The industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, under Green Category for manufacturing of Heatshrinkable Moulded Components @ 5000 Numbers/Day, Heatshrinkable Tubings @ 5000 Numbers/Day, Insulators and Lightning Arresters Moulded @ @ 4000 Numbers/Day, Mastic Tapes @ 15000 Numbers/Day and Lugs Ferrules Terminals and other Metal Parts @ 2000 Numbers/Day, as products, along with requisite document.
The industry has establish its unit without obtaining Consent to establish from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The industry has deposited Rs. 15000/- vide R no. 139538470 dated 24.01.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 15000/- vide R. no. 380369819 dated 24.01.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 31.12.2027, for both the Acts against the fixed assets of Rs. 71.60 lakhs on 11.01.2023.
While processing the application, the industry was raised clarification and the reply submitted by the industry w.r.t to the said observation as under:

2. WE HAVE ALREADY TAKEN THE RIGHT TO BUSSINESS CLEARANCE FOR OUR UNIT IN WHICH WE HAVE GOT CLU, MAP APPROVAL, FIRE NOC AND ALL COMBINED APPROVALS FOR SETTING UP THE INDUSTRY. CERTIFICATE ATTAHCED.
3. WE ARE ALSO ATTACHING MAUKA REPORT FROM PATVARI WHERE IT IS MENTIONED THAT THE UNIT IS ONLY IN KHASRA NO. 40/1, FOR YOUR READY REFRENCE.
4. MOA OF INDUSTRY IS ATTACHED.”

Suitability of Site:
The industry has submitted a copy of land use classification letter issued by DTP SAS Nagar vide letter no. 1326 dated 16.08.2023, wherein it has mentioned as under:
“ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਅਧੀਨ ਹਵਾਲੇ ਤਹਿਤ ਪ੍ਰਾਪਤ ਪੱਤਰ ਦੇ ਸਬੰਧ ਵਿੱਚ ਸੂਚਿਤ ਕੀਤਾ ਜਾਂਦਾ ਹੈ ਕਿ ਪਿੰਡ ਸੈਦਪੁਰਾ (ਹ.ਬ.ਨੰ. 10), ਤਹਿਸੀਲ ਡੇਰਾਬੱਸੀ, ਜ਼ਿਲ੍ਹਾ ਐਸ.ਏ.ਐਸ ਨਗਰ ਵਿਖੇ ਪੈਦਾ ਖਸਰਾ ਨੰਬਰ 31//5(4-0) ਅਤੇ 40//1 (4-0) ਕੁੱਲ ਰਕਬਾ 8 ਬਿੱਘਾ 0 ਬਿਸਵੇ ਵਿੱਚੋ ਰਕਬਾ 1 ਬਿਘਾ 11 ਬਿਸਵੇ 12 ਬਿਸਵਾਸੀ (ਲਗਭਗ 0.329 ਏਕੜ) ਦਫਤਰੀ ਰਿਕਾਰਡ ਵਿੱਚ ਉਪਲੱਬਧ ਮਾਸਟਰ ਪਲੈਨ ਡੇਰਾਬੱਸੀ ਅਨੁਸਾਰ ਇੰਡਸਟਰੀ ਮਿਕਸਡ ਜ਼ੋਨ ਅਧਿਨ ਪੈਂਦਾ ਹੈ। ਉਕਤ ਰਕਬਾ ਐਫ.ਈ.ਜ਼ੈਡ ਜ਼ੋਨ ਅਤੇ ਐਮ. ਸੀ. ਲਿਮਟ ਡੇਰਾਬੱਸੀ ਅਧੀਨ ਪੈਦਾ ਹੈ। ਸਾਈਟ ਵਿੱਚ ਕਿਸੇ ਵੀ ਤਰ੍ਹਾਂ ਦੀ ਐਕਟੀਵਿਟੀ ਕਰਨ ਤੋਂ ਪਹਿਲਾਂ ਉਸ ਸਬੰਧੀ ਮਨਜ਼ੂਰੀ ਸਬੰਧਤ ਸਰਕਾਰੀ ਅਦਾਰਿਆਂ ਤੋਂ ਪ੍ਰਾਪਤ ਕਰਨ ਦੇ ਅਤੇ ਰਕਬੇ ਦੀ ਮਾਲਕੀ/ਕਬਜ਼ੇ ਸਬੰਧੀ ਵੱਖਰੇ ਤੌਰ ਤੇ ਮਾਲ ਵਿਭਾਗ ਪਾਸੋਂ ਤਸਦੀਕ ਕਰਵਾਉਣ ਦੇ ਆਪ ਪਾਬੰਦ ਹੋਵੇਗੇ। ਇਸ ਤੋਂ ਇਲਾਵਾ ਉਕਤ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਆਪ ਵੱਲੋ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਦਸਤਾਵੇਜ਼ਾਂ ਦੇ ਸਨਮੁੱਖ ਜਾਰੀ ਕੀਤੀ ਜਾਦੀ ਹੈ।
ਇਸ ਪੱਤਰ ਨੂੰ ਵਿਸ਼ੇ ਅਧੀਨ ਸਾਈਟ ਦਾ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਹੀ ਸਮਝਿਆ ਜਾਵੇ। ਇਸ ਲੈਂਡ ਯੂਜ਼ ਕਲਾਸੀਫਿਕੇਸ਼ਨ ਸੀ.ਐਲ.ਯੂ ਦੀ ਪ੍ਰਵਾਨਗੀ ਜਾ ਕਿਸੇ ਕਿਸਮ ਦਾ ਐਨ.ਓ.ਸੀ ਨਾ ਸਮਝਿਆ ਜਾਵੇ।”
Thus, as per the land use classification certificate, the site of the industry is located in ‘Industry Mix Zone’. Accordingly, the report of master plan of Derabassi was perused and at page no. 88 (copy attached), it has been mentioned that following activities are allowed in industry mix zone:

