Sub: Proceedings of the personal hearing given before Chief Environmental Engineer, Ludhiana w.r.t u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 alongwith show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 on 23.01.2024 - M/s Styllia Garments, Tajpur Road, Near Central Jail, Kakka Road, Ludhiana.

Environmental Engineer, Zonal Office-2, Ludhiana brought out that the industry is a red category dyeing unit and was earlier granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDH3/2023/21547439 dated 28.04.2023 for Dyeing of Knitted Fabric & Polyester Fabric @ 5400 Kg/day with disposal of trade effluent @ 98.5 KLD and domestic effluent @ 1.5 KLD into CETP, which were expired on 27.10.2023. Further, the directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 were issued to the PSPCL authorities to restore the electric connection of the unit temporarily upto 27.10.2023 vide Board’s letter no. 1897 dated 28.04.2023.
Now, the industry has applied for renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 for Dyeing of Knitted Fabric & Polyester Fabric @ 5400 Kg/day with disposal of trade effluent @ 98.5 KLD and domestic effluent @ 1.5 KLD into CETP.
The case was examined and it was observed that the industry has submitted certificate from Company Secretaries, contents of the certificate are as under:

From above, it is observed that the industry has not got all the shares DEMAT. However, the industry has applied for obtaining consent to operate for discharge of trade effluent @ 98.5 KLD and domestic effluent @ 1.5 KLD into CETP.
The industry is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974.
Notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 alongwith show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 was issued to the industry with an opportunity of personal hearing before Chief Environmental Engineer, Ludhiana on 29.01.2024.
Sh. Amandeep Malhotra, Partner of the industry attended the hearing. He submitted a request to the effect that the PDA has allotted shares of 42.5 KL to the industry. However, the shares of 57.5 KL are yet to be DEMAT for which PDA will hold a meeting which may take another 15-20 days. He therefore requested to grant 15 days' time to the industry so that the remaining shares can be got DEMAT.
After hearing the partner of the industry and officers of the Board, the Chief Environmental Engineer of the Board decided as under:
1. The industry shall submit the appropriate document w.r.t DEMAT of shares, within 15 days.
2. The application of the industry for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 shall be decided after receipt of reply from the industry.
3. The Environmental Engineer, Regional Office-3, Ludhiana shall process the consent application of the industry accordingly after 15 days.
4. The industry shall be afforded another opportunity of personal hearing u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as well as for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 immediately after 15 days.
