The industry is a small-scale orange category garment washing unit and was granted consent to operate under the under the Air Act, 1981 vide no. CTOA/Renewal/LDH3/2019/10309538 dated 03.08.2019 for Garments Washing, Softening, Silicon, Bio, Enzyme & Stone wash etc. @ 6000 Nos/day for operation of one boiler of capacity 0.8 TPH with cyclone as APCD & one DG set of capacity 125 KVA capacity, which had expired on 30.09.2023.
Thereafter, the industry applied for varied consent to operate under Air Act, 1981................. Accordingly, consent to operate under Air (Prevention & Control of Pollution) Act, 1981 was refused due to non-submission of requisite documents...................
Thereafter, the industry was issued notice u/s 31-A of the Air Act, 1981 as amended in 1987 with an opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 22.11.2023 and 19.12.2023. No one from the industry attended the hearing. Thereafter Competent Authority has issued directions u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 to the PSPCL authorities vide Board's letter no. 335-36 dated 16.01.2024 for the disconnection of the electric connection of the unit...................
In compliance of above said directions, electric connection of the unit has been disconnected by the PSPCL Authorities vide TDCO no. 28/271 dated 22.01.2024...................
Now, the industry has applied for varied consent to operate under Air Act, 1981 for production of Garments Washing, Softening, Silicon, Bio, Enzyme & Stone wash etc. @ 10000 Num/day for operation of one boiler of capacity 0.8 TPH with cyclone as APCD & one DG set of capacity 125 KVA capacity...................
The industry had already deposited requisite documents and adequate consent fee which is valid upto 30.11.2028 as verified by the Regional Office...................
Regional Office reported that the industry has submitted the copy of letter issued by DTP, Ludhiana vide memo no. 667/DTP(L)/M2A dated 20.03.2018 stating that the site of the industry falls in industrial zone as per Master Plan, Ludhiana (2007-2031)...................
The industry was visited by AEE of RO on 24.01.2024 and reported as under:..................
1. The industry has installed one boiler of capacity 0.8 TPH with cyclone as APCD and having stack of adequate height. Wood was stored as fuel to be used in the boiler...................
2. The industry has also installed one DG sets of capacity 125 KVA with canopy and adequate height...................
It is pertinent to mention here that it was decided as under in the e-noting no. 21071130:..................
“The consents being presently given to the member units conditionally to settle the share issue, may be given for at least one year with the condition that in case of any variation of shares at the time of final settlement with PDA / approval by the Board, the industry concern is bound to follow the production / effluent discharge from their unit accordingly and obtain revised consents with modified figures of production and effluent discharge as per the final share allotment.”..................
Further, it is pertinent to mention here that it was decided as under in the e-noting no. 19582356 (copy attached herewith):..................
“It shall be ensured that no further CTE/CTO for any new/expansion of dyeing units shall be given without the permission from Head office.”..................
Thus, the competency to decide the case falls with Worthy Chairman of the Board...................
As proposed by Regional Office, may if approved:..................
1. Varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for Garments Washing, Softening, Silicon, Bio, Enzyme & Stone wash etc. @ 10000 Num/day with operation of one boiler of capacity 0.8 TPH with cyclone as APCD and one DG set of capacity 125 KVA for the period of six months with usual terms & conditions and special condition that the industry shall get its stack emission samples analyzed from Board's lab, within one month...................
2. Directions u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 may be issued to restore the electric connection of the industry temporarily for the period of further six months...................
