File Note: RAP Projects: It is submitted that the application filed by the unit as well as the report submitted by RO was perused in detail and the details of the proposal/ application of the unit is as under: • The project proponent was earlier granted Consent to Establish (NOC) issued vide no. CTE/Fresh/JAL/2019/9718418 dated 09.05.2019 valid upto 08.05.2020 for the establishment of a residential apartment cum commercial complex at Vill. Pholriwal, Tehsil & District Jalandhar in an area of 4.204 acres (17015 Sq.mt.) with total built up area 81577.5 sq. mt. • The project proponent had obtained CLU from the DTP, Jalandhar vide its memo no. 453 dated 04.04.2012 for an area of 4.204 acres for commercial cum residential purpose. • The project proponent had also obtained Environment Clearance under EIA notification dated 14.09.2006 for setting up residential apartment cum commercial complex from the SEIAA vide letter no. SEIAA/MS/2014/1327 dated 06.02.2014 in total land area of 4.204 acres with total built up area of 81577.5 sqm. • As per the NOC & the EC granted to the project, it had proposed that the total waste water generation from the project will be 227 KLD, which will be treated in a STP installed within the project premises.  In summer season, the project proponent had proposed to use 120 KLD of treated wastewater for flushing purpose, 80 KLD will be used for irrigation of green area and remaining 27 KLD/day will be discharged to public sewer.  In winter season, the total wastewater generation from the project will be 182 KLD, out of which 75 KLD of treated wastewater will be used for flushing purpose, 35 KLD will be used for irrigation of green area of and remaining 72 KLD will be discharged to public sewer.  In rainy season, the total wastewater generation from the project will be 162 KLD, out of which 55 KLD of treated wastewater will be used for flushing purpose, 15 KLD will be used for irrigation of green area and remaining 92 KLD will be discharged to public sewer. • The project proponent had also obtained the NOC from the Municipal Corporation, Jalandhar vide memo no. SPL-SE/12 dated 16.09.2013 for water supply connection, collection of solid waste and disposal of its treated sewage in the main Municipal Corporation sewer which will be further treated in treatment plant installed by the Municipal Corporation Jalandhar. • Lastly, the consent to establish (NOC) was extended vide no. CTE/Ext/JAL2/2023/22586238 dated 15.09.2023 with validity upto 19.05.2024, subject to all terms & conditions as mentioned in the original ‘Consent to Establish’ & further ‘Consent to Establish’ extensions granted to the project and the following additional conditions that: 1. It will comply with all the conditions of the Environment Clearance granted to it by the SEIAA vide no. SEIAA/MS/2014/1327 dated 06.02.2014. 2. The project proponent will obtain permission from CGWA for extraction of fresh water. 3. The project proponent will comply with Municipal Solid Waste (Management & Handling) Rules, 2000. 4. The project proponent will install STP of adequate capacity and will dispose of treated effluent as per the details mentioned in Environment Clearance granted to it by the SEIAA vide no. SEIAA/MS/2014/1327 dated 06.02.2014. 5. The project proponent shall get the validity of Environment Clearance extended for another one year well before its expiry i.e. 05.02.2024 in accordance with OM dated 13.12.2022 issued by MoEF&CC & shall submit the copy of the same to the Board, thereafter. • Now, the project proponent has applied for consent to operate under Water Act, 1974 for operation & occupancy of Residential flats @ 187 numbers and commercial shops @ 50 numbers with requisite documents. • The project proponent has deposited Rs. 105600/- vide UTR no. AXSK240220007077 dated 22.01.2024 and the RO has calculated the adequacy of the same for grant of CONSENT TO OPERATE for one year. • Notably, the project proponent has submitted CA certificate dated 16.01.2024 mentioning the gross block of fixed assets of the project as Rs. 75.72 Crore as on 30.10.2023, however, the cost amounting to Rs. 106.39 Lakh under the Head of Govt. Charges (regulatory fees to Govt. Departments) has been incorporated in the fixed assets calculation. Therefore, effectively the gross block of fixed assets shall be around Rs. 74.66 Crore. Likewise, the fees deposited is valid for grant of CONSENT TO OPERATE for period of 1.25 years and is valid upto 30.04.2025. • The site of the project was visited by the officers of Regional Office on 25.01.2024 and observed as under: A. The project proponent has constructed 187 flats. About 20 flats are ready for occupancy. B. The effluent generation will be 100.9 KLD (187 x 5 x 135 x 0.8) which is within the discharge for which NOC as well as EC has been granted. C. The project proponent has installed STP of capacity 300 KLD for treatment of domestic effluent. The STP is based on MBBR technology. D. Flow meter has been provided at the outlet of the STP. E. The project proponent has developed green area in about 0.5 acres. Further, plantation is also being carried out on additional area of 0.5 acres. F. The project proponent has made agreement for lifting of solid waste to MC dumpsite. G. The project proponent has submitted approved layout and building plan endorsed by Chief Town Planner, Punjab, Chandigarh . • The RO has recommended that consent to operate under Water Act, 1974 may be granted to the project proponent for one year with usual conditions and with special condition that: a) The project proponent shall get its treated effluent sample analyzed from Board’s lab within one month. b) The project proponent shall not discharge more than 92 KLD treated effluent into MC sewer. In consideration of the report/ recommendations sent by RO; if approved, the Consent to Operate under the Water Act, 1974 for operation & occupancy of Residential flats @ 187 numbers and commercial shops @ 50 numbers, be granted to the project proponent upto 31.03.2025, subject to suitable conditons and the following additional conditions that: 1. This Consent is valid only for operation & occupancy of for operation & occupancy of Residential flats @ 187 numbers and commercial shops @ 50 numbers in the project for which ‘Consent to Establish’ already granted by the competent authority. 