Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 30.01.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 - M/s En. En. Engineering works, E-89, Phase 4, Focal Point, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was granted consent to operate under the Water Act, 1974 and Air Act, 1981 both valid upto 30/09/2022 for the manufacturing of Sewing Machine Body @ 50 Nos./day and Sewing Machine Parts @ 50 Kgs/day.
The industry has now applied for obtaining renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry was visited by officer of the Board on 03.01.2024 and it was observed as under:
1. The industry was in operation during visit and engaged in manufacturing of Sewing Machine body & Sewing Machine parts.
2. The industry has installed 1 no. electric paint booth with inbuilt water curtain as APCD.
3. It has stored paint sludge @ 60 Kg in hazardous waste storage room, but not disposed off to TSDF Nimbuan till date.
4. The industry has installed one DG set of capacity 62 KVA with canopy & inadequate stack height.
5. The industry has stored 12-15 paint drums in its hazardous waste room however it has not disposed the same till date.
6. The industry has not applied for obtaining authorization under Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 as there is generation of hazardous waste of category 5.1, 21.1 and 33.1.
In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 30.01.2024.
Sh. Naresh Kumar Bansal, Partner of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the industry is engaged in manufacturing of Sewing Machine body & Sewing Machine parts. The industry submitted that they have lifted all paint sludge to TSDF Nimbuan and enclosed manifest form. The stack height with D.G set has been increased as per requirements. They have agreement with M/s Lucky Steels all stored paint drums will be disposed off as soon as possible. They have obtained authorization under Hazardous & Other Wastes Rules, 2016 through Auto renewal system. They further requested to grant consents of the Board.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall provide stack of adequate height with D.G set as per norms of the Board.
2. The industry shall store hazardous waste of all categories in scientific manner and get it lifted to authorized agencies regularly.
3. The industry shall comply with the conditions of the authorization granted under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016.
4. The Environmental Engineer, Regional Office shall verify submission made by industry and send further recommendations in the matter.
