It is submitted that earlier the project proponent was granted Consent to Establish (NOC) under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2023/21035998 dated 11.04.2023 having validity upto 01.02.2025 for Residential township project in total area of29.3 acre area, consisting of 140 individualplots, 140 plots for independent floors to bedeveloped by third party) and 55 plots forCommercial SCOs as components and disposal of treated wastewater @ 189 KLD shall bereused for flushing purpose by providingdual plumbing system in the project.Remaining treated wastewater shall beutilized for irrigation in green area (2.34acre) and plantation area (2.24 acres as per Karnal Technology) with subject to suitable conditions mentioned therein.
However, as per the approved site plan and due to some objections in RERA the project proponent has applied for revised CTE from the Board. The total plot area remains the same as earlier, however no. of plots have been decreased from 280 to 279, leading to slight decrease in the pollution load of the project.
The project proponent has applied for fresh Consent to Establish (NOC) from pollution angle under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for 279 plots and 55 commercial plots, alongwith requisite documents and fees.
The project proponent has deposited fees of Rs. 1,44,000/- vide R. no. 451743198dated 11.01.2024. The fee deposited by the project proponent is adequate for three years, against the total proposed cost of the project Rs. 48.40 Cr.
The project proponent has submitted its change of land use from DTP, SAS Nagar vide Memo no. 7089 dated 18/11/2021 for developing affordable residential plotted colony in an area of 29.3 acre by M/s SS Developers at village Chapar Chiri Kalan (H.B. No. 195), Teh& Distt. SAS Nagar.
There is slight decrease of 1 KLD in the wastewater generation from the residential colony will be about 462 KLD, which will be treated through the proposed STP of capacity 500 KLD based on MBBR technology. Out of 462 KLD, the treated effluent @ 189 KLD shall be utilized for flushing purpose, 51 KLD shall be utilized for green area (i.e. 2.34 acre) and remaining 222 KLD shall be discharge onto land for plantation area developed in 15 mtr green buffer zone marked on the approved layout plan. The total area under 15 mtr of green buffer zone is about 2.24 acre, which is adequate for the disposal of domestic treated water.
As observed during visit dated 03.02.2024 site is an empty plot and the proposed site is located back side of industrial area phase-8, opposite to M/s Posh City (Residential Project). No demarcation or development of the site has been carried out.
There is no change in the proposed plot and the area remains the same. Further, as per the earlier visit dated 24.02.2023, the site is complying with prescribed siting guidelines for such projects, except CBWTF site is located at a distance of 70 m from the boundary of the project and in compliance to the same provisions have already been made in the approved site plan for 15 mtr green belt towards the CBWTF site. The site falls in residential zone as per Master Plan SAS Nagar.
In view of the above, it is recommended that revised 'Consent to Establish' (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted for 03 years, subject to suitable conditions and additional conditions that:
1. This NOC is only valid for development of Residential Township Project in total area of 29.3 acre area located in village Chappar Chiri Kalan, Distt. SAS Nagar, consisting of 279 plots, and 55 plots for Commercial plots as components, only.
2. Further, the project proponent shall ensure that no construction in the aforesaid components of the project is carried out by itself and/ or other promoter company such that the built-up area of construction exceeds 20,000 sq.m., without obtaining prior Environmental Clearance from the competent authority under the EIA notification 14.09.2006, being the responsible agency for the development of the project.
3. The project proponent shall ensure that the total built up area of construction being carried out by it or any different builders may not be greater than 20,000 sqm, otherwise the project as such is covered under category 8(a) of the schedule appended to the EIA notification 14/09/2006 and the project proponent is required to obtain environmental clearance, failing which, the promoter company shall be liable for action for violation of the EIA notification dated 14/09/2006.
