File Note: Commercial Project by MAYA BUILDERS: It is submitted that the application filed by the unit as well as the report submitted by RO was perused in detail and the following submissions has been given by RO w.r.t. the application of the project proponent: • Earlier, the project proponent was granted consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2021/16023090 dated 09.08.2021 valid till 04.02.2022 for construction of Commercial (Showrooms) in an area of 0.816 acres (Total area 3301.909 Sq.mtr and built-up area as 10,010.98 Sq.mtr) & disposal of Domestic Effluent @ 53 KLD as “24 KLD will be used for flushing purpose, 1 KLD will be used onto land for plantation and remaining 28 KLD into sewer”, subject to certain conditions as mentioned therein. • Thereafter, the project proponent was granted extension in consent to establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Ext/SAS/2022/18094262 dated 22.07.2022, valid till 04.02.2023 for same terms, subject to certain conditions as mentioned therein. • Later, the project proponent was granted extension in consent to establish (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Ext/SAS/2023/20808242 dated 29.05.2023, valid till 31.01.2024 with change in terms of disposal of Domestic Effluent @ 53 KLD i.e. “24 KLD will be used for flushing purpose, and remaining 29 KLD used for plantation area as per karnal technology in an area of 0.5 acres bearing khasra no 473”, subject to certain conditions as mentioned therein. • Now, the project proponent has applied for obtaining fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation of Commercial (Showrooms) in an area of 0.816 acres (Total area 3301.909 Sq.mtr and built-up area as 10,010.98 Sq.mtr) along with requisite documents and consent fee. • The project proponent has proposed that total water requirement of the project 68 KLD out of which 44 KLD of fresh water will be met through borewell and 24 KLD is used for flushing purpose. 53 KLD of waste water generated will be treated in STP of 75 KLD capacity. 24 KLD of treated wastewater will be flushing purpose and remaining 29 KLD used for plantation area as per karnal technology in an area of 0.5 acres bearing khasra no 473. • The project proponent has submitted CA Certificate with the value of fixed assets of Rs. 25.12 crore. The project proponent has deposited Rs. 1,80,000/- vide R. No. 267472844 dated 04.01.2024 under Water Act, 1974 and Rs. 1,80,000/- vide R. No. 52017843 dated 05.01.2024 under Air Act, 1981. The consent fee under Water Act, 1974 and Air Act, 1981, which are adequate upto 30.09.2028. • The project proponent has submitted letter of Regional Deputy Director-cum-Competent Authority vide no. CLU/DDLG/PTL/2019/25711 dated 18.10.2019 regarding Change of Land Use for Commercial purpose to M/s Maya Builders, SCO No. 14, 15, 16 & 17, Near Nabha Sahib Gurudwara, Zirakpur-Patiala Highway, Zirakpur, Distt. SAS Nagar at Village Chatt (H.B. No. 286), District SAS Nagar (3949.045 sq.yd.) subject to suitable conditions mentioned therein. • The project proponent has submitted partnership deed executed on dated 16.12.2017 between Sh. Amit Mittal S/o Sh. Ved Parkash Mittal R/o House No. 80, Sector-21, Panchkula, (Hereinafter called the Party of FIRST PART), Sh. Vivek Sawal S/o Sh. Tilak Raj Sawal R/o House No. 378, Sector-46-A, Chandigarh, (Hereinafter called the Party of SECOND PART) and Sh. Neeraj Mittal S/o Sh. Subhash Chand Mittal R/o House No. 8, Sector-8, Panchkula, (Hereinafter called the Party of THIRD PART). • The site was visited by the officer of the Regional Office on 23.01.2024 and during visit, it was observed as under: 1. The project proponent has completed the civil construction work for the commercial project. 2. The project proponent has opened its sales office in the commercial tower and few shops are also in operation. 3. The project proponent has installed STP of capacity 75 KLD based on MBBR technology for treatment of domestic effluent to be generated from the project. 4. The fresh water requirement of the project is met through submersible; the total fresh water requirement of the project is 68 KLD. The total sewage generation from the project is 53 KLD. 5. The project proponent is using treated water for dual plumbing after passing through UF Membrene and the rest is being utilized for land developed as per Karnal Technology in 0.5 acres. The project proponent has developed 0.5 acres of area adjoining to the project site as per Karnal Technology. 6. The project proponent has installed 2 nos. DG sets of capacity 350 KVA each, which is equipped with canopies & adequate stack height. 7. The project proponent has submitted approved site plan issued by MC Zirakpur. 