਗ ਦੁਆਰਾ ਸਮੇਂ-ਸਮੇਂ ਸਿਰ ਲਗਾਏ ਜਾਂਦੇ ਹਨ, ਨੂੰ ਭਰਨ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ।
4. ਆਪ ਪੰਜਾਬ ਪ੍ਰਦੂਸ਼ਣ ਕੰਟਰੋਲ ਬੋਰਡ ਤੋਂ ਪੂਰਵ ਪ੍ਰਵਾਨਗੀ ਪ੍ਰਾਪਤ ਕਰੋਗੇ ਅਤੇ ਜੇਕਰ ਕਿਸੇ ਹੋਰ ਐਕਟ/ਰੂਲਾਂ ਤਹਿਤ ਕਿਸੇ ਹੋਰ ਵਿਭਾਗ ਦੀ ਜਰੂਰਤ ਹੋਈ ਤਾਂ ਆਪਣੇ ਪੱਧਰ ਤੇ ਪ੍ਰਾਪਤ ਕਰੋਗੇ।
5. ਆਪ ਇਸ ਦਫਤਰ ਵਿਖੇ ਪੇਸ਼ ਕੀਤੇ ਸਵੈ ਘੋਸ਼ਣਾ ਪੱਤਰ ਦੀਆਂ ਸ਼ਰਤਾਂ ਨੂੰ ਮੰਨਣ ਦੇ ਪਾਬੰਦ ਹੋਵੇਗੇ।
6. ਸਾਈਟ ਦੀ ਮਾਲਕੀ ਸਾਂਝੇ ਖਾਤੇ ਵਿੱਚੋ ਹੈ। ਇਸ ਸਬੰਧੀ ਭਵਿੱਖ ਵਿੱਚ ਜੇਕਰ ਰੈਵੀਨਿਊ ਸਬੰਧੀ ਕੋਈ ਲਿਟੀਗੇਸ਼ਨ ਹੁੰਦੀ ਹੈ ਤਾਂ ਇਸ ਦਫਤਰ ਦੀ ਕੋਈ ਜਿੰਮੇਵਾਰੀ ਨਹੀਂ ਹੋਵੇਗੀ, ਇਸਦੀ ਨਿਰੋਲ ਜਿੰਮੇਵਾਰੀ ਆਪਦੀ ਹੋਵੇਗੀ।
7. ਸਾਈਟ ਵਿੱਚੋਂ ਜੇਕਰ ਕੋਈ ਖਾਲ/ਰਸਤਾ ਲੰਘਦਾ ਹੈ ਤਾਂ ਆਪ ਬਿਨਾਂ ਕਿਸੇ ਰੋਕ-ਟੋਕ ਦੇ ਨਿਰਵਿਘਨ ਚਲਦਾ ਰੱਖਣ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ।
8. ਸਾਈਟ ਦੇ ਅੱਗੇ ਰਕਬਾ NHAI ਵੱਲੋਂ ਐਕਵਾਇਰ ਕੀਤਾ ਗਿਆ ਹੈ, ਇਸ ਤੇ ਕਿਸੇ ਕਿਸਮ ਦੀ ਉਸਾਰੀ ਨਹੀਂ ਕਰੋਗੇ।
9. ਸਾਈਟ ਵਿੱਚੋ ਜੇਕਰ ਬਿਜਲੀ ਦੀ ਤਾਰ ਗੁਜਰਦੀ ਹੈ ਤਾਂ ਹੇਠਾਂ ਸਰਕਾਰ ਦੀਆਂ ਹਦਾਇਤਾਂ ਅਨੁਸਾਰ ਆਪ (Including Both Side of Center Line) ਨੋ-ਕੰਨਸਟ੍ਰਕਸ਼ਨ ਜ਼ੋਨ ਛੱਡਣ ਦੇ ਪਾਬੰਦ ਹੋਵੇਗਾ।
10. ਆਪ ਮਾਸਟਰ ਪਲੈਨ ਅਬੋਹਰ (2009-2031) ਦੀਆਂ ਸ਼ਰਤਾਂ/ਬੰਦਸ਼ਾਂ ਨੂੰ ਮੰਨਣ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ।
11. ਸਰਕਾਰ ਵੱਲੋਂ ਜਾਰੀ ਨੋਟੀਫਿਕੇਸ਼ਨ ਨੰ. 13/41/2021-6492/2684 ਮਿਤੀ. 19.10.2021 ਅਨੁਸਾਰ ਆਪ ਇੰਡਸਟਰੀ ਦੀ ਸਥਾਪਨਾ ਲਈ ਸਮਰੱਥ ਅਧਿਕਾਰੀ ਡਾਇਰੈਕਟਰ ਆਫ ਫੈਕਟਰੀਜ਼, ਪੰਜਾਬ ਤੋਂ ਐਨ.ਓ.ਸੀ./ਪ੍ਰਵਾਨਗੀ ਲੈਣ ਦੇ ਪਾਬੰਦ ਹੋਵੋਗੇ।
12. ਜੇਕਰ ਭਵਿੱਖ ਵਿੱਚ ਆਪ ਵੱਲੋਂ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜ਼ ਗਲਤ ਪਾਏ ਜਾਂਦੇ ਹਨ ਤਾਂ ਜਾਰੀ ਕੀਤਾ ਗਿਆ ਪੱਤਰ ਬਿਨਾਂ ਕਿਸੇ ਅਗਾਊਂ ਨੋਟਿਸ ਰੱਦ ਸਮਝਿਆ ਜਾਵੇਗਾ।"
2. The project proponent has submitted letter of Sub Divisional Magistrate, Abohar bearing no. 2739 dated 26.09.2023, has issued report of siting guidelines w.r.t. distance from the various points for the land area 99k-7m bearing khasra nos. 105//24/2/2(0-18), 25/2/2(2-16), 106//1(7-12), 10(7-12), 11(7-12), 18(8-0), 19(8-0), 20/2(7-8), 21/2(7-12), 22(8-0), 23/1(4-0), 23/2/1(3-12), 121//1(7-12), 2/1(2-14), 3/1(1-12),3/2(6-0), 8/2(7-12), 122//5/1(0-15) of village Dangar Khera, Tehsil Abohar, District Fazilka. As per which, the project proponent has proposed to establish HMP in khasra no. 121//8, which is reproduced in tabular form as under:-

3. The project proponent has submitted feasibility report, the industry has proposed to install cyclone separator followed by bag filter house as an air pollution control device with the hot mix plant.
4. The project proponent has deposited Rs. 8400/- vide Receipt No. 749657172 dated 14.01.2024 as NOC Fee against the proposed project cost of Rs. 146.90 lacs, which is adequate for one year.