4. The project proponent shall ensure that the total built up area of all individual projects/plots combined together is not more than 1,50,000 sqm, otherwise the project as such is covered under category 8(b) of the schedule appended to the EIA notification dated 14/09/2006 and the project proponent is required to obtain environmental clearance, failing which, the promoter company shall be liable for action for violation of the EIA notification dated 14/09/2006.
5. The project proponent shall maintain minimum distance from the dump site of Municipal Corporation, Mohali, in accordance with the Solid Waste Management Rules, 2016 and the 'Guidelines on The Provision Of Buffer Zone Around Waste Processing and Disposal Facilities' dated April, 2017 issued by CPCB & further amendments thereto. In case, it is proven at any stage that the project proponent is not fulfilling the minimum distance requirement from the said dump site, then it shall be liable to bound to shift its project boundary away from the site to maintain the minimum distance requirement from the dump site; and the Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, arising due to the same.
6. Further, the project proponent shall be bound to provide green belt/ buffer of 15 m width towards the boundary of the existing CBWTF facility.
7. The project proponent shall comply with the conditions of the CLU granted by the DTP, SAS Nagar vide Memo no. 7089 dated 18/11/2021, in true letter & spirit.
8. The promoter company shall install STP of at least 500 KLD capacity for the treatment of domestic effluent generated by the project premises, as proposed by it with this application.
9. The project proponent shall provide necessary arrangements for usage of the treated effluent after STP for flushing purpose and shall develop adequate green area (2.34 acre) and plantation area (2.24 acres as per Karnal Technology) for discharge of the remaining treated effluent after STP, as proposed by it.
10. The land proposed by the project proponent for development of plantation area as per Karnal technology for utilization of its treated effluent after STP shall be developed inconsonance to the development of the project and the said land pocket shall not be used for any other purpose. The project proponent shall be entirely responsible for the arrangement of additional land required for the disposal of treated domestic effluent, if any.
11. The promoter shall also not allow any occupancy in the project till the time adequate arrangements for solid waste disposal are made as well as 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 are obtained.
12. The promoter company shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate.
13. The project proponent shall obtain permission from the PWRDA for the abstraction of ground water if applicable.
14. The project proponent shall utilize treated wastewater from nearby STPs for the construction purpose and shall submit an agreement in this regard within one month.
15. The project proponent shall provide separate water meter and energy meter for the STP and maintain record of the same on daily basis.
16. The promoter shall provide a buffer zone of green belt (dense populated trees with pleasant fragrance) around the sewage treatment plant, so as to reduce the effect of odour problem in its vicinity.
17. The promoter company shall explore the possibility of using treated domestic effluent for useful purpose such as construction work, sprinkling on dusty patches/roads, use in nearby construction activities etc.
18. The project proponent shall place adequate no. of bins outside its premises from where the Municipal Solid Waste shall be got lifted.
19. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter of adequate capacity at site to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.
20. The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.
21. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016.
22. The project proponent shall take adequate steps to the effect that the construction material of any kind that is stored at site shall be fully covered in all respects so that it does not disperse in the air in any form.
23. The project proponent shall ensure that all the construction material and debris shall be carried out in trucks or other vehicles which are fully covered and protected so as to ensure that the construction debris or the construction material does not get disburse into the air or atmosphere in any form.
24. The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project.
25. The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material.
26. The project proponent shall provide mask to every worker working on the construction site and involved in loading/ unloading and carrying of construction material and construction debris.
27. The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.
28. The promoter shall develop its project strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority.
29. The promoter company shall provide adequate rain harvesting pits in its project (@ 1 recharge bore per 5000 sqm built up area) so as to achieve maximum ground water recharge.
30. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021.
31. The Punjab Pollution Control Board shall have the liberty to revoke this consent & take penal action against the industry/project proponent and its responsible/ concerned person(s), in case any information/document provided by the industry/ project proponent is found to be incorrect/false/misleading at any point of time.
32. The Punjab Pollution Control Board shall not be responsible for any financial liability and/ or any other liability of the project proponent, due to grant of this Consent to Establish.
