RO reported that the industry was granted Consent to Operate under Air Act, 1981 with condition that the industry shall shift its Cupola furnace from premises in a non-designated area to the designated industrial area within a period of 6 months. The industry has failed to comply with the same. There is an ongoing litigation between the industry and the Govt. regarding the ownership of the unit. The industry has given a request for grant of consent to operate.
RO recommended that the request of the industry may be considered and 1. Directions u/s 31-A of the Air Act, 1981 may be issued for de-sealing of cupola furnace 2. The industry may be issued CTO under the Air Act, 1981 with suitable conditions.
In view of the above, it is recommended that :-
1. Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued for de-sealing of cupola furnace
2. Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be granted to industry for six months with suitable conditions and special condition that in case the final decision of the pending court case goes against the industry, the consent granted stands revoked.
