It is submitted that earlier the project proponent was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/PBIP/SAS/2023/2305313973 dated 03.07.2023 which was valid upto 31.12.2023 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/PBIP/SAS/2023/2305521890 dated 03.07.2023 which was valid upto 31.12.2023 for operation & occupancy of Residential Plots @ 800 nos., Booths @ 34 nos., SCOs @ 67 Nos & Club @ 1 in the part of the project within area of 156.183 acres & having max. built up area 1,40,000 sqm for which Environmental Clearance had been granted by SEIAA, Punjab vide no. SEIAA/MS/2014/1208 dated 06.02.2014 subject to certain terms and conditions mentioned therein.
Now, the project proponent has applied for renewal of consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation & occupancy of Residential Plots @ 800 nos., Booths @ 34 nos., SCOs @ 67 Nos & Club @ 1 in the part of the project within area of 156.183 acres & having max. built up area 1,40,000 sqm alongwith requisite documents.
The project proponent has deposited Rs. 7,20,500/- vide online R. no. 395410510 dated 09/05/2023 under the Water (Prevention & control of Pollution) Act, 1974, which is adequate upto 28/02/2024 and Rs. 7,20,500/- vide online UTR no. 194356771 dated 08/05/2023 under the Air (Prevention & Control of Pollution) Act, 1981. Further, as per record file, the consent fee deposited by the industry was recalculated and it is adequate upto 31.01.2026 under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The project proponent has submitted compliance report of the conditions of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as Environmental Clearance granted by the Competent Authority.
The project proponent has submitted analysis report of the effluent samples carried out by NABL approved laboratory i.e. M/s Eco Paryavaran Laboratories & Consultants Pvt. Ltd. on 15.01.2024, the conc. of the parameters were found within the permissible limits of the Board as tabulated below:

The site of the project was visited by the undersigned on 19.12.2023. During the visit, it was observed as under:
1. The project is residential plotted township.
2. The project proponent has provided to develop residential township of total plots @1397.
3. The individual plot owners have completed construction on 800 plots. Presently, 537 families are residing in the colony as confirmed by the representative of the project.
4. The project proponent has also completed 67 no SCO, 34 no. booths & 1 no. club house. The representative of the project proponent informed that about 50 no. SCO occupied and 32 booths are occupied.
5. The project proponent has set up 02 tubewell and water meter installed on both the tubewell.
6. The project proponent has installed STP of capacity @ 1500 KLD and same was found in operation. The project proponent has also connected the sewerage line to inlet tank of STP. The treated water quality was found good, as observed during visit. The project proponent has installed water meter on the outlet line. The project proponent has developed @ 2 acres land as per Karnal Technology & the project proponent has also developed 15 park & green area @ 11.68 acre in the park for the disposal of treated effluent. No stagnation was observed in and around the residential township.
7. The project proponent has installed 01 mechanical composter for the treatment of wet biodegradable solid waste.
8. The project proponent has installed 03 DG set of capacity 25 KVA, 35 KVA & 82.5 KVA, all are equipped with canopy.
9. The project proponent has constructed 08 no. Rain Water Harvesting Pits.
The project proponent is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981,
It is further submitted that the State Level Impact Assessment Authority, Punjab vide letter no. SEIAA/2023/1940 dated 09.11.2023 has issued directions under Section 5 of the Environment (Protection) Act, 1986 to the Member Secretary, Punjab Pollution Control Board, Patiala to launch prosecution under Section 15,16 read with Section 19 of the Environment (Protection)Act, 1986 against M/s TDI Infratech Limited and its responsible persons. Accordingly, this office has drafted the complaint and same has been sent to SLO of the Board for vetting. After vetting and approval from the Competent Authority, the complaint shall be filed in the Lower Court, SAS Nagar.
In view of the above, may if approved, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be renewed upto 31.03.2025 subject to suitable conditions and following additional conditions that:
1. The project proponent shall comply with the conditions of Environmental Clearance granted by the Competent Authority.
2. The project proponent shall perform / promote its Corporate Environment Responsibility (CER) activities as well as use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic.
3. The project proponent shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocol or any other non-biodegradable material in the premises.
4. The project proponent shall properly handle and manage the solid wastages as per the provisions of the Municipal Solid Waste Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.
5. The project proponent shall maintain the record of energy consumption utilized for the operation of STP.
6. The promoter shall not discharge the effluent into any drain/choe/nallah/river/inland surface water under any circumstances in any case.
7. In case the promoter fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the promoter.
