Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 30.01.2024 w.r.t. show cause notice for refusal of 'Consent to Establish' (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 - M/s New Star Auto comp, Khasra no. 50//21/1/2, 50//22/1/2, 50//23/1/2, Budhewal Sugar Mill Road, Budhewal, Ludhiana.

No one attended the hearing
The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the project proponent has proposed to setup an industrial unit for manufacturing of Washers @ 0.4 MTD, Bolts @ 4.2 MTD and Nuts @ 3.6 MTD and has applied for obtaining consent to establish (NOC) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The project report of the industry has been perused and the industry has proposed following manufacturing processes:-
1. Wheel Nut -
Round bar - Forging - Machining- Tapping - Heat treatment
2. High Tensile Washer -
Round bar - Forging shop - Cutting - Forging - Normalizing - Heat treatment - Hardening - Tempering
And whereas, on perusal of report of RO, the following observations has been made:
1. Plantation area has not been mentioned for discharge of domestic effluent.
2. Details of number of forging furnaces and pollution control measures is not given.
In view of above, the industry was issued show cause notice for refusal of 'Consent to Establish' (NOC) under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 30.01.2024.
No one from industry attended the hearing but submitted written reply which has been taken on record. The industry submitted that they have applied for NOC of the Board for manufacturing of Washers, Bolts and Nuts. They have provided green belt within the factory alongwith boundary wall to discharge treated domestic effluent. They have proposed to install all electric equipment's i.e. electric forging as well as electric heat treatment process. Presently, industry will install electric furnaces as per project report and no APCD is required.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. 'Consent to Establish' (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be granted to industry with following special conditions:-
a) The industry shall made proper arrangement for discharge of domestic effluent onto land for plantation.
b) The industry shall provide adequate pollution control arrangements.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
