Grand Carnival by RGI Infra:
It is submitted that the application filed by the unit as well as the report submitted by RO was perused in detail and the following submissions has been given by RO w.r.t. the application of the project proponent:
• The project proponent has applied for obtaining consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for establishment of commercial project namely “Grand Carvinal” located at Block-H, Aero City, District SAS Nagar, Punjab for total land area 24,296.82 (6 acres) having built up area of 92411.305 sqm alongwith requisite documents.
• The project proponent was granted Environment Clearance vide SEIAA letter No. EC23B000PB154773 dated 08.02.2023 under EIA Notification dated 14.09.2006 for establishment of commercial project namely “Grand Carnival” located at Block-H, Aero City, District SAS Nagar, Punjab for total land area 24,296.82 (6 acres) having built up area of 93,014.047 sqm.
• The project proponent has submitted feasibility report regarding installation of STP of capacity 175 KLD based on MBBR Technology. As per feasibility report, the total water requirement of the project is 177 KLD. The total wastewater generated from the project will be 142 KLD which will be treated in proposed STP of 175 KLD capacity.
In summer season, 109 KLD will be used for flushing purpose, 2 KLD will be used for green area (327.225 sq.m.) and remaining 28 KLD will be discharged into GMADA sewer.
In winter season, 109 KLD will be used for flushing purpose, 0.5 KLD will be used for green area (327.225 sq.m.) and remaining 29.5 KLD will be discharged into GMADA sewer.
In Monsoon season, 109 KLD will be used for flushing purpose, 0.1 KLD will be used for green area (327.225 sq.m.) and remaining 29.9 KLD will be discharged into GMADA sewer.
• With regard to discharge of treated effluent into GMADA sewer, the project proponent has submitted a copy of letter issued by Greater Mohali Area Development Authority vide memo no. EO/2022/13830 dated 04.07.2022 regarding allotment of commercial site, block-H measuring 24296.82 square meter at Aerocity, SAS Nagar wherein some of the conditions mentioned as under:
“X The allottee will be provided separate connections for fresh water for drinking and potable uses and tertiary treated waste water for flushing and gardening purpose. Therefore, allottee will have to have dual plumbing system along with separate storages for both types of water in its building. It may be noted that occupation certificate shall be issued only after it is certified by the J.E. (Building) that this provision has been made by the allottee (This provision is made in the scheme as per the orders of the State Level Environment Impact Assessment Authority, Punjab and Ministry of Environment and Forests, Government of India conveyed vide their letter no. 38523 dated 27-09-2011 and conditions issued there under.)
XI Since, there is a provision for supplying tertiary treated waste water for flushing, gardening and non potable uses, the allottee shall use only this water for construction of the building, once it is available with GMADA.
XII GMADA has made arrangements for providing separate connections for rainwater disposal. Therefore, rainwater and floor washing water should not be disposed off on road directly. The allottee will have to make necessary arrangements accordingly.
OTHER GENERAL CONDITIONS:-
X GMADA shall provide domestic water connection and the tertiary treated effluent to the allottee for use in flushing & gardening purpose. The allottee shall ensure the installation of Dual piping system in the apartments for this purpose subject to inspection by JE before issuance of Occupation Certificate.
IX The allottee shall be entitled for the Sewer & Storm water connection in the main Sewer & Storm network developed by GMADA.”
• The project proponent has submitted layout plan of the project approved by Chief Administrator, GMADA, which had been technically approved by Member BPSC-cum-Senior Town Planner, SAS Nagar vide no. 1223 STP(SAS)/SB-8(G) dated 03/10/2023, having total land area of 6 acres and built-up area of 92411.305 sqm.
With regard to same, the project proponent has applied for amendment in EC for change in built-up area of the project from 93,014.047 sqm to 92411.305 sqm. In this regard, the project proponent has submitted proceedings of the 272nd meeting of SEAC held on 08.01.2024 wherein it has been mentioned that the SEAC had decided to forward the application to SEIAA with the recommendation to grant amendment in earlier EC granted vide letter No. EC23B000PB154773
dated 8.02.2023 for change in built-up area of the project from 93,014.047 sqm to 92411.305 sqm.
• The site of the project was visited by the officer of Regional Office on 18.01.2024 and observed as under:
1. The project site is located at Block H, Aero City, District SAS Nagar.
2. The project proponent has already started construction of basement.
3. The project proponent has not provided any labour huts at the proposed site.
4. The project proponent has proposed to install STP of capacity 175 KLD.
5. The project proponent has proposed to install mechanical composter for the treatment of wet biodegradable solid waste.
6. As per the boundary limits of the site shown by the representative of the promoter company during the visit, there is no approved existing operational MAH industry within a radius of 250 m from the boundary of the proposed site of the project. There is no approved existing operational air polluting industry within a radius of 100 m from the boundary of the project.
7. The site of the project is conforming to the sitting guidelines laid down by the Govt. of Punjab, Department of Science Technology and Environment vide order dated 25/07/2008 as amended on 30/10/2009.
