File Note: It is submitted that the subject cited project proponent was granted NOC by the Board vide no ZO-1/SAS Nagar/ NOC/2011/F- 231 dated 12.08.2011 having validity upto 11.08.2013 to develop a training institute named as "Venusian Chambers" at Ambala Chandigarh Road, Village Lehli, Tehsil Dera Bassi, Distt. SAS Nagar within MC limits of Lalru in an area of 4 acres. Subsequently, the validity of NOC was further extended upto 11/08/2014 with the same conditions mentioned therein. Thereafter, the validity of 'consent to establish' (NOC) was further extended upto 11/8/2015 with the same conditions as mentioned therein and with the additional condition that the promoter company shall submit the proposal regarding disposal of treated wastewater for summer, winter and rainy season. The validity of 'consent to establish' (NOC) no. ZO-I/SAS Nagar/NOC/2011/F-231 dated 12/08/2011 (Valid upto 11/08/2012) granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, and extended upto 11/08/2015 vide letter no. 5568 dated 14/10/2014, is hereby, further extended upto 10/08/2016 with the same conditions mentioned therein. Now, the promoter company has applied for obtaining "Consent to Establish"(NOC) for an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents and fee. The project proponent has deposited Rs. 23,500/- vide UTR. No. ALLAH16264264960 dated 20.09.2016, Rs. 23,500/- vide UTR. No. ALLAH16363965785 dated 28.12.2016 & Rs. 1,53,600/- vide UTR. No. CMS3802904098 dated 26.12.2023. The fee deposited by the project proponent is adequate upto 10.08.2024 against the total cost of the project Rs. 4859.0 lacs as per brief project report. The project proponent has submitted extended Bank Guarantee of Rs. 1.0 lac vide no. 0013NDDG00053524 dated 23.01.2024 which is expired on 23.01.2025 as assurance to comply with the following stipulations: a) The promoter company shall start the installation of Sewerage Treatment Plant with 15 days. b) The Promoter shall comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection Act, 1986 and/or any other environmental law applicable to him and Rules, Circular and Directions issued by the Board from time to time. c) The Promoter shall comply with the pollution control status applicable from time to time. Accordingly, the site of the project was visited on 02.02.2024 and it was observed as under: 1. The site is located at Ambala Chandigarh Road, Village Lehli, Tehsil Dera Bassi, Distt. SAS Nagar within MC limits of Lalru in an area of 4 acres. 2. The civil construction work has been completed and the completion is in progress. The representative submitted that due to COVID-19 and other financial constrains the project could not be completed. 3. The project proponent has started the construction work of STP. The civil construction work of equalization tank of STP has been completed. 4. The building plan of the site has already been approved by Nagar Panchayat Lalru. 5. The built-up area is 15,142 sqm as per approved plan submitted by the project proponent. As per the feasibility report submitted by the project proponent, the total area of the plot is 13069 sqm, out of which 3019 sqm. will be used for developing green belt and 60 % of the parking area i.e. 2030 sqm will be green area. Thus, there will be total area of 5049 sqm. green area. 6. The project will generate 45 KLD of domestic effluent which will be treated in STP to be provided within the premises. About 20 KLD of treated water will be used for dual plumbing and the rest 25 KLD will be discharged onto land for plantation to be developed in 5049 sqm, which is adequate. In view of above, it is recommended that ‘consent to establish’ (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 10.08.2024 with usual conditions & with following special conditions: 1. The project proponent shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 before commissioning of its unit. 2. The project proponent shall commission its STP within two months and ensure that the treated sewage conforms to the effluent standards prescribed by the Board / Ministry of Environment and Forests & Climate Change for such discharges. 3. The project proponent shall not discharge any effluent outside its premises, at any point of time, under any circumstances. 4. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water. 5. The project proponent shall not discharge the effluent into any drain/choe/nallah, in any case. 6. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 7. The project proponent shall recycle the entire quantity of cooling water (if any). 8. The project proponent shall develop its project strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority. 9. The project proponent shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received. 10. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 11. The project proponent shall comply with the provisions of Solid Waste Management Rules, 2016. 12. The project proponent shall comply with the provisions of Plastic Waste Management Rules, 2016. 13. The establishment shall obtain all the statuary approvals/clearances from the concerned departments. 14. The NOC is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 15. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. *Competency Chief Environmental Engineer Date of Receipt: 13.01.2024 Date of clarification: 23.01.2024 Date of Scrutiny: 05.02.2024 Date of Deemed Approval: 15.02.2024
