Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 30.01.2024 w.r.t. show cause notice for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 - M/s Rishav Exports, Ganpati Enclave, 1st and 2nd Floor, Focal Point Tibba, Village Dharour, P.O. Sahnewal, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is Small Scale / Red category unit and is an engaged in the process of manufacturing Garments with printing process.
The industry has been established without obtaining NOC of the Board. Now, the industry has applied for fresh consent to operate under the Water Act, 1974 & the Air Act, 1981.
The consent applications of the industry were scrutinized and following discrepancies were found:-
1. The industry has not submitted the Dimensional Drawing of ETP viz-a-viz completion certificate of ETP from the competent person/firm.
2. The industry has not submitted the analysis report of treated effluent from Boards Lab.
3. The industry has not submitted the dimensional drawing of Septic tank provided for treatment of domestic effluent.
4. The industry has not marked the plantation area to dispose of the treated trade effluent and treated domestic effluent.
5. The industry has not attached the copy of registry of land on the basis of which CLU has been obtained.
6. The industry has not applied for obtaining authorization of the Board under the Hazardous and other Wastes Management and Transboundary Rules, 2016.
7. The industry has been commissioned without obtaining NOC of the Board. Hence, the industry is required to submit the compliance report of NOC conditions if industry has obtained the NOC of the Board to establish the industry.
8. It has made the arrangements to re-use the treated trade effluent for Washing of Screens and the reading of water meter provided in this area was not visible.
9. It has not provided the Sub energy meter with its ETP and water meter with its submersible pump.
10. The industry could not produce the record of water consumption, re-use in screen washing area and operation of ETP.
11. It has not provided the dedicated Hazardous Waste Storage room. Hazardous waste generated from the ETP was being stored after packing in non HDPE Bags in shed near the ETP.
12. It has provided the 2 D.G. Sets of 500 KVA and 250 KVA with inadequate stack height.
13. The adequacy of consent fee cannot be adjudged, as the industry has failed to submit the exact date of commissioning of the industry as conveyed through clarification dated 05.01.2024
In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 30.01.2024.
Sh. Rishi Kapoor, Partner of the industry attended the hearing and submitted written reply which has been taken on record. The industry submitted drawings/Layout of ETP, UF along with completion certificate as desired. He attached details related to Septic Tank & record, copy of registry along with CLU. The factory layout along with green area which is being used for the disposal of treated Domestic effluent & trade effluent if extra after its reuse for screen washing. The industry has submitted request for agreement to Ramkay for ETP sludge, Lucky steel for Plastic Cans & Varun lubricant Co for Waste Oil. They will apply for authorization to the Board, in next 7-10 days. They have cleaned the glass of water meter & the reading is clear for reading. Industry has also installed ETP with UF for waste water treatment. The energy meter at ETP and water meter is now installed. The stack of D.G sets is now raised by 3m as desired. The generated sludge is dried & packed in HDPE bags & is being stored in the room dedicated for hazardous waste. The industry when commissioned it was a hosiery unit without printing which was under exempted category as we know later after 2021 we installed screen printing (Copy of Bill is attached) which is a date of commissioning as proof. Industry has also deposited Consent & NOC fee as per CA certificate. He requested to collect the trade effluent samples & will pay all relevant charges to the board
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall operate its ETP & APCD regularly and efficiently so as to achieve the prescribed standards of the Board.
2. The industry shall maintain record of fresh water consumption, effluent treated and electricity consumed in treatment of waste water on regular basis.
3. The industry shall develop adequate plantation area to utilize treated effluent after ETP, as per karnal technology.
4. The industry shall apply for obtaining authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016, within 07 days.
5. The Environmental Engineer, Regional office shall visit the industry to verify the submission made by industry and submit report / recommendations in the matter.
