It is intimated that this project is a school having around 1200 students and staff members. Earlier, the school was operating without NOC/consent of the Board. Therefore, the project proponent was given personal hearing before the SEE, Zonal Office-II, Patiala on 16.10.2023. Wherein it was decided as under:-
1. The school shall submit a bank guarantee amounting to Rs. 5.0 lakh as an assurance to comply with the environmental laws within 7 days.
2. The school shall apply for consents under the Water Act, 1974 and the Air Act, 1981 and authorization under Hazardous & Other Wastes (Management & Transboundary Movement) Rules, 2016 within 7 days.
3. Environmental Engineer, RO, SGR shall visit the school to verify the contentions made during the hearing, collect the effluent sample from the outlet of the STP and to process the applications to be applied by the school immediately after 10 days.
In compliance to the decision of the personal hearing, the school has deposited bank guarantee amounting to Rs. 5 lakh vide BG no. LOBG211712309541 dated 30.10.2023 valid upto 25.10.2025 in favor of Environmental Engineer, Punjab Pollution Control Board, Vatavaran Bhawan, Nabha Road, Patiala.
Now, the school has applied for obtaining consent to operate without obtaining NOC under the Water Act, 1974 and the Air Act, 1981 under small scale orange category for the capacity of Students and Staff Members @ 1200 Numbers and for the disposal of domestic effluent @ 43.2 KLD onto land for plantation after treated in STP.
The school has also deposited consent fee of Rs. 3,78,000/- vide no. HDFCR52023121462286411 dated 14.12.2023 under the Water Act, 1974 and Rs. 3,78,000/- vide no. HDFCR52023121462292388 dated 14.12.2023 under the Air Act, 1981 and Rs. 5,000/- vide no. N348232784998347 dated 14.12.2023 under VDS scheme against the total value of fixed assets of Rs. 536.97 lacs as per CA certificate dated 19.10.2023. The fee deposited by the school is adequate upto 31.12.2038 (after deducting penalty fee (Rs. 10,000/- under each act) and fee is taken from 2018 as per VDS scheme) under the both Acts.
The institute has also deposited Rs. 18,000/- vide no. N348232784984602 dated 14.12.2023 as NOC fee.
The institute has submitted site plan and building plan which are duly approved by competent authorities.
The institute has obtained DTP certificate vide no. 707 DTP(S)-130 dated 10.07.2019 as per which the site of institution falls in revenue estate of Village Handiaya bearing Khasra no. 269//9/2/(7-18), 297//5/2/(4-9), 6(5-6) measuring in total land 25 Kanal 9 Marle. The institute is running from 2004. The site does not falls in limit of any Municipal Committee. Site falls in the Notified Local Planning Area, Barnala. The institution is running prior to 21.01.2005 (date of enforcement of PUDA Building Rules in Punjab) and 17.08.2007 (effective date of EDC, LF/PF and CLU charges in Punjab) so it does not need change of land use. Thereafter, the institute has proposed to construct new block in an area of 43242 sqr feet. The institute got permission for the same from Department of Town and Village Planning, Punjab with usual conditions.
To verify the facts, the school was visited by the officers of this office on 30.01.2024 and it was observed as under:-
i. The school is situated at Barnala-Bathinda Road, Handiaya, Barnala.
ii. As per the detail submitted by the school, it uses 54 KLD ground water for domestic use and generates 43.2 KLD domestic effluent which is discharged onto land for plantation after passing through STP of capacity 50 KLD. It has also submitted completion certificate of STP.
iii. The STP installed by the school is based on MBBR followed by tertiary treatment. The effluent after treatment is being discharged onto land for plantation/lawns provided by the school. The school is day scholar. During visit no stagnation was found in the plantation area. The plantation area is adequate as compare to the effluent generation from the school.
iv. The STP was found in operation during visit and treated effluent was being discharged onto land for plantation and effluent sample of the same were collected during visit and has been sent to the Head Office Lab, Patiala for analysis. The results for the same are awaited.
v. The school is lifting its municipal solid waste through MC, Barnala and has provided the compost pit for the hotti culture waste.
vi. The school has installed a D.G set of capacity 125 KVA equipped with canopy.
vii. There is one existing air polluting industry namely M/s Krishna Metal within 100 mtr of the school building. Between the school and industry there is one open plot and one road of around 22 ft. wide. The plantation has been provided in the vacant plot boundary and inside the school boundary. In such cases, there is need to develop 15 mtr wide green belt buffer zone towards air polluting unit as school is established after the establishment of the existing industry.
No complaint is pending against the school.
In view of above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the school in light of the analysis report to be received from the Zonal Lab, for one year with suitable conditions and special condition that:-
1. The school will develop the green belt buffer zone of 15 mtr wide towards the existing air polluting industry.
