• It is intimated that the project proponent is a small scale orange category residential project covered under category 2091 i.e. Area/Infrastructure Development Project (Not covered under EIA notification 2006).
• Earlier, the project proponent was granted Consent to Establish' (NOC) under the Water (Prevention and Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/JAL2/2023/20664639 dated 21.02.2023 valid upto 20.02.2024 for establishment of Residential Plots @ 80 Nos/day, Commercial Plots @ 21 Nos/day, School @ 1 no/day and discharge of domestic effluent @ 60 KLD Onto green area & green buffer and duel plumbing to be provided within the project with suitable conditions mentioned therein.
• Now, the project proponent has applied for ‘Consent to Establish' (NOC) Expansion for establishment of Residential Plots @ 86 Nos/day, Commercial Plots @ 21 Nos/day, School @ 1 no/day and discharge of domestic effluent @ 50 KLD onto land for plantation inside and outside the project 0.43 acre land available. 06 number of residential plots have been added in the existing land
• The project proponent has obtained the CLU Certificate vide its Memo No. CA-JDA-CLU-2022/8412 dated 03.11.2022 for an area of 12.70125 acres as propose site. The project is not covered under EIA 2006 as total area is less than 50 hectares. Also, total built up area will be 56054 square meter which is less than 1,50,000 square meter.
• The proposed site was visited by officer of this office on 25.01.2024 and it was observed that the project proponent has demarcated the boundary wall of the proposed project at site. No MAH industry/cement plant/ grinding unit/ rice sheller/ saila plant/ stone crushing/ screening cum washing unit/ hot mix plant/ brick kiln within a radius of 500 m from the boundary of the proposed site of the project. No air polluting industry located within 100 m of the site. Therefore, the site of the project is conforming to the sitting guidelines laid down by the Govt. of Punjab, Department of Science Technology and Environment vide order dated 25/07/2008 as amended on 30/10/2009. However, a cold storage i.e. M/s Manali Cold Store is situated along one of the boundary of the project. As per the proposed plan submitted by the project proponent it has provided buffer zone of 15 m of green area towards the cold storage.
• As per the revised site plan submitted by the project proponent, it shall have 86 residential plots, 21 commercial plot and 1 school. As per the brief project report the occupancy/population has been estimated to be 430 persons (assuming 5 person/plot). Accordingly, the total fresh water consumption has been estimated to be 58 KL (135 lpcd) and the domestic effluent generation shall be around 46.4 KLD.
• The project proponent has also uploaded feasibility report of the proposed STP to be installed at site. As per feasibility report the treatment capacity of the proposed STP will be 75 KLD, which will be based on MBBR technology which is principally adequate. The project proponent has proposed to dispose off its treated effluent partially onto land reserved for green area and green buffer at site approx. i.e. 6210.754 sq. mtr (1.53 acres). The project proponent shall also provide treated water connection to all plot owners for reuse of treated water on green area to be provided within the plots and dual flushing. The treated waste water shall be utilized within the project only. Further, the PP has obtained land adjoining to the site measuring 0.43 acres on which excess water shall be used for irrigation of platation under Karnal Technology.
• The project shall generate solid waste @ 240 kg/day which will be segregated into recyclable, Biodegradable and inert waste. A mechanical composter for the treatment of biodegradable shall be installed. Recyclable waste shall be sold to recyclers. Non-Bio-degradable waste will be disposed off as per the Solid Waste Management Rules, 2016. The biodegradable component is will be composited and utilized at the site and the non-biodegradable is will be disposed off to authorized recycler.
Keeping in view of above, it is recommended that consent to establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the colony for one year with suitable conditions and with special conditions that:-
1. The project proponent shall comply with the various terms and conditions of the CLU granted to it.
2. The project proponent shall use the treated effluent for onto land for plantation within its premises and shall partially use it for flushing purpose by adopting dual plumbing provision in its project.
3. The project proponent shall utilized maximum treated water within the project only and excess effluent, if any, shall be discharged into MC sewer.
4. The project proponent shall obtain necessary permission from Municipal Corporation, Jalandhar for disposing of treated sewage into MC sewer and submit the same to the Board within one month.
5. The promoter company shall ensure that the total built up area of all individual projects/plots combined together is not more than 1,50,000 sqm, otherwise the project as such is covered under category 8(b) of the schedule appended to the EIA notification and project proponent of the area development project is required to obtain the environmental clearance, failing which, the promoter company shall be liable for action for the violation of EIA notification dated14/09/2006.
6. The promoter company shall ensure that the total built up area of construction being carried out by it or any different builders may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification and project proponent of the building and construction project is required to obtain prior environmental clearance, failing which, the promoter company/builder shall be liable for action for the violation of EIA notification dated14/09/2006.
7. The project proponent shall obtain permission from the PWRDA for the abstraction of ground water.
8. The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month.
9. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis.
10. The project proponent shall ensure segregation of solid waste at source, facilitate collection of segregated waste in separate streams, handover recyclable material to either the authorized waste pickers or the authorized recyclers as prescribed in Solid Waste Management Rules, 2016. The bio-degradable waste shall be processed, treated and disposed of through composting by providing mechanical composter of capacity 150 kg/day.
11. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
12. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project
13. The promoter company shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