As the industry as applied for ‘consent to operate’ under Green Category, which is permissible in the industry mix zone. Thus, the site of the unit is suitable.
The industry has submitted a copy of registry dated 28.03.2023 executed between Sh. Shanker Lal Saini and Sh. Gurpreet Singh & Reena, for land measuring 1 bigha , 11 biswa and 12 biswasi.
The industry has submitted a copy of MoA, wherein, it has been mentioned that Sh. Madan Singh and Smt. Reena are subscribers/directors of the industry.
The industry has submitted a copy of GST registration certificated dated 12.05.2023, as a proof of date of commissioning of the unit, along with the online application form.
The industry has also submitted a copy of building plan signed by Er. Rishi Garg, Competent Person of Director of Factories of Punjab.
Visit:
Accordingly, the industry was visited by AEE of this office on 01.02.2024 and during visit, it was observed as under:
1. The industry has installed environmental data board at its entrance.
2. The industry has installed 01 no. extruder line and 05 no. injection moulding in its premises. The industry is yet to start production activity at the site.
3. The industry will be engaged in extruding and injection moulding process using polymers made of virgin plastic. The product manufactured by the industry shall be used in electrical transformers and wiring systems.
4. The industry does not generate any trade effluent from its process.
5. The industry has constructed septic tank, after passing through which domestic effluent shall be used onto land for plantation within premises.
6. The industry has not installed any boiler, furnace, paint booth, powder coating etc., or any source of air pollution in its premises.
7. The industry has installed one no. DG set of capacity 82.5 KVA on its roof, which is provided with canopy and stack of adequate height.
From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Recommendations:
In view of above, if may approved, the industry may be granted fresh ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 31.12.2027 with usual conditions & with following special conditions:
1. The industry shall not carry out any activity, which can change in category from Green to Orange or Red, under any circumstances.
2. The industry shall established its unit only in Khasra no. 40//1, for which the industry has obtained land use classification letter from the Department of Town and Country Planning vide letter no. 1326 dated 16.08.2023.
3. The industry shall comply with the by-laws of Master Plan, Derabassi as well as the guidelines of Department of Town & Country Planning, at all times.
4. The industry shall not generate and discharge any kind of trade effluent from its premises and shall discharge only domestic effluent onto land for plantation in its premises after passing through septic tank.
5. The industry shall not discharge the effluent into any drain/choe/nallah, in any case.
6. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
7. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard.
8. The project proponent shall comply with the guidelines issued by PWRDA and shall obtain permission from PWRDA for abstraction of ground water (as applicable).
9. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.
10. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
11. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
12. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