• The project proponent has deposited Rs. 630500/- vide R. No. 314522211 dated 11.01.2024 as NOC fee and the RO has calculated that the said fee deposited by the project proponent is adequate for two years against the total proposed cost of the project of Rs. 44621 lacs. However, the RO has reported that the project proponent has already started the construction activity at site and no proof regarding date of commencement of construction has been attached with the application. Therefore, it is safe to assume that the project proponent has started its construction activity after the approval of the building/ site layout plan from the GMADA i.e. after 03/10/2023. Accordingly, the ‘Consent to Establish’ fees deposited is adequate upto 02/10/2025.
• The RO has recommended for grant of ‘Consent to Establish’ to the project for one-year subject to suitable conditions and additional conditions as mentioned in their note.
In consideration of the report/ recommendations sent by RO; if approved, the ‘Consent to Establish’ under the provisions of the Water Act, 1974 & the Air Act, 1981 for establishment of Commercial project in the total land area of 24,296.82 sqm (6 acres) having built up area 92411.305 sqm at Block H, Aero City, Mohali, Distt. SAS Nagar, Punjab, be granted to the project proponent for two years i.e. upto 02/10/2025, subject to suitable conditions and the following additional conditions:
1. This Consent to Establish has been granted for establishment of Commercial project in the total land area of 24,296.82 sqm (6 acres) having built up area 92411.305 sqm at Block H, Aero City, Mohali, Distt. SAS Nagar, Punjab, only.
2. The project proponent shall ensure holistic compliance of the terms & conditions of the Environment Clearance granted by SEIAA, Punjab vide no. SEIAA/PB/MIS/2022/EC/34 dated 08.02.2023.
3. The project proponent shall submit copy the amendement in Environmental Clearance for change in built-up area of the project from 93,014.047 sqm to 92411.305 sqm, within 03 months to the Board and ensure compliance of any additional terms & conditions if imposed by the competent authority.
4. The project proponent shall develop its project strictly in accordance with the layout plan approved by the GMADA authorities vide no. 1223 STP(SAS)/SB-8(G) dated 03/10/2023.
5. In case, there is any change in the layout plan submitted by the Project Proponent at any stage or otherwise, then the project proponent shall apply to the Board for revised CTE before starting any construction/development activity at the site.
6. In case, there is any change in components of the project such as total area, built-up area, water consumption, wastewater generation, solid waste generation etc. if at any stage, then the project proponent shall obtain revised fresh ‘Consent to Establish’ from the Board as well as Environment Clearance, for the said change.
7. The project proponent shall comply with the conditions mentioned in the allotment letter issued by the GMADA vide memo no. EO/2022/3830 dated 04.07.2022. Further, the project proponent shall comply with the various term and conditions of the Master Plan of the area.
8. The project proponent shall restrict its water consumption, waste water generation and abide by the treatment proposal for wastewater and solid waste, as per the proposal given by it.
9. The promoter company shall install STP of capacity 175 KLD based on latest technology.
10. The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose @ 109 KLD and and shall develop green area in an area of 327.225 sqm for utilization of treated effluent @ 2 KLD – 0.5 KLD – 0.1 KLD during the Summer-Winter-Monsoon seasons for discharge of the treated effluent after STP and only the remaining treated effluent shall be allowed for discharged in GMADA sewer after grant of due permission/ approval from the GMADA authorities regarding the same. In case, the permission for discharge of effluent into the sewer line and/ or its disposal to the terminal STP of the concerned authority is denied or not allowed by the concerned authority/ respective department at any stage; then this ‘Consent to Establish’ (NOC) from pollution angle shall be deemed cancelled and the Board shall not be responsible for any financial liability arising due to cancellation of this CTE (NOC). In such case, the project proponent shall apply for fresh ‘Consent to Establish’ (NOC) from pollution angle alongwith concrete proof for alternate modes of disposal of treated effluent like availability of adequate land for utilizing treated effluents for plantation or to adopt other environmentally sound effluent disposal arrangements.
8. The project proponent shall not allow occupancy in its project till Sewer Connection and Occupancy Certificate have been issued by the GMADA authorities.
9. The promoter shall also not allow any occupancy in the project till the time adequate arrangements for effluent treatment & disposal, solid waste handling & disposal are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained.
10. The project proponent will develop the project on its own risk & cost in regard to disposal arrangement. The project proponent shall be entirely responsible for the arrangement of additional land required for the disposal of treated domestic effluent, if any.
11. The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
12. The project proponent shall obtain permission from the PWRDA for the abstraction of ground water, if applicable.
13. The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month.
14. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis.
15. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity.
16. The promoter company shall explore the possibility of using treated domestic effluent for useful purpose such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities etc.
17. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
18. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter of adequate capacity to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
19. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
20. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
21. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form.
22. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
23. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
24. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material.
25. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris.
26. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.
27. The project proponent shall install mechanical composter for the treatment of solid waste being a bulk waste generator.
28. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021.
29. The Punjab Pollution Control Board shall have the liberty to revoke this consent & take penal action against the industry/project proponent and its responsible/ concerned person(s), in case any information/document provided by the industry/ project proponent is found to be incorrect/false/misleading at any point of time.
30. The Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, due to grant of this Consent to Establish. |