8. The project proponent has submitted compliance report of the Consent to Establish under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 granted to it. • The RO has recommended that the Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the project proponent upto 30.09.2028, subject to suitable conditions and additional conditions as mentioned in their note. In consideration of the report/ recommendations sent by RO; if approved, the Consent to Operate under the provisions of the Water Act, 1974 and the Air Act, 1981 for occupancy & operation of Commercial (Showrooms) in an area of 0.816 acres (Total area 3301.909 Sq.mtr and built-up area as 10,010.98 Sq.mtr), be granted to the project proponent upto 30.09.2028, subject to suitable conditions and the following additional conditions that: CONDITIONS PROPOSED UNDER WATER ACT, 1974: 1. This consent is valid for operation & occupancy of of Commercial (Showrooms) in an area of 0.816 acres (Total area 3301.909 Sq.mtr and built-up area as 10,010.98 Sq.mtr) with wastewater generation limited to 53 KLD. 2. The domestic effluent generated from the project shall be treated in the STP installed within premises as proposed by it. 3. The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose @ 24 KLD and the remaining treated effluent @ 29 KLD shall be utilized onto the plantation area as per karnal technology developed in an area of 0.5 acres bearing khasra no 473, in accordance with the proposal submitted by it. 4. The project proponent will obtain necessary permission from PWRDA for abstraction of ground water immediately, if not already obtained. 5. The project proponent shall start carrying out complete water auditing of the project on daily basis, immediately, so that the quantity of freshwater consumed and treated effluent utilised for activities like dual plumbing, can be assessed. 6. The project proponent shall provide separate flow meters after STP on channels/ pipelines carrying treated effluent for reuse in dual plumbing and disposal onto plantation area. 7. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021. 8. The project proponent will comply with the provisions of MSW Rules, 2016. 9. The project proponent shall ensure at source segregation of the solid waste to be generated from its premises, at all times. 10. For biodegradable waste to be generated from the premises, the project proponent shall install mechanical organic waste composter(s) of adequate capacity. 11. The project proponent shall get the non-biodegradable solid waste disposed of at authorised site only, after obtaining permission from the Competent Authority and shall maintain proper record of disposal of the same, at all times. 12. The project proponent shall place adequate no. of storage bins in its premises, from where the municipal solid waste shall be got lifted and transported by the operator of the integrated MSW management facility as and when the facility is established and made operational. 13. The project proponent will comply with the provisions of E-waste Management Rules, 2016. 14. The project proponent shall ensure that its activities does not create any nuisance in the surrounding areas and no public complaints are received. 15. The Consent is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 16. In case the institute fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. CONDITIONS PROPOSED UNDER AIR ACT, 1981: 1. This consent is valid for operation & occupancy of of Commercial (Showrooms) in an area of 0.816 acres (Total area 3301.909 Sq.mtr and built-up area as 10,010.98 Sq.mtr) with wastewater generation limited to 53 KLD. 2. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021. 3. The project proponent shall not consume any fuel except HSD in its installed DG set (s), without obtaining prior written permission from the Board. 4. The project proponent will comply with the provisions of MSW Rules, 2016. 5. The project proponent shall ensure at source segregation of the solid waste to be generated from its premises, at all times. 6. For biodegradable waste to be generated from the premises, the project proponent shall install mechanical organic waste composter(s) of adequate capacity. 7. The project proponent shall get the non-biodegradable solid waste disposed of at authorised site only, after obtaining permission from the Competent Authority and shall maintain proper record of disposal of the same, at all times. 8. The project proponent shall place adequate no. of storage bins in its premises, from where the municipal solid waste shall be got lifted and transported by the operator of the integrated MSW management facility as and when the facility is established and made operational. 9. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 10. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disburse in the air in any form. 11. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form. 12. The project proponent will comply with the provisions of E-waste Management Rules, 2016. 13. The project proponent shall ensure that its activities does not create any nuisance in the surrounding areas and no public complaints are received. 14. The Consent is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 15. In case the institute fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