5. The project proponent has submitted copy of Jamabandi for the land area 99k-7m bearing khasra nos. 105//24/2/2(0-18), 25/2/2(2-16), 106//1(7-12), 10(7-12), 11(7-12), 18(8-0), 19(8-0), 20/2(7-8), 21/2(7-12), 22(8-0), 23/1(4-0), 23/2/1(3-12), 121//1(7-12), 2/1(2-14), 3/1(1-12),3/2(6-0), 8/2(7-12), 122//5/1(0-15) of village Dangar Khera, Tehsil Abohar, District Fazilka.
6. The project proponent has submitted copy of Memorandum and Article of Association of BMR Builders Pvt. Ltd. which is incorporated under the Companies Act, 1956 on dated 22.08.2000 stating that Sh. Darshan Kumar Garg S/o Sh. Jagan Nath and Sh. Rajinder Singh S/o Sh. Bhagwan Singh, both resident of Bathinda have joined as Director of the said company.
7. The project proponent has submitted authorization letter, which states that Mr. Sanket Garg, Director of the company be and hereby authorize to sign all the documents on behalf of our company "DMR BUILDERS PRIVATE LIMITED" and to do all such acts, deeds, and things.
8. The project proponent has submitted copy aks chajra and site plan of the complete site.
To check compliance, the site was visited by undersigned on 27.01.2024 alongwith representative of the company (Sh. Bhim Sain Garg) and it was observed that the site of hot mix plant i.e. khasra no. 121//8 is located within 200 meter of National Highway (189 meter from Fazilka-Abohar highway) and within 500 meter of Lal Lakir/ Phirni of nearest village namely Dangar Khera. Screenshots of the distances measured from the site of establishment of hot mix plant (i.e. khasra no. 121//8) are attached herewith wherein the distance of site is approx. 472 meter from the lal lakeer/phirni of village Dangar Khera. Further, the distances of nearest National Highway and nearest village lal lakeer/phirni were measured from various points of khasra no. 121//8 to locate the stack of proposed hot mix plant so as to simultaneously meet the siting criteria of distances of National Highway and village lal lakeer/phirni. However no point in khasra no. 121//8 simultaneously satisfied the both distances as per siting criteria from National Highway and lal lakeer/phirni.
As such, the site of hot mix plant is not meeting the specific siting criteria dated 26.04.1999 of hot mix plants, i.e. the site of hot mix plant is located within 200 m radius of National Highway and the site lies within 500 m radius of the nearest village lal lakeer/phirni (village Dangar khera).
In view of above, NOC of the project proponent may be refused, please.