2. The promoter company shall comply with all terms & conditions mentioned in the Environmental Clearance granted by the SEIAA, Punjab vide no. SEIAA/MS/2014/1327 dated 06.02.2014. 3. The project proponent shall immediately apply for obtaining Consent to Operate under the Air Act, 1981. 4. In case of any further development/ progression in project, the project proponent shall get the validity of Environment Clearance extended for another one year in accordance with OM dated 13.12.2022 issued by MoEF&CC & shall submit the copy of the same to the Board, thereafter. 5. The project proponent shall comply with the conditions mentioned in the CLU(s) granted by the Competent Authority to it. 6. The project proponent shall not carry out any activity/ construction at site which obstructs the natural drainage through the site, in wetland and water bodies and the natural drainage system should be maintained for ensuring unrestricted flow of water. 7. In case, there is any change in the layout plan submitted by the Project Proponent at any stage or otherwise, then the project proponent shall apply to the Board for revised CTO before starting any construction/development activity at the site. 8. The project proponent shall install mechanical composter of adequate capacity for treatment of wet biodegradable solid waste. 9. The project proponent shall restrict its water consumption, waste water generation and abide by the treatment proposal for wastewater and solid waste, as per the proposal submitted by it. 10. The project proponent shall ensure operation of the arrangements provided for usage of the treated effluent after STP for flushing purpose and shall utilize max. treated effluent after STP for development of adequate green/ plantation area within premises and only the remaining treated effluent (no more than 92 KLD) shall be allowed for discharge into Sewerage System connected to terminal STP(s) installed by JDA in accordance with the permission accorded by the respective authority. 11. In case, the permission for discharge of effluent into the sewer line of JDA and/ or its disposal to the terminal STP of the concerned authority is denied or not allowed by the concerned authority/ respective department at any stage; then this Consent to Operate shall be deemed cancelled and the Board shall not be responsible for any financial liability arising due to cancellation of this CTO. In such case, the project proponent shall apply for fresh Consent to Operate alongwith concrete proof for alternate modes of disposal of treated effluent like availability of adequate land for utilizing treated effluents for plantation or to adopt other environmentally sound effluent disposal arrangements. 12. The project proponent shall carry out awareness and activities for the themes/ action points identified under Mission LiFE (Lifestyle for the Environment) by Ministry of Environment, Forests and Climate Change given at the website (http://missionlifemoefcc.nic.in). 13. The project proponent shall start carrying out complete water auditing of the project on daily basis, immediately, so that the quantity of freshwater consumed and treated effluent utilised for activities like irrigation, dual plumbing, construction purpose can be assessed. 14. The project proponent shall provide separate flow meters after STP on channels/ pipelines carrying treated effluent for reuse in dual plumbing, discharge onto green area and disposal into MC sewer, if not already provided and maintain record regarding the same. 15. The project proponent shall make use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021. 16. The project proponent will comply with the provisions of MSW Rules, 2016. 17. The project proponent shall ensure at source segregation of the solid waste to be generated from its premises, at all times. 18. The project proponent will maintain proper record of operation of composter and quantity of manure produced and its disposal. 19. The project proponent shall get the non-biodegradable solid waste disposed of at authorised site only, after obtaining permission from the Competent Authority and shall maintain proper record of disposal of the same, at all times. 20. The project proponent shall place adequate no. of storage bins in its premises, from where the municipal solid waste shall be got lifted and transported by the operator of the integrated MSW management facility as and when the facility is established and made operational. 21. The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 22. The project proponent will comply with the provisions of E-waste Management Rules, 2016. 23. The project proponent shall ensure that its activities does not create any nuisance in the surrounding areas and no public complaints are received. 24. The Consent is being issued to the project proponent based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 25. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
