It is submitted that the industry will be small scale red category unit and has applied for obtaining ‘consent to establish'/ (NOC) under the Water Act, 1974 and Air Act, 1981 with requisite documents. The industry has deposited NOC fee against the project cost of Rs. 497.45 Lacs as per project report attached, which is adequate for one year as per Board's Office Order dated 29/10/2018.
The proposed site was visited by the undersigned on 01.02.2024 and it was observed as under:
1. The proposed site is a land of 2500 sq.yards having industrial shed. However, it has not installed any plant and machinery.
2. It has proposed Powder Coating of Pipe/Wiremesh/HR Sheet/Round/Wire @ 500 MTY & Electroplating/Phosphating of Sheet Metal Components/Forged Components/PLW Pipes/Nut & Bolts on Job Basis @ 9000 MTY by using raw material as Pipe/Wire-mesh/HR Sheet/Round/Wire @ 500 MTY, HCL @ 75 MTY, Sulphuric Acid @ 14 MTY, Nitric Acid @ 5 MTY, Salts & other Chemicals @ 120 MTY.
3. It has proposed to install 1 no. electric Heat Treatment Furnace of capacity 10 MTD, 2 no. Powder Coating Booths with cyclones as APCD, 5 no. Shot Blast Machines with inbuilt bag house filters and 2 no. electric Baking Ovens.
4. It has made agreement with M/s JBR Technologies Ltd., Ludhiana for disposal of its trade effluent @ 1,20,000 ltr/month.
5. Domestic effluent @ 1.6 KLD will be discharged into sewer.
6. The proposed site of the industry is located in the designated Industrial Focal Point, Ludhiana as per Master Plan of Ludhiana.
Applicability of Factories Act, 1948:
As per policy of the Board, it is clearly mentioned that the Punjab Pollution Control Board will decide the applications for consent to establish (NOC) of all industries to be set up in designated/ approved areas such as Industrial Area/ Industrial Estate / Industrial Focal Point/ Approved Industrial Park / Industrial Zone of the Master Plan. However, the Site Clearance u/s 41 (A) of the Factories Act, 1948 will not be necessary for grant of consent to establish/ operate/ authorization by the Board. It is submitted that the subject cited industry is located in Industrial zone as per Master Plan (2010-2031) of Ludhiana. Therefore, there is no requirement of Site Clearance u/s 41 (A) of the Factories Act, 1948.
Applicability of EIA notification dated 14/09/2006
Not applicable.
In the subject cited case, the industry has mentioned ground water extraction @ 6.6 KLD. Considering 25 working days per month, ground water extraction will be 165 KL/month, which is less than 300 KL/month.
In view of the above, it is recommended that the industry may be granted ‘consent to establish'/ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for one year with suitable conditions as per policy of the Board and special condition that the industry shall get its building plans approved under the provisions of section 3-A of Punjab Factory Rules, 1952.
